Mercer, Member Joseph Fischnaller, M.D. Gael Stuart, Administrator MINUTES • November 7, /979 9:30 a.m. Meeting called to order by Commissioner Mercer in the absence of Chairman O'Meara. Commissioner Brown was present. MINUTES: The minutes of October 3, 1979 were approved by motion of Commissioner Brown, seconded by Commissioner Mercer. CORRESPONDENCE: None OLD BUSINESS: I. Appeal. Florence Moss for Lots 1 & 2, Block 15, Gise Addition. Ms. Boss is appealing a site evaluation that was found to be unacceptable by the Health Department on 8/6/79 and 10/26/79 due to 1) Inadequate lot size to accomodate proposal and subject to high water table; 2) Inadequate lot size for both well and drainfield. Ms. Boss is proposing to construct a 3 bedroom home with private well and repair present septice system. On the lot now is a mobile home. The property is currently served by a sand point well and the existing septic tank and drainfield's construction is unknown. The lot is boardering the mill pond so a minimum of a 75 foot set back is required. Mr. David Brown appeared to represent Florence Hoss. Mr. Brown reported to the Board of Ms. Hoss' background and explained her business and living circumstances. Ms. Hoss is facing a hardship, her husband was drowned last year and she has 3 dependant children. She conducts .her business, hanging gill nets, on this site which takes a considerable i amount of space and to find another site suitable for herbusiness would be I very difficult. Mr. Brown stressed that Ms. Hoss has insufficient funds to I relocate. Randy Durant is uncertain a drainfield for a 3 bedroom house can be designed for this lot with a well. (Attachment #1) Qmtnissioner Brown moved to grant a variance if Durant & Fischnaller can work out a solution to locate the well and septic system so that it doesntt create a health hazard and it meets set back requirements. Commissioner- Mercer seconded the motion. 2. Material on Co-generation of energy that was presented to Administrator Gael Stuart at the last meeting. Mr. Stuart, after reviewing the material, advised the Board that at the present time the development of a proposal would be too complex for the Health Department. David Goldsmith, Director of Planning, attended a seminar on Co-generation and reported that because of the quantity needed it would be unfeasible. 3. Discussion of immunization. Phyllis Bee reported on the immunization that ( - has been done in schools K through 6 this year. Port Townsend - 208 out of 4 750 enrolled were in noncompliance (27%) ; Chimacum - 90 out of 380 were in 11 noncompliance (20%); Quilcene - 4 out of 137 enrolled were in noncompliance (2.98); Brinnon - 1 out of 30 were in noncompliance (3%) . - Port Townsend Schools have sent out exclussion letters to those in non- s compliance. The other schools have sent out only warnings. Health Board Meeting November 7, 1979 Page 2 - 0 NEW BUSINESS: 1. Discussion on personnel matters. REPORTS: 1. Public Health Nurse; Phyllis Bee a) Report of Nursing Service (attachment #2) Extra Well Child Clinics have been added but the clinics are overwhelmed with participants. b) Home Health Program. Report that Clallam County wishes to discontinue servicing Jefferson County. Dr. Fischnaller and Phyllis Bee brought up the possibility of Jefferson County applying for grants to set up its own program. Jefferson County is eligible to apply. Ms. Bee explained that Jefferson County has been doing the Home Health Program in entirely except for the paper work, which Clallam County has been doing. The Health Department will explore the possibility of setting up thier own program and grants. 2. Environmental Health; Randy Durant a)Activities Report (attachment #3) b) Proposed Pee Schedule for 1980 (attachment #4) Randy submitted a draft fee schedule. After review and discussion the Board advised an -additional increase in the travel immunizations. Randy will further research the fee schedule for "Repair - Commercial systems" under Septic Tank Permits. No action was taken at this time. c) Proposed Definitions Additions. (attachment #5) Randy submitted the ' following changes:l)Sewage definition - Repair, New Installation, New Installation-Commercial, and Larger System - Section III, Ordinance 2-77. 2) Section 5,5 - Increase $1,000.00 bond to $2,000.00 minimum. No ation was taken at this time. d) Class 4 Water System, a small public water supply which consists of 9 or less taps. WAC requires the local Health Officer and Department to adopt rules and regulations that apply to Class 4 Systems. A contract must be drawn with DSHS to define each department's responsibility in the case of all Water Systems. A copy of the proposed contract was submitted (attachment #6) . Dr, Fischnaller and Randy Durant reviewed and approved it. An ordinance and fee schedule needs to be adopted. Board reviewed all documents. 3. Public Health Officer; Dr. Fischnaller a) Report of Health Officers' Meeting, Dr. Fischnaller reported that they discussed changes in Federal Laws regarding the support of public health at the local level. 