JEFFERSON COUNTY HEALTH DEPARTMENT BOARD OF HEALTH MEETING 9:30 a.m. April 5, 1978 Health Department Conference Room Minutes • Present were: Board of Health Members - B.G. Brown, A.M. O'Meara f and Chairman, Carroll Mercer. Staff Members; Randy Durant, Joseph Fischnaller M.D., and Gael Stuart. Call to order: Chairman Mercer called the meeting to order, a quorum was present. Minutes: The minutes of the March 15, 1978 meeting were read and approval with the correction of typographical errors and the error in the date set for this meeting April 5, 1978. corresoondence: 1. A copy of the resolution 78-03 from the City Council of the City of Port Townsend empowering the Jefferson County Health Department to enforce its regulations within the city limits of the City of Fbrt Townsend was presented and made a part of the minutes. 2. A copy of a letter to Mayor Joseph Steve requesting that he or a representative attend the Board of Health meetings is attached. 3. A letter from Grady and Holloway, Attorneys, regarding drainage problems at Cape George Colony is attached. The involvement of the County Engineer was questioned because public roads are not involved. Old Business 1. The board instructed Gael Stuart to meet with David Abeam and Herbert Kuzniczi to final_ze the plans for distribution of assets of the Olympic Health District and present a recommendation to the commissioners of the two counties for their consideration. 2. The board suggests that compensatory time and vacation time earned as employees of the Olympic Health District I hasos*ak -a..u.s,. • • be paid to each employee. In cases where the employee wants more than annual leave due for 1978, the administrator will allow the additional time without, pay. The sick leave obligation will be transferred to the new health departments with no financial consider- ation. The administrator will recommend the above as a part of the distribution of assets formula. New Business €e 1. The administrator was instructed to write a resolution for budget extension to include the changes necessary for the C.E.T.A. grant for a home health aide and the Maternal Child Health grant: The resolution will be presented to the county commissioners after consultation with Fran Hanson of the auditor's office. 2. The staff and some Board of Health members have tenta- tively set April 20, 1978 as a date to meet with school officials and citizens to help determine the needed health services for Western Jefferson County. Reports 1. public Health Nursing: Phyllis Bee was absent due to illness, but it was reported that the Well Child Clinics are well attended and the grant will be approved after minor revisions. , g 2. Environmental Health - Randy Durant: a. The fee schedule is in the process of development and recommendations will be made. • b. Randy will develop a release of liability form in cooperation with the prosecuting attorney. It is • hoped that the release of liability can become a part of-the-deed. There is a question about the legal value of a release of liability. c. The development of an appeal procedure was discussed. It was decided that a statement be written on the notice of denial of approval that the denial could be appealed to the County Health Officer. The county commissioners would schedule a further hearing if the findings of the health officer were not satisfac- 1 tory. The hearing would be scheduled by Jerdine Bragg on Tuesday during the extension of the commissioners meeting. The need for diplomacy with the public was stressed. It was acknowledged that the sanitarians were in a difficult position. d. The monthly report of the environmental health department was presented. Activity has increased greatly since last year. (Attachments) e. The food program report was presented. (Attachmert 2) f. The food service ordinance was presented. (Attachment 3 ) g. The fees for annual permits was presented. (Attachment 4) It will be effective July 1, 1978. Copies will be sent to all food service establishments. W_. ,-Y • • 3. Administrator's Report - Gael Stuart: a. Cialiam County Health Department has been billed for the insurance premium for Dr. Fischnaller. b. Colleen Parker's time will be expanded to four days per week and she will receive fringe benefits accord- ing to County policy. 