Along with providing physical space for a NFP RN, First Step Family Support Center will collaborate with Jefferson County Public Health in reaching out to local Physicians, Midwives and families with information about the NFP program in an effort to reach and recruit eligible pregnant women to the NFP program. FISCAL IMPACT/COST BENEFIT ANALYSIS: There is no exchange of money associated with this agreement. RECOMMENDATION: JCPH Management recommends BOCC signature of the MOU with First Step Family Support Center to house one Registered Nurse for Jefferson County Public Health Nurse Family Partnership program; Upon signature — until terminated REVIEWED BY: - 6, ip Morley, �i�.unty Administrator Date Community Health Environmental Public Health Developmental Disabilities 360-385-9444 360-385-9400 (f) 360-379-4487 360-385-9401 (f) Always working for a safer and healthier community Memorandum of Understanding First Step Family Support Center and Jefferson County Public Health Jefferson County Public Health and First Step Family Support Center both provide health education and prevention based services for families in Jefferson and Clallam Counties. The collaboration therein seeks to better serve low income families with children 0-2 years old in Clallam County where Nurse Family Partnership's intensive home visiting for high risk families has not been available until now. This MOU represents First Steps Family Support Center's willingness to host one Nurse Family Partnership Nurse Home Visitor in their agency upon hire. First Step Family Support Center will: A. Host/house one NFP RN at our facility, located at 323 E. 6th St. Port Angeles, WA. This RN will be employed by Jefferson County Public Health,trained by Jefferson County Public Health,and supervised by Jefferson County Public Health; B. Utilize First Step Family Support's current referral and outreach systems for identifying and referring first-time pregnant(<1=28 weeks gestational age)women to this NFP RN for NFP service; C. Collaborate with Jefferson County Public Health in reaching out to local Physicians, Midwives and families with information about the NFP program in an effort to reach and recruit eligible pregnant women to the NFP program; D. Provide a desk,access to a copier, scanner, fax machine,access to a refrigerator and microwave, a key to the building,and access to internet services ; and, E. Designate parking accommodations at First Step Family Support for the NFP RN. Jefferson County Public Health will: A. Provide liability coverage for the JCPH employee; B. Provide a computer and printer(laptop or desktop, monitor,keyboard and mouse); C. Provide a cell phone and cell phone service; D. Provide a two drawer file cabinet and office supplies such as pens,pencils, white out, note books, etc.; E. Provide an office chair that meets the needs of the JCPH employee; F. Provide all supplies and equipment necessary for the NFP RN to participate in meetings/trainings/webinars onsite; G. Provide all supervision, required by the NFP model for fidelity,to the NFP RN; 1 H. Provide reimbursement to First Step Family Support Center for copier charges incurred monthly via invoice to JCPH;and, I. Provide mileage reimbursement and all accompanying vehicle support to JCPH employee for attending home visits,meetings and trainings authorized by the NFP supervisor. Shared Responsibilities include: Both agencies agree that there will be no charge to the other agency for these services,except for copies made by JCPH staff. Both parties agree to be responsible for the negligent acts or omissions of its own employees, officers,or agents in the performance of this Agreement. Designated Contacts: The designated contact person for First Step Family Support will be Venita Lynn and the designated person for contact with Jefferson County Public Health will be Yuko Umeda,NFP supervisor. Confidentiality: The Parties to this Agreement and their employees and representatives, and subcontractors and their employees, will maintain the confidentiality of health information.All health services are protected as required by the Health Insurance Portability and Accountability Act of 1996 ("HIPPA")and all other applicable federal and state privacy laws. Termination: Any party may terminate this MOU for any reason upon at least sixty(60)days written notice. Any Party may also terminate this MOU at any time if the other party defaults in any of its material obligations,but only if such defaults have continued for a period of ten(10)days after the receipt of a written notice from the other party. Amendment: This MOU may be amended by mutual written consent of all the parties. No Partnership of Joint Venture. Nothing in this MOU shall create or be deemed to create any relationship of agency,joint venture, or partnership between the parties to this MOU. Neither shall any party have the power to bind or obligate any other in any manner except as expressly provided in this MOU. Limitation on Waiver. Any waiver,express or implied,by any party of any rights,terms,or conditions of this MOU shall not operate to waive such right, terms, or conditions or any other rights, terms, or conditions beyond the specific instance of waiver. 2 No Discrimination. No party shall discriminate or permit discrimination against any person or group of persons on the basis of race,color,creed, national origin,age, gender,sexual orientation, religion, marital status,or qualified individuals with disabilities. All parties shall comply with the Americans with Disabilities Act and all regulations interpreting or enforcing such Act. Indemnity. Each party to this MOU shall indemnify, defend, and hold harmless the other party and their officers,agents,employees,and volunteers from and against any and all claims,lawsuits,demands for money damages, losses or liability,or any portion thereof, including attorney's fees and costs, arising from any injury to person or persons(including the death or injury of to any other party to this MOU or damage to personal property) if said injury or damage was caused by the negligent acts or omissions of the that party. In the event of concurrent liability, the parties shall have the right of contribution in proportion to the respective liability of each party. Nothing contained in this section shall be deemed to waive immunities established pursuant to state statute or to create third-party right or immunities. Required Liability and Workers Compensation Coverage. The parties to this MOU shall obtain and keep in force during the terms of this MOU or as otherwise required, the following coverage with commercial companies or through other sources such as Risk Pools,approved by the State Insurance Commissioner pursuant to Ch. 48.05 RCW: A. Worker's compensation and employer's liability insurance as required by the State of Washington. B. Commercial Automobile Liability Coverage providing bodily injury and property damage liability coverage for all owned and non-owned vehicles assigned to or used in the performance of the work for a combined single limit of not less than$1,000,000 each occurrence. C. General Commercial Liability Coverage, or the equivalent from other sources such as Risk Pools legally authorized to operate in the State of Washington, in an amount not less than a single limit of one million dollars($1,000,000.00)per occurrence and an aggregate of not less than two (2) times the occurrence amount ($2,000,000.00 minimum) for bodily injury, including death and property damage. The insurance coverage shall contain no limitations on the scope of the protection provided and shall include the following minimum coverage: 1) Broad Form Property Damage,with no employee exclusion; 2) Personal Injury Liability, including extended bodily injury; 3) Broad Form Contractual/Commercial Liability- including completed operations 4) Premises- Operations Liability(M&C); 5) Independent; and, 6) Blanket Contractual Liability. Required Professional Liability Insurance. 3 If any party or its employee sis required to be professionally licensed or certified by the State in the performance of services under this MOU, that party shall maintain professional liability insurance in the amount of not less than one million dollars ($1,000,000). No Joint Acquisition of Property. This MOU does not contemplate the joint acquisition of property by the parties. At termination, each party will remain the sole owner of its own property. Integration. This MOU,together with attachments or addenda, represents the entire and integrated MOU between the County and the said parties and supersedes all prior negotiations,representations, or MOUs written or oral between the parties. Term: This Agreement is effective upon hire of the new Nurse Family Partnership RN (Jefferson County Public Health's employee)in 2019,and will continue year to year thereafter. This Agreement will be reviewed no later than two years from its effective date,or earlier upon request.