314D money can no longer be appropriated to the counties by a need basis but must be divided by matching monies in order to emphasize county funding participation. This would cut all counties except King County. Jefferson has been cut to $3,200.00 which could possibly be changed. b).Possible necessity to close two establishments due to bad inspection reports. Tjemsland's Store and Roma Inn Tavern. The replacement, addition, or alteration of a septic tank, distribution box, tight line, or other appurtenances to an existing individual sewage disposal system, and including any replacement, addition, or alteration to a sub-surface disposal field where at least a portion of the original sub-surface disposal field is used. In those instances where no portion of the existing drainfield or septic tank is to be use, it will be considered the same as a new installation." ANEW INSTALLATION. A system to serve not more than a 2-family residen- tial unit, or a business requiring not more than a 1,250 gallon septic {; tank." `NEW INSTALLATION - COMMERCIAL. A system to serve all other commercial buildings or mutt-family dwellings over 2-family units." "LARGER SYSTEM. Systems with greater than 3500 gallons per day sewage flow disposed of on land." Proposed Change Section 5.5 - Increase $1000 bond to $2000 minimum. This ordinance is promulgated pursuant to RCW 70.05.060 and Chapter 248-54-570 WAC and is adopted to insure the pro- tection of public health through the provision of minimum requirements and standards for design, construction, operation and maintenance of Class 4 Water, Systms. • SECTION 2. ADMINISTRATION. This ordinance is administered according to the Water System Plan of Operation between the Washington State Department of Social and Health Services and the Jefferson County Health Department signed and approved or hereafter amended. DATE SECTION 3. DEFINITIONS. Unless otherwise noted by an asterisk (*) all defini- tions listed below are de?fined under WAC 248-54-560 "Rules and Regulations of the State Board of Health Regarding Public Water Systems". (1) "Class 1 System" (2) "Class 2 System" (3) "Class 3 System" (4) "Class 4 System" (5) "Community Water System" (6) *"Compliance Program" -A schedule in writing, documenting the public water systems deficiencies, recommend improvements, and a schedule for completion. SECTION 4. PLAN REVIEW - FEE. (1) A, fee for administration of these rules, plan review and well site inspection is required. (2) The fee for a Class 4 Public Water System plan review and inspection shall be as follows: (a) Well site inspection: $20.00 (b) Plan review Class 4 Systems (5 or more connections): $65.00 (c) Plan review Class 4 Systems (Less than 5 connections): $35.00 (3) Engineers design of all water systems is required unless wavied by the Health Officer. The design engineer shall be licensed with the State of Washington and have experience in water system design. SECTION 5. EXISTING, NON-EXPANDING SYSTEMS - APPROVAL. (1) Any existing Class 4 Water System not have approval of the health officer shall complete the information requested in the Class 4 design requirements for existing water systems within the intent and purpose of the applicable provisions of the following sections of the Rules and Regulations Regarding Public Water Systems: WAC 248-54-600 (2) (e) (i), 248-54-620 (1) (a) (b) (d), 248-54-640 (under the terms of the Water System Plan of Operation provided for in WAC 248-54-570), 248-54-660, 248-54-680, 248-54-700, 248-54-710, 248-54-740, 248-54-780 and 248-54-790. (2) Any factor to be out of compliance shall be grounds for denying a building permit or sewage disposal permit. If the water system is not approved, the purveyor shall develop a compliance program acceptable to the Health Officer and Department of Social and Health Services to bring the system up to standards. SECTION 6. NEW OR EXISTING, EXPANDING SYSTEMS - REQUIREMENTS. (1) Every purveyor before obtaining approval to install, for the purpose of operating any new or any portion of a Class 4 Water System, or additions, extensions or alterations of an existing Class 4 Water System shall complete the information requested in the Class 4 design requirements for new or expanding systems within the intent and purposes of the applicable provisions of the following sections of the Rules and Regulations Regarding Public Water Systems: WAC 248-54-600, 248-54-640 (under the terms of the Water Systems Plan of Operation provided in WAC 248-54-570), 248-54-660, 248-54-680, 248-54-700, 248-54-710, 248-54-740, 248-54-780, and 248-54-790. rr.aiw mimow rw.NIM.ON. smossommossomorm .,y.... .wx£ _ � ,. •, .. ..may CC � 4mnt. #6- +3- SECTION 7. ENFORCEMENT. If after investigation the health officer finds that any public water system fails to comply with the law or with this ordinance, the health officer may send a compliance letter to the purveyor of the public water system, which letter shall include the following: specification of the areas where the public water system fails to meet the requirements of the law or of this ordinance; and specifications of time deadlines for submission of any steps designed to bring the public water system into compliance with the law or this ordinance. In the event the purveyor fails to comply with the law or this ordinance by the deadlines set out in the compliance letter, the department may take legal actions as it deems necessary under RCW 43.20.170 and RCW 70.05.120 in order to assure compliance of the public water system with the law and this ordinance.
