MINUTES
Week of November 4,2002
Chairman Richard W ojt called the meeting to order at the appointed time. Commissioner
Titterness and Commissioner Huntingford were both present.
Al Scalf, Community Development Director re: Requestfor Twelve (12) Month Extension
of Preliminary Long Plat Approval, SUB95-0085, Spigarelli Long Plat; To Divide 81 Acres into 16
Residential Lots; Located off of Kennedy Street, Port Hadlock; Don and Mary Spigarelli, Applicant: AI
Scalf explained that a preliminary long plat approval expires after 5 years. The preliminary plat approval can
be extended for 12 months by the Legislative Body if an application is made 30 days prior to the expiration
date. The Spigarelli's preliminary plat approval was issued on September 26, 1997 and was due to be
finalized September 26, 2002. Before the September deadline the property was sold to new owners who
submitted an application for a Planned Rural Residential Development (PRRD) on September 6,2002. The
new proposal was allowed under the original preliminary plat application, however, staff failed to notify the
new owners of the plat approval deadline and the requirement to apply for an extension 30 days prior to
expiration. The Department's recommendation is to extend the plat and allow the new owners to continue
with their cluster development. Under a new plat application, more recent regulations would apply for
buffers and set backs on wetlands, streams, aquifer recharge areas, and a slight landslide hazard area.
Commissioner Huntingford moved to deny the request for a 12 month extension of the preliminary plat
approval for the Spigarelli Long Plat. Commissioner Titterness seconded the motion and directed the
Community Development Department to work with the applicant on options for their project. Chairman Wojt
called for a vote on the motion. The motion carried by a unanimous vote.
COUNTY ADMINISTRATOR BRIEFING SESSION: County Administrator David
Goldsmith reported that the Washington Association of Counties (WSAC), the Washington Association of
County Officials (WACO) and the Association of Washington Cities (A WC) have put together a package of
information to be taken to the legislature about funding issues for local governments.

PUBLIC COMMENT PERIOD: The following comments were made:
· An article in the Peninsula Daily News was quoted regarding the efforts Clallam County is making for
the next 5 years to raise the average annual salary of residents and create new jobs. Clallam County is
using Jefferson County's ineptness and Port Townsend's reputation of chasing away businesses to
build up their businesses. There are organizations in Jefferson County that are using the Growth
Management Act as a weapon to stop growth. The County should go to the Legislature to get the
act changed.
· A request was made that the water pump at the Quilcene well be reopened and a volunteer offered to
turn on the water at the pump each morning and off each night. It was recommended that the County
and/or State put up signs on the rivers advising people to pick up their garbage when they are done
fishing and that a SaniCan be put at Rodgers and Muncie Streets in Quilcene for the fishermen.
· The Fred Hill Pit to Pier Project would bring 30 new family wage jobs to the County. Support was
expressed for this project and a group has been formed to get petitions of support signed for this
project.
· Grays Harbor County took the Satsop Nuclear Power Plant site and created an industrial area that
will have up to 1,600 high paying union jobs.
· Port Townsend's image is keeping businesses from locating here.
· Another person expressed support for the Fred Hill Material Pit to Pier project and urged the Board
to approve the mineral overlay amendment.
· A contractor advised that Fred Hill Materials is a very reliable company.
· A representative from Fred Hill Materials presented information on the ability of barges to go under
the Hood Canal Bridge. This is the most economical way to move gravel. Fred Hill Materials never
had any intention of strip mining 20,000 acres. They have a proposal to mine 600 acres in addition to
the 144 that are currently being mined.
APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Titterness
moved to delete Item 5 and to approve and adopt the balance of the items on the Consent Agenda as
presented.

