Recommendation
Mr. and Mrs. Walsh applied for a geotech waiver during the course of a stormwater permit
application. Mr. and Mrs. Walsh plan to construct a single-family home. Mr. and Mrs. Walsh's
property is mapped as an unstable shoreline slope area. I have reviewed Mr. and Mrs. Walsh's
waiver request, available map and data, and completed the attached geohazard checklist. Mr. and
Mrs. Walsh will implement applicable best management practices during construction. Mr. and
Mrs. Walsh's stormwater permit does not trigger a geotech, as her site is less than 15% grade.
The grade of the entire parcel is 8% and the highest concentrated slope on the property is 17%
near the mapped stream. The stream has a buffer of 50 feet, larger than the 30 -foot buffer
required from geologically hazardous areas in Jefferson County Code (JCC) 18.22.170(6)(f).
Based on our available data, Mr. and Mrs. Walsh's site, proposed development, and analysis
from the geohazard checklist I find that the standards for a geotechnical report waiver, under
JCC _18.22.370, have been satisfied.

1- Stable zone — The entire proposed development is located within an area designated as
stable per GIS mapping (see exhibit A).
2- Moderate risk area isolated — The moderate risk area is located on the opposite side of a
ravine that runs through the property, the proposed development is topographically
disconnected from the area (see exhibit A).
3- Favorable hydrology — The hydrology on the site is directed toward the ravine, which
provides a natural flow path through the high risk areas to the East. This feature will minimize
potential impact to these areas (see exh ib it A).
2- Distance to high risk landslide areas — The high risk landslide areas mapped to the East
are approximately 325' from the proposed development. This distance should allow any
concentration of water from the development to disperse and migrate appropriately so as not
to cause stability issues (see exhibit A).
3- No signs of erosion, or landslide activity in area of proposed development

Please read this form carefully and be aware that, in applying for and receiving a permit
for development, you are knowingly and willfully seeking a waiver from the requirement of a
professional geotechnical report describing your Property, proposed development, and potential
risk of earth movement. Your Property contains a mapped Geologically Hazardous Area, a
Critical Area as defined by Chapter 18.22 of the Jefferson County Code. Mapped Geologically
Hazardous Areas may contain site features, such as soil, hydrology, or topography features that
increase the risk of earth movement, which may present a risk to life and property. In accordance
with permitting the construction of the items described and listed below within an
Environmentally Sensitive Area, Applicant(s) acknowledge and agree as follows:
1. Applicant(s) desire to clear for a single-family residence, construct a septic system and
build a single-family residence. The Property is located within a Geologically
Hazardous Area with an Unstable Shoreline Slope Area and Seismic Hazard Area.
Applicant(s) agree that they are fully aware of the risks inherent in development in a
Geologically Hazardous Area, an Unstable Shoreline Slope Area and Seismic Hazard
Area.
2. Applicant(s), as their own free and voluntary act, accept, and assume all risks of loss or
damage arising out of the conditions described herein and further agree to relieve
Jefferson County, its agencies, divisions, officers, agents, and employees of any
liability, damages, claims, or other expenses arising as a result of or allegedly as the
result of the approval of the development and the approval of the Applicant(s)' proposed
development.

3. Applicant(s) agrees to and shall hold harmless and indemnify the Jefferson County, its
agencies, divisions, officers, agents, and employees from and against any and all
liability, loss, claims, suits, damages, costs, expenses (including attorney's fees) that
may arise at any time, occur or be generated as a result of any reduction in the fair
market value of the Applicant(s)' Property and/or any damage to personal property or
personal injury by reason of the conditions existing now or any time hereafter on or
around the Applicant(s)' Property or due to any design, development, or construction
pursuant to the building permit, stormwater management system approval, septic permit,
or any other development permits issues thereunder by the Jefferson County, its
agencies, divisions, employees, agents, officers, or representatives pursuant to any then
applicable state statute, administrative code, regulation, or Jefferson County ordinance.
4. If any term of this Waiver is to any extent invalid, illegal, or incapable of being
enforced, such term shall be excluded to the extent of such invalidity, illegality, or
unenforceability; all other terms shall remain in full force and effect.
5. All associated permits must be obtained or development must be substantially started
within one-year from the effective date of this Waiver. If this condition is not met, the
Waiver shall be void.
6. Development and associated permits must substantially comply with the Exhibit "A"
Site or Development Plan.
7. This Waiver is not a permit of any type.
