Paulette Fleming's petition for the probate of decedent's
Last Will and Testament and for an order of solvency, came before
the court. The court finds:
1. Decedent died testate on November 6, 2018, in Grant
County, Washington.
2. Decedent was a resident of Grant County, Washington and
left an estate subject to administration in Washington state, at
the time of her death.
3. The offered documents purporting to be decedent's Last
Will and Testament were executed by decedent as her Last Will and
Testament on June 1, 2015 , in the presence of Susan J. Allen and
W.C. Henry, competent and subscribing witnesses, who attested
thereto in the manner provided by law.
4 . The decedent at the time of executing the said Will, was
of legal age, of sound mind, not acting under duress, menace,
fraud or undue influence and was competent to execute the same .

5. In said will, decedent appointed Paulette Fleming to act
2 as Personal Representative without bond and with non-intervention
3 powers.
4 6. The value of the estate is estimated to be $250,000.00
5 and the debts and cost of administration of the estate are
6 estimated to be $5,000.00.
7 7. Notice of Pendency of Probate Proceedings will be given
8 to the heirs, legatees and devisees of decedent's estate.
9 Based upon the foregoing, it is hereby ORDERED:
10 1. The copy of decedent's Will filed in this Court on the
11 f lf day of '/;p~, 20/g, be and is hereby established and
12 admitted to probate as the Last Will and Testament of Maxine Emma
13 Fleming, deceased;
14 2. Paulette Fleming is hereby confirmed as Personal
15 Representative of said Will, to serve without bond and she is
16 directed to file her Oath as required by law. The Clerk shall
17 issue Letters Testamentary to Paulette Fleming upon filing an
18 oath.
19 3. The estate is solvent and the Personal Representative,
20 may proceed to administer the Last Will and Testament in
21 accordance with the provisions without further order of this
22 Court.

12 Susan J. Allen and W.C. Henry declare as follows: We are
13 Maxine Emma Fleming's attorneys. She knew the extent of her
14 property and the names of her surviving children.
15 I, Susan Allen and W.C. Henry met with Mrs .
16 Fleming where she was residing in Port Townsend, Washington in
17 May and June, 2015.
18 In those appointments we discussed her estate and her
19 desire to do a will. Susan Allen prepared a Will at her request
20 with the provisions that are set out in the Will. Maxine
21 Emma Fleming executed the Will on June 1, 2015. We witnessed the
22 Will and believe that Mrs. Fleming was not acting under any undue
23 influence nor was she incapacitated.
24 We made and kept a photocopy of the signed Will which is
25 attached hereto. It is our practice to make and keep a photocopy ·
26 of all the executed estate documents that are prepared for
27 clients. The client kept the original. The nominated personal

representative is unable to locate the original Will and reports
2 that the original Will may be located in Quincy, Washington,

3 where he«mother was residing at the time of her death.
4 We believe that if Mrs. Fleming had wanted to change her
5 Will, she would have contacted our office.
6 We, Susan J. Allen and W.C. Henry, declare under penalty of
7 perjury under the laws of the State of Washington that the
8 foregoing is true and correct.

LAST WILL AND TESTAMENT
OF
I, MAXINE EMMA FLEMING, now domiciled in Jefferson County,
Washington, declare this to be my Will and revoke all prior wills
and codicils.
I. Family
My irrunediate family now consists of my children, JOSEPH B.
FLEMING, ANITA BEROSEK, PAULETTE FLEMING and JEANNIE RANGE.
II. Debts and Final Expenses
I hereby order and direct that all my just debts, for which
proper claims are filed against my estate, and my funeral
expenses and the expenses of my 1ast illness, be paid as soon
after my death as practicable; provided, however, that this
direction shall not authorize any creditor to require payment of
any debt or obligation prior to its normal maturity in due
course.

III. Loans
I have made loans to my children. Any unpaid loans at the
time of my death shall be shall be deducted from loan recipient's
share of my estate.
IV. Alternate Bequest
My estate shall be distributed to my children, JOSEPH B.
FLEMING, ANITA BEROSEK, PAULETTE FLEMING and JEANNIE RANGE, who
survive me, share and share alike, subject to the loan
deductions.
V. Personal Representative
I appoint Paulette Fleming as personal representative of
this Will, to act without bond. In the event that she shall
predecease me, or shall fail or refuse to act hereunder, or
having qualified so to act, shall thereafter die, become
incapacitated, resign, or be removed, then' I appoint Joseph B.
Fleming to act as personal representative, also without bond.
VI. Nonintervention Powers
I further direct that my estate be settled without the
intervention of any court, except to the extent required by law,
and that my personal representative settle my estate in such
manner as shall. seem best and most convenient to him or her; and
I hereby empower my personal representative to mortgage, lease,
sell, exchange and convey the personal and real property of my
estate without an order of court for that purpose and without

notice, approval or confirmation and in all other respects to
administer and settle my estate without the intervention of
court.
VII. Consultation
The personal representative shall consult with and inform
his or her siblings, heirs, on all major decisions regarding the
estate assets and expenses.
VIII. Final Wishes
I direct that on my death my remains be cremated and the
ashes disposed of on my parents' graves in Troutdale Oregon and
on my husband's grave in Fall City, Washington.
I have initialed for identification purposes the preceding
pages and the last page of this my Will and have executed ·the
entire instrument by signing this, the third and next ·to last
·fr page thereof, on this /;;r day , 2015, at Port
Townsend, Washington.

CERTIFICATE OF WITNESSES
(1) I am over the age of eighteen years and competent to be
a witness to the Will of MAXINE EMMA FLEMING.
(2) The Testatrix in my presence and in the presence of the
other witness whose signature appears below:
(a) -Declared the foregoing instrument, consisting of
four pages, of which this is the last, to be her Will;
(b) Requested me and the other witness to act as
witnesses to her Will and to make this unsworn statement; and
(c) Signed such instrument.
(3) I believe the Testatrix to be of sound mind, and that
in so declaring and signing, she was not acting under any duress,
menace, fraud or undue influence.
(4) The other witness and I in the presence of the
Testatrix and of each other now affix our signatures as witnesses
to the Will and make this statement.
Each of the undersigned declares under penalty of perjury
under the laws of the State of Washington that the foregoing is
true and correct.