WORKSHOP: Low Impact Development & Ecology Storm water Manual: Department of
Community Development Associate Planner Josh Peters introduced John Cambalik, Local Liaison, and
Bruce Wulkan, Stormwater Lead from Puget Sound Water Quality Action Team and Melodie Selby from
the State Department of Ecology who made presentations regarding Stormwater, the Puget Sound Water
Quality Protection Act, the Work Plan for 2001 to 2003, the Comprehensive Stormwater Management
Program Action Elements and the State Department of Ecology Stormwater Manual.
Katherine Baril, Cooperative Extension re: Marine Resources Committee: Cancelled.
Judi Morris, Treasurer re: Bonding to Raise Funds for Capital Improvements;
EOC/Dispatch, Sheriff's Administrative Project and Castle Hill and Courthouse Improvements:
Treasurer Judi Morris advised that a bond for $3.5 million for 20 years with an interest rate of 4.4% would
have an annual payment of approximately $250,000. The Real Estate Excise Tax that will be used to pay for
the bond is anticipated to bring in $290,000 annually. This tax is currently coming in at a higher rate than
budgeted. If the County bonded for $4.5 million, the payment over 20 years would be $341,000 annually at
the same interest rate. There are higher payments for 10 year bonds. The interest rates are the lowest they've
been in 30 years. There is enough income from the 1/4% Real Estate Excise Tax to fund the 20 year bond of
$4.5 million. If the Board acts on this immediately, the Bond Counsel advised that the County could have
the funds by December 27,2002. The project needs to be 90 to 95% complete within 3'years of the bond
Issuance.
David Goldsmith asked about the setup costs for the bonding. Judi Morris replied that the cost for $2.9
million is $21,000, with underwriting costs of $24,000. The Board members concurred that a bond be issued
for $4.5 since the interest rate is low. The paperwork will be started.

The Board met in Executive Session from 3:00 to 4:00 p.m. to discuss a personnel matter
with the County Administrator.
The meeting was recessed at the close of business on Monday and reconvened on Thursday,
November 7, 2003 at 7 p.m. at the Olympic Canal Tracts Club House in Brinnon. All three Board Members
were present.
HEARING re: Olympic Canal Tracts Proposed No Shoot Zone: Chairman W ojt opened the
public hearing at the appointed time.
Chris Allegri, stated that he lives on 4 Wheel Drive Road and is in favor of the no shoot zone. He submitted
a picture of a bullet hole through the roof of his house.
Wayne Donahue, stated that he also lives on 4 Wheel Drive Road and is in favor of the no shoot zone. He
was sitting on his deck one morning and his fiancé was sitting in the living room and the neighbor was
shooting a gun. The gun shots were deflected off a target and came very close to where he was sitting. He
got a gun, fired back and yelled that someone lived there. Since then, he and the neighbor have talked and
the neighbor agrees that it is too dangerous to be shooting a gun in that area because of the houses.
Thomas Waite, asked if the no shoot zone covers the mouth of the river? Hearing that it did not, he stated
that he had no comment.
Jacque Hartley, stated that the residents at the Canal Tracts want to have this zone designated because there
are people that indiscriminately fire semiautomatic weapons and talking to them doesn't help. Having a
designated zone means that when residents call and complain, law enforcement officers will be able to
respond and stop the shooting.
Brady Blake. stated that he has lived in the Canal Tracts for several years and he has called 911 a couple of
times because of people with pistols. He has no problem with designating a no shooting zone west of
Highway 101, but he doesn't like the eastern boundary of Hood Canal because he is a duck hunter.
George Sickel, explained that an attempt was made to establish this area as a no shooting zone 2 years ago
and the Sheriff was against it because the boundaries weren't clearly defined. Now the boundaries are very
distinct. Ifit does become a no shooting zone, the Sheriff will be able to take some action when they are
called.