4. f{ealth Officers Report - Joseph Fischnaller M.D. a. Dr. Fischnaller reported that Dr. Waltei Miller may -A be available to read x-rays. b. Meetings will be held with local medical associations to explain our programs and to hear their concerns. c. The contract for the Clallam County health officer calls for 35 hours per month. d. When staff is scheduled to attend out of town meetings they are to notify the commissioners secretary at the courthouse. We are advised by Mr. Randall Durant and Mr. David Cunningham that although there is no formal established hearing procedure in this matter you will certainly entertain the information we have offered to present. Mr. Ralph P. Anderson has advised Mr. Becker that a report is being prepared at this moment by Roats Engineering Company based upon a site inspection by M.r. Herb Armstrong, Professional Engineer. This report will deal with the flood potential, ecological aspects, and potential damage to contiguous properties which may result from a septic tank and drain field in this gully. FiEREAS, under the provision of R.C.'J. 70.05.060 and R.C.W. 71.46.360, the Board of Health is charged with the duty of making such rules and regulations as may be necessary for the prevention, suppression and control of dangerous_ contagious or infectious disease and ',THEREAS, the following rules and regulations are necessary for the prevention suppression and control of dangerous contagious or infectious disease now there- fore, BE IT RESOLVED by the Jefferson County Board of Commissioners that the following be adopted as regulations. SECTION I 1.1 The State Board of Health Rules and Regulations, Food Service Sanitation, e s adopted June 3, 1963, is hereby adopted by reference as the Rules and Regulations worming Food Service Sanitation in the Jefferson County Health Department. 1.2 The 1962 Edition of the United states Public Health Service rood Sanitation Ordinance and Code is hereby adopted by reference as the official interpretation of this ordinance, where applicable. 1.3 'there a conflict may occur between this ordinance and the 'State Board of Health Regulations, or the PIS Food Sanitation Ordinance and Code, the Jefferson County Health Department Regulations take preference, with State Board of Health Regulations second preference and the PHS Sanitation Code third. SECTION II 2.1 Permits.. A valid permit issued by the Health 'ffice shall-be required for any person to operate a food service establishment within the jurisdiction of the Jefferson County Health Department. Only persons who comely with the minimum re- quirements of these regulations shall be entitled to receive and retain such a oermit. Permits shall not be transferable from one person to another or place other than that specified on the permit. A valid permit shall be posted in a conspicuous place in every food establishment. Permits for temporary food service establishments shall be issued for a period not to exceed 14 days. Wit•- 400111.1.ssss. • rY • • Page 2 2.2 Permit Application: A written application for a Permit shall be made on forms provided by the health Officer. Such application shall include the name.. or names of the applicant and whether such application is for an individual firm, corporation or partnership. The application shall include location of operation and type of food service proposed and any other information requested on the form to help a. evaluate the proposal. Applications for temporary food service establishments shall include the inclusive dates of the proposed operation. 2.3 Permit Issuance. A permit shall be issued by the Health Officer after receipt of the application and an inspection of the premises reveals compliance with minimum requirements and upon receipt of inspection fees as established by this Ordinance. • 2.4 No food service establishment shall operate after the effective date of this resolution except in compliance with the provisions of this Ordinance and unless there is conspicuously displayed on the premises thereof a valid and current Food Service Establishment Permit. 2.5 Permit Suspension: The Health Officer may susnend the Permit to operate for failure to comply with these Pules and le'ulations. Whenever a food establish- agent fails to comply with the Demerit provisions of this Ordinance the operator shall be given the opportunity to attend a Hearing called by the Health Officer for the purpose of reviewing the inspection records and arriving at a mutually satisfactory schedule of compliance with all violations of these rules and regulations. Not with- Standing this provision of these regulations, should the Inspecting Officer have reasonable grounds to believe that unsanitary, or other conditions exist which con- stitute a substantial immediate hazard to public health he shall contact the Director of Environmental wealth and/or the County Health Officer who ray without warninm. notice or hearing issue a written notice that the Permit to operate is immediately suspended. 2.6 Permit Suspension Appeal Whenever a food service establishment operator feels agrieved by the decision made by the Health Officer following a hearing. he may within 5 days file a written notice of appeal with the Jefferson County Superior Court. SECTION III 3.1 Inspection Records, Demerit Values, Demerit Scores The Health Officer shall cause to be made inspections of all Food Service Establishments at least annually, or at frequent enough intervals to assure compliance with these Rules and Regulations. Upon completion of the inspection the demerit values of all violations shall be totaled and the establishment notified in writing on the inspection forms in use. 3.1.a Demerit values shall be those established in the 1962 Food Service Manual or as subsequently amended, a copy of which is attached and becomes a part of this Ordinance. 