The court finds: 1. Decedent died testate on November 6, 2018, in Grant County, Washington. 2. Decedent was a resident of Grant County, Washington and left an estate subject to administration in Washington state, at the time of her death. 3. The offered documents purporting to be decedent's Last Will and Testament were executed by decedent as her Last Will and Testament on June 1, 2015 , in the presence of Susan J. Allen and W.C. Henry, competent and subscribing witnesses, who attested thereto in the manner provided by law. 4 . The decedent at the time of executing the said Will, was of legal age, of sound mind, not acting under duress, menace, fraud or undue influence and was competent to execute the same . Allen and W.C. Henry declare as follows: We are 13 Maxine Emma Fleming's attorneys. She knew the extent of her 14 property and the names of her surviving children. 15 I, Susan Allen and W.C. Henry met with Mrs . 16 Fleming where she was residing in Port Townsend, Washington in 17 May and June, 2015. 18 In those appointments we discussed her estate and her 19 desire to do a will. Susan Allen prepared a Will at her request 20 with the provisions that are set out in the Will. Maxine 21 Emma Fleming executed the Will on June 1, 2015. We witnessed the 22 Will and believe that Mrs. Fleming was not acting under any undue 23 influence nor was she incapacitated. 24 We made and kept a photocopy of the signed Will which is 25 attached hereto.