Larry Hartley, stated that he approached a person by walking onto his property and asked him what he was
shooting at? The man had an AK47 that he had been shooting for hours. The man told him it was none of his
business, to get off of his property, and shot over his head as he was leaving. No one needs to shoot that kind
of weapon in a residential area. It happened again, and the Sheriff was called, but the Deputy said they
couldn't do anything.
Unidentified Man, explained that he is new to the area and wanted to see how the public hearing process
works. Listening to the testimony, he has heard of at least 4 crimes that were committed, including the
person who shot back at someone with his own firearm. There is no way to legislate people's attitude. The
Sheriff should have been called and the man locked up. If a person is carrying a weapon in this State and
loses their temper, it is considered assault.
Wayne Donahue, stated that there are 3 people sitting here today that would not be here if a stray bullet had
gone the wrong way.
Commissioner Huntingford explained that the Board established this ordinance for residential areas and he
believes that no shooting zones, when the boundaries are clearly marked, are a deterrent to indiscriminate
shooting of firearms. The boundaries that have been submitted for the Canal Tracts No Shooting Zone go
from the road down on the Duckabush River up to the power line, along the power line to MacDonald Cove
and MacDonald Creek and then back up. In the petition, it mentions the high tide mark. The Board received
a letter from the State Department ofFish and Wildlife about some of their property on the west side of the
road along the river. People duck hunt along the Canal so they may look at moving the boundary to the east
side of Highway 101. The letter also mentions a game management area near MacDonald Cove that needs to
be clarified by Fish and Wildlife. The proposed no shooting zone covers a large area, and the County will
need to contact Fish and Wildlife to get more information.
Arch Lopez, asked what charges are brought against a person for discharging firearms in the no shooting
zone? Commissioner Huntingford answered that there are civil penalties and the person is arrested and
charged with a misdemeanor. Upon conviction for the first offense, the fine is $100; consecutive offenses are
punishable upon conviction by a $250 fine and/or 90 days in jail. Mr. Lopez asked if a Deputy has to witness
the incident? He believes it is a waste of County resources because by the time the Deputy arrives the
incident is over in most cases.
Unidentified Woman, asked what would happen if someone was in their own home and needed to defend
themselves? Commissioner Huntingford said that the RCW states that a people have a right to defend
themselves.
Unidentified Woman, stated that when she has called the Sheriff's Office to complain about shooting, they
say that because she is in the County, there are no regulations about shooting. They just want to establish
some regulations for their area.
Unidentified Man, added that the high tide mark may be difficult for the Deputy to determine.

Hearing no further comments, the Chair closed the public hearing. The Board concurred that written
comment would be accepted until Friday, November 15 at 5 p.m.
Mark Millard, stated that there is an extreme high tide mark in that area and a person technically can't shoot
from the ground. He thinks it would be better to make the highway the boundary. It was mentioned that
guns are not to be discharged within a certain distance from the highway. A suggestion was made that
indiscriminate shooting could be dealt with through a noise ordinance instead of a no shooting ordinance.
The Board agreed to get more information from the Department of Fish and Wildlife, review the information
and testimony that is submitted. and put the ordinance on the agenda within a month.
The Board recessed at the close of the meeting on Thursday and reconvened on Friday from
] 0:00 a.m. to 2:00 p.m. for a Department of Natural Resouw;:s surface mining tour of several operations in
the County. The focus of the tour was on the various phases of reclamation. All three Commissioners were
present.

CREATION OF A "NO SHOOTING" AREA
IN THE VICINITY OF OLYMPIC CANAL TRACTS, DRINNON
NOTICE IS HEREBY GIVEN that the Jefferson County Commissioners have received and the
Auditor has found sufficient, a petition for the establishment of a "No Shooting" area known as
Olympic Canal Tracts located in Brinnon described as follows:
Beginning at the point of intersection of the centerline of U.S. Highway 101 and the centerline of
Duckabush Road;
Thence Northwesterly along the centerline of Duckabush Road to the intersection with the along
the most westerly line of the Bonneville power lines;
Thence Southwesterly along the most westerly line of the Bonneville power lines to the
intersection of said power lines with McDonald Creek;
Thence Southeasterly along McDonald Creek to the shoreline of Hood Canal;
Thence Northerly along the shoreline of Hood Canal to the tidal area at the mouth of the
Duckabush River;
Thence Northerly along the shoreline to a point along the shoreline that is due west of the
intersection of the centerline of U.S. Highway 101 and the centerline of Duckabush Road;
Thence west to the point of beginning.
Said property being portions of Sections 15, 16, 17,20,21,28 and 29 all in Township 25 North,