3.2 Demerit Scores 3.2a '►hen a demerit score of an establishment is 20 or less, all violations of 2 or 4 demerit points must be corrected by the time of the next routine inspection. .amm.a.mm, smma- ammeemeememmum ,ems$ • • Page 3 . .., 3.2.b When the demerit score of an establishment is more than 20 but not more than 40, all items of 2 or 4 demerits must be corrected within a period not to exceed 30 days. 3.2.c When one or more 6 point demerit items are in violation, regardless of demerit score, such items must be corrected within a period of `time not to exceed 10 days. 7 3.2.d When the Demerit Score of an establishment is more than 40 the Permit Is subject to immediate suspension by the Environmental Health Director, or the County Health Officer, if in the opinion of the Inspecting Officer an immediate health hazard exist:; or if the Food Service • Establishment has on record a demerit score of 20 or more on the previous inspection. 3.2.s In the case of temporary food service establishments, violations most be corrected within a specified period of time not to exceed 24 hours. Failure to comply with such notice shall result in immediate suspension of the permit. SECTION IV 4.1 Additional Provisions: In addition to those requirements set forth by the • Stets Board of Health Rules and Regulations and the interpretation by the U.S. Public Health Service Code, 1962 Edition, the following stipulation shall also be met. 4.1.a All Food Service Establishments, other than Temporary establishments, that are constructed or extensively reconstructed after the effective date of this Ordinance, shall have toilet and handwashing facilities for each sex which are available to the public and which are avail- able without passing through a food processing or storage area. 4.1.b All threaded water taps inside or outside the establishment shall be equipped with approved siphon beakers or other backflow pre- vention devises. 4.1.c Where hand dishwashing is in use, all food service establishments that are constructed or extensively reconstructed after the effective date of this Ordinance shall provide a separate drain connected metal compartment with convenient spray attachment adjacent to, but separate from the sink wa^hing compartment for the purpose of scraping and prerinaing eating and drinking utensils. 4.1.d It shall be the duty of the operator of every establishment to see that all Food Service Workers are in compliance with State Law re- quiriag such workers to obtain valid Food Service Workers Permits. 4.1.e Access to establishments. The Eealth Officer, after proper identi- fication, shall be permitted to enter any food establishment at any reasonable time for the purpose of inspecting the establishment and/or equipment to determine compliance with these regulations. SECTION V i i. Fees as per Jefferson County Health Department Fee Schedule. Page 4 SECTION VI 6.1 Review of Plans: Prior to the construction or remodeling of any Food Service Establishment plans for such construction or remodeling shall be submitted to the health department for review and approval prior to issuance of a Building Permit commencing any construction or remodeling. SECTION VII 7.1 Penalties: Any person violating or failing to comply with any of the provisions of these rules and regulations shall be guilty of a misdemeanor. In addition thereto, such person can be enjoined from continuing such violation. Each day upon which such violation occurs shall constitute a separate violation. 7.2 The Prosecuting Authority of the county or municipality in which any alleged violations may occur and/or the County Health Office shall be empowered to enforce the provisions of this ordinance. 7.3 Any section of this ordinance not covered in WAC 248.84 (Rules and Regula- tions of the State Board of Health - Food Service Sanitation) may be waived by the Jefferson County Health Department if it causes a hardship on the operator and it cash* shown that no health hazard will result. SECTION VIII 8.1 Constitutionality: Should any section, paragraph, sentence, clause or Ores* of these rules and regulations be declared unconstitutional or invalid for any reason, the remainder of said rules and regulations shall not be affected thereby. SECTION II These Rules and Regulations are necessary for the prevention, supression and control of dangerous, contagious or infectious disease and shall be in full force and effect on January 1, 1978. 84-JC$D/1-78
