MINUTES Jefferson County Board of Commissioners Regular Meeting — Monday, February 10, 2020, 9:00 a.m. Jefferson County Courthouse—Commissioners' Chambers 1820 Jefferson Street, Port Townsend, WA CALL TO ORDER: Chair Greg Brotherton called the meeting to order at the appointed time in the presence of Commissioner David Sullivan. Commissioner Kate Dean was absent. PUBLIC COMMENT PERIOD: The following is a summary of comments made by individuals in attendance at the meeting and reflect their personal opinions. • Comment regarding the Constitution and the Supreme Law of the Land. • Comment regarding stroke protocol and taking the drug Dextromethorphan to reduce the effects of a stroke. • Comment regarding a recent meeting held by the Tarboo Ridge Coalition. The Commissioners addressed comments and concerns raised during the Public Comment Period. APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Sullivan moved to approve the items on the Consent Agenda as presented. Chair Brotherton seconded the motion. The motion carried. 1. HEARING NOTICE re: Critical Areas Ordinance; Hearing Scheduled for March 2, 2020 at 6:30 p.m. in the Superior Court Courtroom, Jefferson County Courthouse, 1820 Jefferson Street, Port Townsend, WA 2. RESOLUTION NO. 04-20 re: In the Matter of Finding and Determination to Declare Certain Personal Property as Surplus and Authorize Disposal 3. AGREEMENT,Amendment No. 1 re: Engineering Design for the Courthouse Boiler Replacement; Additional Amount not to Exceed $33,000; Jefferson County Central Services; LNS Engineering 4. AGREEMENT re: Oak Bay Campground Electrical Project; In the Amount of$36,079; Jefferson County Public Works; Henden Electric, Inc. 5. AGREEMENT re: Land Appraisals and Acquisitions for the Olympic Discovery Trail—Four Corners Road to Anderson Lake State Park; In An Amount Not to Exceed $9,800; Jefferson County Public Works; RF Duncan& Associates, Inc. 6. MEMORANDUM OF AGREEMENT re: Amending Appendix A—Wage Table 2020 & 2021 of the Sheriff's Administrative Staff Collective Bargaining Agreement, and Implementing Pay Equity Adjustments for the Sheriff's Administrative Staff Based on the Results of the Total Compensation Study Conducted by Cabot Dow; Jefferson County; Teamsters Local #589 1 DRAFT Commissioners Meeting Minutes of February 10, 2020 7. BID AWARD re: 2020-2021 Supply of Aggregate for Bituminous Surface Treatment, Project No. 18020390; In the Amount of$202,917; Jefferson County Public Works; Bruch and Bruch Construction, Inc. 8. MINUTES re: Regular Meeting Minutes of February 3, 2020 9. Payment of Jefferson County Vouchers/Warrants Dated February 10, 2020 Totaling $791,511.15 (Records of all claims submitted for payment along with vouchers approved and signed by the Board of Jefferson County Commissioners are retained by the Jefferson County Auditor and Public Works Department.) 10. Payment of Jefferson County Payroll Warrants Dated February 5, 2020 Totaling $978,068.07 and A/P Warrants Done by Payroll Dated February 5, 2020 Totaling $921,514.42 (Records of all claims submitted for payment along with A/P Warrants approved by the Payroll Services Manager are retained in the Jefferson County Auditor's Office) COMMISSIONERS' BRIEFING SESSION: The Commissioners discussed recent meetings they attended, upcoming meetings and discussed a special request to change hearing testimony rules. The Commissioners agreed not to change the hearing testimony rules. BRIEFING re: Olympic Peninsula Narcotics Enforcement Team (OPNET): Sheriff Joe Nole, Prosecutor James Kennedy, and Chief Civil Deputy Prosecuting Attorney Philip Hunsucker briefed the Board on a potential agreement with OPNET and answered questions posed by the Board. The meeting was recessed at 10:22 a.m. and reconvened at 10:36 a.m. with Chair Brotherton and Commissioner Sullivan present. COUNTY ADMINISTRATOR BRIEFING SESSION: County Administrator Philip Morley reviewed the following with the Board. • Senior Management Team; 2020-2023 Work Program