I'm writing to suggest that before the County finds the application in MLA 19-0036 complete,
the County request the applicant to provide a recorded land survey and map, by a certified civil -
engineer, of Parcel #721031007 (Smersh residence), including related tidelands.
In BDN's application materials thus far, various diagrams and various assertions or omissions
are made concerning the size and perimeters of the parcel/site, whether it is served by septic,
whether it has wetlands, whether it has impervious surface, etc. The applicant appears to want to
refer only to the tidelands, when that is convenient, and only to the land portion, when that is
convenient. The result is impermissible blanks and false or misleading answers.
No professional land survey has been submitted with the proposal, and no professional survey
appears to be in the county records for Parcel #721031007. (An imprecise, hand -drawn diagram
can be found in connection with a permit application circa 1991 or so.)
A professional survey of Parcel #721031007 would show the following items that are relevant to
the application:
a) The total perimeter and acreage of Parcel #721031007. This should include the land
portion, as well as any tidelands, if they are part of Parcel #721031007. If the tidelands
are not part of that parcel, then they should be shown separately and identified by DNR's
or other official identification number.
b) The boundary line between Parcel #721031007 and Hicks County Park. (Note: public
land cannot be taken by adverse possession.)
c) The boundary line between any Smersh tidelands and the tidelands of Hicks County Park.

d) Impervious surfaces. (BDN has said there are none, which is flatly false, as there is a
house and garage, very recently remodeled, and parking areas on the parcel, among other
things.)
e) Sep 'tic system, drain field, and backup drain field, and their distances from the ordinary
high-water `mark and other relevant points.
1) . Wetlands.
g) Fill, bulkhead, and banking features —all of which Smersh constructed before he built his
house.
h) Bones Creek. (This is the creek that BDN virtually ignores but which has carried salmon
and cutthroat trout, per Point No Point Treaty correspondence and per neighbors. It is
also the creek that Smersh diverted and rechanneled into a salmon -barring high culvert, in
connection with which he received a stop -work order.) This would allow measurement of
buffers and setbacks.
i) Shine Road public right-of-way. Smersh's house/garage appears to be well into the
public right-of-way connected with Shine Road. It's not clear how these impervious
surfaces have been considered in the application.
An authoritative survey will help everyone concerned and is necessary to review essential
elements of the proposal.
