HomeMy WebLinkAboutM021820 4)N c o�i'sRINO MINUTES Jefferson County Board of Commissioners Regular Meeting — Tuesday, February 18, 2020, 9:00 a.m. Jefferson County Courthouse—Commissioners' Chambers 1820 Jefferson Street, Port Townsend, WA CALL TO ORDER: Chair Greg Brotherton called the meeting to order at the appointed time in the presence of Commissioner Kate Dean and Commissioner David Sullivan. PUBLIC COMMENT PERIOD: The following is a summary of comments made by individuals in attendance at the meeting and reflect their personal opinions. • Comment regarding the Commercial Shooting Facilities Ordinance. • Comment regarding the County's proposed Agreement with Olympic Peninsula Narcotics Enforcement Network(OPNET). • Comment regarding the Commercial Shooting Facilities Ordinance. • Comment regarding the Parkland School shooting, individuals' use of guns, and PTSD triggers. • Comment regarding noise from Navy Growlers on Whidbey Island, noise coming from the Jefferson County Sportsmens Association and indoor shooting ranges. • Comment regarding the Commercial Shooting Facilities Ordinance, and support of indoor shooting ranges. • Comment regarding the Commercial Shooting Facilities Ordinance. • Comment regarding the County's Equestrian Park and proposed indoor ranges. • Comment regarding the Commercial Shooting Facilities Ordinance. The Commissioners addressed comments and concerns raised during the Public Comment Period. Chair Brotherton read a poem by Wallace Stevens "Anecdote of the Jar." APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Sullivan moved to approve the items on the Consent Agenda as presented. Commissioner Dean seconded the motion which carried by a unanimous vote. 1. RESOLUTION NO. 05-20 re: Re-Establishing Jefferson County Cash Drawers, Petty Cash Account and Revolving Fund Amounts in Various County Departments 2. AGREEMENT re: Well Decommissioning; In the Amount of$11,306.57; Jefferson County Environmental Public Health; Oasis Well Drilling, Inc. 3. AGREEMENT re: Maternity Support Services and Infant Case Management; In the Amount of $2,400; Jefferson County Environmental Public Health; Discovery Behavioral Health 4. AGREEMENT NO.WQC-2017-JeCoPH-00167,Amendment No. 1 re: Water Quality Combined Financial Assistance, Strait Priority Areas;No Dollar Amount, Time Extension Only; Jefferson County Public Health; Washington State Department of Ecology (DOE) 1 Commissioners Meeting Minutes of February 18, 2020 5. AGREEMENT NO. ADVISORY BOARD REAPPOINTMENT re: Clean Water District(CWD) Advisory Council; Four(4) Year Term Expiring on December 12, 2023; District No. 3 Representative, Richard Hull 12. MINUTES re: Regular Meeting Minutes of February 10, 2020 and Special Meeting Minutes of February 10, 2020 13. Payment of Jefferson County Vouchers/Warrants Dated February 5, 2020 Totaling $3,734.86 and Dated February 18, 2020 Totaling $661,209.94 (Records of all claims submitted for payment along with vouchers approved and signed by the Board of Jefferson County Commissioners are retained by the Jefferson County Auditor and Public Works Department.) 14. Payment of Jefferson County Payroll A/P Warrants Done by Payroll Dated February 6, 2020 Totaling $146,493.86 (Records of all claims submitted for payment along with A/P Warrants approved by the Payroll Services Manager are retained in the Jefferson County Auditor's Office) COMMISSIONERS' BRIEFING SESSION: The Commissioners discussed their meeting schedules and recent meetings they attended. Chair Brotherton stated the 7th and Hendricks Affordable Housing Project is not moving forward this year, and an affordable housing discussion followed. CERTIFICATION: Annual Inventory of the Capitalized Assets as of December 31, 2019: Clerk of the Board/Human Resources Manager Erin Lundgren stated that each year,the Commissioners certify the County's annual assets. She added that Directors have already verified the inventory to be true and accurate and she administered the Verification of Oath for each of the Commissioners. DISCUSSION AND POTENTIAL ACTION re: Olympic Peninsula Narcotics Enforcement Team (OPNET) Interlocal Agreement: The Board met with Prosecutor James Kennedy, and Chief Civil Deputy Prosecuting Attorney Hunsucker to review the potential Interlocal Agreement with OPNET. After discussion, Commissioner Sullivan moved to approve the agreement. Commissioner Dean seconded the motion which carried by a unanimous vote. 2 Commissioners Meeting Minutes of February 18, 2020 COMMISSIONERS' BRIEFING SESSION-Continued: County Administrator Philip Morley discussed an upcoming JeffCOM meeting regarding regionalization. The Commissioners continued to review their meeting schedules. County Administrator Morley announced that he would like to schedule a Board of County Commissioner Special Meeting on March 17, 2020 from 9:00 a.m. to 5:00 p.m. at Camp Beausite, where the Commissioners will meet with the County's Senior Management Team to discuss Strategic Planning. Commissioner Dean moved to schedule