Re: No Shooting Petition in Olympic Canal Tracts

Dear Ms. Delaney,
On August 19, 2002, you sent me a letter saying that the boundaries that had been
submitted in our petition, are unenforceable. I was aware of a no shooting petition that
had been submitted and approved in the Triton Cove area with No Name Creek as the
north boundary, the JeffersonlMason county line as south boundary, the power lines as
the west boundary and Hood Canal as the east boundary. The number on this ordinance
is 07-0814-00. With this in mind, I would like to resubmit our petition, which states that
the Duckabush Rd. is the north boundry, McDonald Creek the south boundary, the power
lines the west boundary and Hood Canal on the east. In my opinion these boundaries are
much more enforceable than those from the Triton Cove ordinance.

Dear Ms. Delaney,
On August 19, 2002, you sent me a letter saying that the boundaries that had been
submitted in our petition, are unenforceable. I was aware of a no shooting petition that
had been submitted and approved in the Triton Cove area with No Name Creek as the
north boundary, the JeffersonlMason county line as south boundary, the power lines as
the west boundary and Hood Canal as the east boundary. The number on this ordinance
is 07·0814-00. With this in mind, I would like to resubmit our petition, which states that
the Duckabush Rd. is the north boundry, McDonald Creek the south boundary, the power
lines the west boundary and Hood Canal on the east. In my opinion these boundaries are
much more enforceable than those from the Triton Cove ordinance.

Re: Petition for a NO SHOOTING area for the Olympic Canal Tracts,
Brinnon, Wa.
Many of the residents of the Olympic Canal Tracts are concerned about
shooting that takes place within the Tracts, both in and out of the hunting
season. As the number of our permanent residents increases, it is felt that
we need to be able to get protection from the people discharging firearms
close to residences. Since there are no laws against this, we feel we must
petition the County Commissioners to make this area a NO SHOOTING
area. The Board of Tnlstees whole heartedly approves this request.
The enc1osed, signed petitions are our formal request to make the Olympic
Canal Tracts a NO SHOOTING area which wiII then give the Jefferson
County Sheriffs Department the authority to arrest anyone discharging a
firearm in this area.

The tirst petition enc10sed was signed at our annual meeting. While there

the Olympic Canal Tracts located in Brinnon. The petition was reviewed by the Jefferson
County Auditor's Office and was found to be sufficient, however the proposed boundary map
was found to be unenforceable by the Sheriffs Office. An example of an enforceable boundary
is a road, river, shoreline, powerline, etc. Please contact the Sheriffs Office at 360-385-3831
for their assistance in establishing an appropriate boundary.
Once you obtain and submit a new map to this office, the petition will again be reviewed
by the Jefferson County Auditor. After it is Certified by the Auditor's Office you will be

I am in receipt of the Proposed "No-Shooting Zone request for the Olympic Canal Tracts.
As depicted on the accompanying map, the South and West boundaries are non-physical
boundaries and would be almost impossible to enforce. Once away from a road, fence,
river or other physical marker, the Officer would find themselves in heavily forested
woods and/or undergrowth, and in those areas unable to determine if they were within the
No Shooting Zone. This would also be a "positive defense" for the shooter, if, they were
even located.
If the boundaries were to be set as so many feet west of the end of any county road within
the development, or something like that, it could possibly help in enforcing the statute.
But even then it would be difficult.