o Proposed Retreat in March 2020 • ADDITIONAL BUSINESS re: Legislative Priorities Special Meetings: Commissioner Sullivan moved to cancel the remaining Special Meetings to discuss Legislative Priorities that were set to occur every Friday at noon through the end of March 2020. Chair Brotherton seconded the motion. The motion carried. If there is a need to hold a Special Meeting to discuss legislative priorities in the future, a Special Meeting will be called. • Upcoming hearing re: Commercial Shooting Facilities; information and logistics NOTICE OF ADJOURNMENT: Commissioner Sullivan moved to adjourn the meeting at 10:53 a.m. until the next regular meeting or special meeting as properly noticed. Chair Brotherton seconded the motion. The motion carried. The following County staff were also present: County Administrator Philip Morley, Chief Civil Deputy Prosecuting Attorney(DPA) Philip Hunsucker, and Department of Community Development Associate Planner Michelle Farfan. HEARING re: Proposed Ordinance Amending Ordinance No. 14-1209-19 Establishing a Moratorium on Commercial Shooting Facilities in Unincorporated Areas of Jefferson County: Chair Brotherton reviewed the procedure for the public hearing. County Administrator Morley explained the reason for the hearing and the Growth Management Hearing's Board decision. Chair Brotherton opened the hearing for public testimony. The following individuals provided testimony: John Austin, Deborah Pederson, George Yount, Peter Newland, David Whipple, John Ebner, Tim Green and Flora Mace. Hearing no further testimony, Chair Brotherton closed the oral portion of the hearing. The special meeting was recessed at 1:52 p.m. and reconvened at 2:00 p.m. with all three Commissioners present. HEARING re: Two (2) Proposed Ordinances: 1) Amending Ordinance No. 12-1102-18 for Commercial Shooting Facilities under Title 8 JCC Health and Safety, as recommended by the Jefferson County Planning Commission in their December 3,2019 Recommendations, as well as on a range of options discussed in the County's SEPA Checklist in the County's response to Question A.11; and 2) Repealing and Replacing Ordinance 15-1214-18 and Amending Title 18 Jefferson County Code Ordinance, as recommended by the Jefferson County Planning Commission in their December 3,2019 Recommendations, as well as on a range of options discussed in the County's SEPA Checklist, in the County's response to Question A.11: Chair Brotherton reviewed the procedure for the public hearing. Commissioner Dean moved to accept written testimony through 4:30 p.m. on Tuesday, February 11, 2020. Commissioner Sullivan seconded the motion which carried by a unanimous vote. Chief Civil DPA Hunsucker gave a PowerPoint presentation on Staff's Analysis of Planning Commission's Recommended Commercial Shooting Facility Ordinances. DRAR Commissioners Special Meeting Minutes of February 10, 2020 Chair Brotherton opened the hearing for public testimony. The following individuals provided testimony: John Austin, Steve Cherry, Jean Ball, Pamela Roberts, Teri Hein, William Thorness, Kathleen Waldron, John Quinn, Steve Ranka, Peter Newland, Alex Sidles, Janet Welch, Mark Jochems, Riley Parker, John Ebner, Carl Youngman, Scott Freeman, Susan Freeman, Phil Vogelzang, George Yount, Diane Johnson, Patricia Jones,Amanda Kingsley, Aaron Don, Rowan Sharp, Sonia Saxon, Judith Alexander, Tami Pokorny, Tim Green, Jason Victor Serinus, Sharon Saint Don, Cynthia Koan, Marjorie Bell, Carol Gallup, Lorna Smith, Eric Pratt, John Minor, CJ Rankin, Charlotte Wells, and Donald Mazzola. Hearing no further testimony, Chair Brotherton closed the oral portion of the hearing. He stated again that the written testimony will be accepted through Tuesday, February 11, 2020 at 4:30 p.m. NOTICE OF ADJOURNMENT: Commissioner Dean moved to adjourn the meeting at 4:03 p.m. until the next regular meeting or special meeting as properly noticed. Commissioner Sullivan seconded the motion which carried by a unanimous vote.