the Special Meeting. Commissioner Sullivan seconded the motion which carried by a unanimous vote. The meeting was recessed at 10:28 a.m. and reconvened at 10:45 a.m. with all three Commissioners present. DELIBERATION re: Proposed Ordinance Amending Ordinance No. 14-1209-19 Establishing a Moratorium on Commercial Shooting Facilities in Unincorporated Areas of Jefferson County: Chief Civil Deputy Prosecuting Attorney (DPA)Philip Hunsucker explained that there was question as to whether the proposed ordinance was clear enough, so the current version of the ordinance aims to clarify questions that arose during the process. County Administrator Philip Morley stated the Board could direct staff to bring forward final ordinance language for adoption at a future meeting, and that it would essentially allow for any pre-existing legal non-conforming commercial shooting facilities that have a Resource and Conservation Office (RCO) grant,to move forward effective immediately, consistent with RCWs, on temporary moratorium and that the six months extension takes place upon the expiration of the current 6 month period. Commissioner Dean stated she would make that aforementioned motion but would clarify the motion. She asked if staff will be bringing it back to us to consider perhaps next week? County Administrator Morley replied yes. Chair Brotherton asked if the existing moratorium would still go until the 23r1 of March. County Administrator Morley replied yes, but would allow for grant activity for a pre-existing legal non-conforming commercial shooting facility that has an RCO grant, that would be effective immediately, so we would be amending the existing ordinance to allow for that but the new six month extension of the moratorium would only take place upon the expiration of the current moratorium on the 23rd of March. Chair Brotherton and Commissioner Dean asked clarifying questions about the moratorium date which were answered by County Administrator Morley and Chief Civil DPA Hunsucker. After a brief discussion, Commissioner Sullivan seconded Commissioner Dean's motion. Commissioner Dean stated she would like to clarify her motion. She moved to direct staff to modify the existing moratorium or consider repeal and replace to clarify both the March 23, 2020 ending date and beginning date and be explicit about the Jefferson County Sportsmens' Association proceeding with RCO work. County Administrator noted that with the repeal and replace, that might happen before March 23rd, so it wouldn't be necessarily explicit of the March 23, 2020 date, but to make sure that the extension is only for six months and that the allowance for the RCO grant take place immediately, however best accomplished. Commissioner Dean retracted her motion. The Commissioners asked more clarifying questions. Commissioner Sullivan moved to direct staff to bring forward a resolution with the recommendations regarding the moratorium on gun ranges. Commissioner Dean seconded the motion. County Administrator Morley clarified that rather than a resolution, it will be an ordinance. The Commissioners agreed to the amendment to the motion. Chair 3 Commissioners Meeting Minutes of February 18, 2020 Brotherton called for a vote on the motion which carried by a unanimous vote. COMMISSIONERS' BRIEFING SESSION-Continued: Chair Brotherton read a poem by Wallace Stevens"Anecdote of the Jar" again which he relates to the Growth Management Act. He discussed a Bill regarding milk which did not pass. Commissioner Dean discussed the County's new property valuations. DELIBERATION re: Proposed Ordinance Amending Ordinance No. 12-1102-18 for Commercial Shooting Facilities under Title 8 Jefferson County Code Health and Safety and Proposed Ordinance Repealing and Replacing Ordinance 15-1214-18 and Amending Title 18 Jefferson County Code: Chair Brotherton gave an overview of the proposed ordinances. County Administrator Philip Morley and Chief Civil Deputy Prosecuting Attorney (DPA) Philip Hunsucker and the Board reviewed and made edits to several line items of the proposed ordinances on Title 8 and Title 18. Chief Civil DPA Hunsucker suggested the Commissioners could direct staff to prepare new draft ordinances based on the discussion held today, with proposed changes to the Whereas clauses, so they can be reviewed in context and then make further edits during the next deliberation session. Commissioner Sullivan moved the aforementioned proposed motion. Commissioner Dean asked if a motion was necessary? Chief Civil DPA Hunsucker replied it was not. Commissioner Sullivan withdrew his motion. The Board directed staff to incorporate Board comments into revised line-in line-out drafts for Title 8 and Title 18 ordinances for approval at the February 24, 2020 Board of County Commissioners meeting. Deliberations on both ordinances will continue at the next meeting. NOTICE OF ADJOURNMENT: Commissioner Dean moved to adjourn the meeting at 12:33 p.m. until the next regular meeting or special meeting as properly noticed.