ORDINANCE NO. 03-0227-95
WHEREAS, the unincorporated private communities of Kala Point, Port Ludlow and Cape
George Colony, all located within the boundaries of Jefferson County, have, through their respective
Homeowner's Associations requested an ordinance setting forth procedures to establish "no shooting"
areas around their communities, and;
WHEREAS, the Board of Jefferson County Commissioners recognizes that persons
discharging firearms near such developed residential areas in unincorporated Jefferson County
presents a safety hazard to those residents; and
WHEREAS, the provisions of RCW 9.41.300 provide that Counties may enact laws or
ordinances restricting the discharge and possession of firearms in certain instances; and,
NOW, THEREFORE, BE IT HEREBY ORDAINED, by the Board of County Commissioners
of Jefferson County:
SECTION 1: PURPOSE
The purpose of this ordinance is to establish a process for the establishment of "no shooting" areas
in unincorporated Jefferson County and to provide regulation of the discharge of firearms in such
areas as provided below:
1) It is unlawful for any person to discharge fireantls in a "no shooting" area established by Jefferson
County. This ordinance shall not abridge the right of the individual guaranteed by Article I,
Section 24 of the State Constitution to bear arms in defense of self or others.
SECTION 2: FIREARMS DEFINED
The term firearm as used in this ordinance shall include, but not be limited to: pistols, revolvers,
shotguns, and rifles.
SECTION 3: CREATION OR DISSOLUTION OF A "NO SHOOTING" AREA
A) Petitions requesting the Jefferson County Board of Commissioners to create a no-shooting
area or dissolve an existing no-shooting area shall be filed with the Clerk of the Board of
Commissioners. Petitions shall contain the signatures of at least ten (10) elector-residents of
each voting precinct in the area under consideration. A map and legal description of the area
shall be included with these petitions.

SECTION 3 : CREATION OR DISSOLUTION OF A "NO SHOOTING" AREA -- Continued
B) After petition signatures have been verified by the Jefferson County Auditor - Elections, the
Jefferson County Board of Commissioners shall set a date of hearing. Legal notice of the
hearing shall be published one time in the official newspaper of the County at least ten (10)
days prior to the hearing.
C) If the County Commissioners find the formation or dissolution of the petitioned area to be
beneficial to the public health, safety and general welfare, the area shall be established as a
"No Shooting" area by ordinance. The Board of Commissioners shall consider, but is not
limited to considerations of the location, terrain and surrounding land use of the petitioned
area.
SECTION 4: VIOLATIONS - MISDEMEANOR - PENALTY - ARREST
A) Any person discharging a firearm in a "No Shooting" area is guilty of a misdemeanor. It shall not
be a violation of this ordinance when a person discharges a firearm in accordance with the
provisions ofRCW 9A.16.020.
B) Any law enforcement officer having information to support a reasonable belief that a person has
committed a violation of this ordinance, has the authority to arrest the person.
C) The first offense for violation of this ordinance constitutes a civil penalty not to exceed one
hundred ($100) dollars. Consecutive offenses are punishable, upon conviction, by a fine not to
exceed two hundred and fifty ($250) dollars or by confinement in the County jail for a period of
not more than ninety (90) days.
SECTION 5: ENFORCEMENT OFFICERS AND PROCEDURES
Enforcement of this ordinance may be by any State or County law enforcement officer, State game
officer, or State Fish and Wildlife officer. All such enforcement officers are empowered to issue
citations to and/or arrest without warrant, persons violating the provisions of this ordinance. Said
enforcement officers may serve and execute all warrants, citations and other process issued by the
courts.
In addition, mailing by registered mail of such warrant, citation or other process to the last known
place of residence ofthe offender shall be deemed as personal service upon the person charged. Said
enforcement officers may seize and hold as evidence the weapon and ammunition of any person
violating the provisions of this ordinance.
SECTION 6: SEVERABILITY
If any section, word or words of tlus ordinance are found to be unconstitutional, or otherwise invalid,
such constitutionality or invalidity shall not affect the remaining portions of the ordinance.
SECTION 7: INTERPRETATION
In the event any other County ordinance, whether or not codified, is in conflict with any of the terms
of this ordinance, the more stringent shall be construed as applicable.

