The attached Match Agreement with the Federal Highway Administration (FHWA) is necessary in order to initiate the expenditure of FLAP funds by Western Federal Highway Lands (WFL) division. Analysis/Strategic Goals/Pros £t Cons: Oil City Road is showing signs of embankment erosion and deterioration throughout its entire 10.98 mile length from HWY101 to the west along the north bank of the Hoh River. Olympic National Park Wilderness is accessible from this road. An assessment is needed to identify bank stabilization options for vulnerable road segments in future river migrations which will cause costly emergency repairs. This study will pursue hydraulic, geomorphic, geotechnical and environmental criteria for WFL engineers to begin planning projects and programming funds to alleviate emergency access concerns and possibly road relocation. Fiscal Impact/Cost Benefit Analysis: This agreement commits WSDOT toll credits in the amount of $39,017 (13.5%) as match for the FLAP funds. The County receives project benefit valued at $250,000 as performed by WFL. No county road funds are programmed for this project in the adopted 6-year TIP. Recommendation: The Board is requested to authorize the chair of the Board to sign three originals of the federal Match Agreement and return all three originals to the Public Works department for further processing. Revi ed By: P flip Morle , out r Date ofa Aelpee Federal Lands Access Program Western Federal Lands Highway Division,FHWA US Department of Transportation g p p 610 E.Fifth Street Federal Highway Administration Match Agreement Vancouver,WA 98661 State: Washington Project Number/Name: WA JEFF 134309(1), Oil City Road Engineering Assessment Parties to this Agreement: U.S. Department of Transportation Federal Highway Administration Western Federal Lands Highway Division, FHWA and Jefferson County Purpose of Agreement: The purpose of this agreement is to document the intent of Jefferson County to meet its match requirement for the subject project as authorized under 23 USC 201(b)(7)(B) With this agreement, Western Federal Lands Highway Division, FHWA authorizes this project as eligible for federal participation. The purpose of this project is to conduct an engineering assessment for a project that will preserve vehicular access to Olympic National Park Wilderness, South Coast Trail,the Pacific Northwest National Scenic Trail, Washington State Dept. of Natural Resources Land, Hoh River Trust Land, and private property. This agreement does not commit the parties to complete the project, but, rather sets forth the respective responsibilities as the project proceeds. Any subsequent decisions to complete final design and to construct the project will depend on authorizing legislation, NEPA analysis, availability of appropriations, and matching funds at the time of obligation. The authority for FHWA to enter into this agreement is under Title 23 U.S.C. Section 204. Funding: The Federal Lands Access Program(FLAP) under Fixing America's Surface Transportation Act (FAST Act) authorizes FHWA to provide funding for specific projects. The Program Decision Committee (PDC), consisting of FHWA,the State of Washington, and an organization representing the local agencies of the state, is designated to jointly decide upon projects funded in the state. The PDC has selected this project for programming under the Washington State Federal Lands Access Program. All FLAP expenditures associated with this project after execution of this match agreement will need to be matched by a Non-Federal source, by other Federal funds other than those made available under Titles 23 and 49 of the United States Code, or by funds made available under 23 U.S.0 202 and 203.The matching requirement under the FAST Act will be met by Jefferson County and other agencies that have committed to the project in subsequent agreements. The forms of match shall be those consistent with the 'Federal-Aid Guidance Non-Federal Matching Requirements' and as approved by FHWA. In the state of Washington,the match rate is 13.5% of the total project cost. This project is authorized to use a Tapered Match. Under this approach,the non-Federal match is imposed over the entire project rather than individual progress payments. The terms and form of the Match will be documented in the project Memorandum of Agreement(MOA) in coordination with the appropriate agencies to be executed at a later date. The final Match will be determined based on actual expenditures at the conclusion of project work. Matching cash funds in FHWA receipt may need to be supplemented, or returned, once actual expenditures are determined. This document does not commit FHWA to advance the project or provide funds for the project, but provides the required matching funds if FHWA expends funds to advance the project. The following agencies have agreed to contribute the amounts shown which will reduce the federal share by the same amount. Jefferson County is ONLY responsible for their respective match as shown above. The required local match is currently estimated at$39,017. This is based on a FLAP funding amount of$250,000 and $39,017 of WSDOT Toll Credits.The value of the match will be confirmed during the development of the Project Memorandum of Agreement.