Information reaardina the No-Shootina Area Petition
Many of the residents of this area, along with those at Cape George, Port
'Ludlow and other heavily residential areas, have been concerned about the
shooting that has occurred both in and out of hunting season. As our
re$idential density increases, it was felt that we needed some kind of
protection from the small percentage of people discharging firearms so
close to residences. The Sheriff had advised that there were no laws to
prevent this. Accordingly the matter was brought before the County
Commissioners who enacted an ordinance permitting us to request specific,
identifiable no-shooting areas. This petition makes that formal request and
will then give the Sheriff the authority to arrest anyone discharging a
firearm in this area. The Boards of Kala Point, Cape George and Port Ludlow
have all endorsed this effort to protect the lives and property in their
respective no-shooting areas.

Prepare a Petition. The petition should clearly state what the petition seeks to do, i.e., establish
a NO SHOOTING area, and a general description of where the proposed NO SHOOTING area

SIGNS FOR POSTING A "NO SHOOTING" ZONE
Signs and posting of signs along the boundary of a "No Shooting" Zone are the
responsibility of the property owners within the boundary of the zone.
The following is recommended by the County:
1. Signs may be made of any suitable material that is able to withstand the
weather conditions of this area.
2. The signs will be no larger than 8 1/2" by 14".
3 . The sign will be bright yellow in color with black lettering.
4. As a minimum, signs shall be posted at all boundary comers and at all entry
roads into the Zone.

IN THE VICINITY OF OLYMPIC CANAL TRACTS. BRINNON
NOTICE IS HEREBY, GIVEN that the Jefferson County C0m-
missioners have received and the Auditor has found suffi-
cient, a petition for· the establishment of a 'NoShooting"
area known as Olympic Canal Tracts located in Brinnon de-
scribed as follows:
Beginning at the point of intersection of the centerline of
U.S. Highway 101 and the centerline of Duckabosh Road;
Thence Northwesterly along the centerline of Duckabush
Road to the intersection with the along the most ~sterIy
line of the Bonneville power lines;
~nce Southwesterly along the mostwesterJy.line of the
Bonneville power lines to the i.ntersectlon of said ~
lines w~ McD6nald Creek; .
Thence' Southeasterly along McDonald Creek tothè ~
line of Hood Canal;
Thence Northerly along the shoreline of Hood Canal to the
tidal area at.the mouth of the Duckabush River;
Thence Northerly along the shoreline to a point along the
shoreline that is due west of the intersection of the center-
line of U.S. Highway 101 and the centerline of Duckabush

Many of the residents of this area, Olympic Canal Tracts, have been concerned about the shooting that has occurred both in and out of hunting
season. As our residential density increases, it is felt that we need some kind of protection /Tom the small percentage of people discharging firearms
so close to residences. The Sheriff had advised that there were no laws to prevent this. Accordingly,the mailer was brought before the County
Commissioners who enacted an ordinance permitting us to request specific. identifiable no-shooting areas. This petition makes that formal request
and will then give the Sheriff the authority to arrest anyone discharging a firearm in this area. The Board of Olympic Canal Tracts has endorsed this
cITon to protect the lives and propeny in the Olympic Canal Tracts no-shooting area.

Many of the residents of the Olympic Canal Tracts are concerned about

season. As the number of our pennanent residents increases, it is felt that
we need to be able to get protection from the people discharging firearms
close to residences. Since there are no laws against this, we feel we must
petition the County Commissioners to make this area a NO SHOOTING
area. The Board of Trustees whole heartedly approves this request.
The enclosed, signed petitions are our formal request to make the Olympic
Canal Tracts a NO SHOOTING area which wiIJ then give the Jefferson
County Sheriffs Department the authority to arrest anyone discharging a
fireann in this area.

The first petition enclosed was-signed at our annual meeting. While there
are signatures of non-full time residents as well, it shows that many of our
members have a great concern over this issue. The copy is of a petition we
had sent in previously, but was turned down because we had not been able to
define our boundaries we]] enough for law enforcement to be able to enforce
the NO SHOOTING law.
