MINUTES: The minutes of October 7, 1980 were approved as corrected by motion of Commissioner Mercer, seconded by Commissioner Brown. Unanimous. . CORRESPONDENCE: 1. Letter from John Beare, Division Director, DSHS, regarding proposed legislation for shared State funding for local health protection (attachment f #1) 2. Letter from John Beare, Division Director, DSHS, regarding the level of support from DSHS for the SCAN system. Effective October 1, 1980, SCAN financial support will be limited to a percentage of the average 1977 monthly billings which will be $50.00 per month for Jefferson County Health Depart- ment. Excess will be billed back to the County. (attachment #2) 3. Letter from Toni M. Lenhardt requesting a variance to the hot water requirement for the proposed "Going Up" food service in an elevator. (attach- ment #3) Durant advised that he doesn't support a variance. Commissioner Brown moved to deny the request for variance, Commissioner Mercer seconded the motion. Unanimous. 4. Report on the need and availability of office space. Mr. Stuart reiterated the problems. The plans are to divide the present conference room into 2 office spaces and develop the basement lounge into a conference room. The Board authorized to have maintenance persome 1 give a cost estimate of the job. t NEW BUSINESS: 1. Budget discussion as it relates to health programs. The programs have not increased in revenue but stayed the same. (attachment #5) They discussed possible solutions for additional revenues or decreased services. REPORTS: i I. Section 'I. (1) Th4 legislature f that:. (a)` health of all state residents is dependent upon the availability of adequate public health protection. (b) The level of public health protection varies from one 1 �I - geographic area to another; • (e) Differences in the fiscal capacities among local public heallth departments affect the level and amount of public fi health services available; (d) The ability of local governments to finance public health protection has decreased while state mandates and public expenditures for public health services have increased; (2) The legislature declares that public health services shall: (a) Be delivered by or through local public health departments; (b) Adequately protect, promote, maintain, and improve the health-of all citizens by focusing on community health vs. individual health; (c) !aphasize personal responsibility through the provision of a broaid. range of information which enhances the indivi- dual's ability to be healthy; (d) Include health promotion, health education, epidemiology, £ and case *anageatent as integral elements of each public health program, and • (e) is a 'shared financial responsibility of both local and state govermeents. (3) Therefore, the purpose of this act is to recognize the finan- cial responsibility of the state in providing an adequate level of public health protection. -I- I r 1 _ .. } Section 2. As used in the chapter and.unlessthe context indicates J u othersd : (1)< "Vepartment " means the department of social and health services. 4 (2) "Local health department" means the ((city, town, county, or district which provides)). authorized public health agency constituted E under chapters 70.05, 70.08, and 70.46 RCW to provide public health services ((to persons)) within the jurisdictional area; • • f (3) "local board of health" means the ((city, town, county, or district board of health)) governing board of a local health department; (4) "steal funds" means the actual expenditure for provision of the basic services, minus fee and permit revenues,.third party payor • reimbursements, and any state and federal revenue contributions to the programs; (5) "Regional advisory committee" means the citizen committee appointed by the governor to provide local input to the six regions on budget and program policy for all department programs. Seetion 3. _ (I) In order to provide an adequate level of public health protection, local public health departments *hall provide, or ensure the provision of the following: (a) Environmental health protection to include water, food, cur-site sewage, and general sanitation. • (b) Communicable disease control to include immunization, sesually trsnoitted disease control, acute communicable disease control, and tuberculosis control. (c) Health promotion to include services designed to improve • health through community or personal education and services that improve nutrition and fitness, reduce or eliminate health hazards, prevent trauma and disease, promote maternal and infant health, and detect and control chronic disease at the earliest possible stage. (d) Support services to include program and accounting reporting which allows management to evaluate agency impact and relate - • costs to services; information on health hazards and health status, including vital statistics and other health data, that identify prospective health hazards and problems in the Community; planned staff.development to maintain the quality of staff; health planning to identify, prioritize and act om public health needs in the community; and laboratory services. Section 4 (Section 8, chapter 183. Laws of 1945 as last amended by section 10, chapter 85, laws of 1971 ex. seas. and RCW 70.46.080 are each amended to read as follows:) (1) To carry out the provisions of section 3 through 7 of this 1981 amendatory act, funds shall be appropriated to the department for distribution to each local health department on a formula basis that includes a base amount plus a zer capita allotment. State funds shall not be used to supplant local funds appropriated for public health. (2) No funds appropriated for this purpose shall be paid tom local health department unless the governing board of the local health department has appropriated for the same period from local funds an amount mot less than the amount of local funds expended two years prior to the current fiscal year, except that each local health department shall receive not less than five thousand dollars for each county served. (3) Payments to local health departments shall be made each month. Local health departments requesting state support shall provide the depart- ment with financial reports submitted at least quarterly showing expendi- tures and revenues according to the state budget, accounting, and reporting system. • —5— imomemooliOi t .. . �s..�.. r e Alternative "i". NEW ncriON. Section 4. (I) The department is authorized, pursuant to' this chapter, to make available grants awarded on a contract basis to local boards of health. The purpose of these contracts will be to enhance the local funding effort in providing an adequate level of public health protection defined in • section 3. In awarding such grants, consideration shall be given to the 4 adequacy of existing levels of public health protection; effect of proposed service on community well-being; documented need for the service; amount of eiipbasis on disease prevention, and the promotion of community wellness; ' coordination with other community resources; manpower ratios; method of delivery; and the amount of money available from other funding sources. (2) Each local board of health,'provided it has appropriated for the • same period from local funds an amount not less than the amount of local funds expended two,years prior to the current budget year, shall be eligible to contract for the provision of public health services necessary to main- tain an adequate level of public health protection. In order to implement the purpose of the chapter and establish a shared relationship of state and local fiscal responsibility for public health protectiont there is appropriated to the department of social and health services the sum of ten million dollars from the general fund for the 1981-83 biennium to be dispursed to local public health departments in accordance with Section 4 of this 1981 Act. Subsequent requests for appropriations shall be included in departmental budget requests. , Section 6. The advisory committee, as directed by the secretary, shall assist the department in developing procedures necessary to effectuate this 1981 Act. This committee will terminate July 1, 1983. Section 8. Sections 1 and 3 through 7 of this set shall constitute a new chapter is Title 70 RCW. • NSW SECTION. Section 9. Because of increasing fiscal concerns and the recently announced increases in telephone rates, it has now . become necessary to decrease the level of support the department is contrib- uting for this system. I am verg much aware of the assistance SCAN has offered you in your daily operation. Therefore, the degree of reduction mill be only that which is absolutely required to meet required cutbacks. You are encouraged to thoroughly review your department's use of the SCAN system to eliminate possible inappropriate uses. This is essential if the state is to continue to support your program in this way. Effective October 1, 1980, SCAN financial support will be limited to a per- centage of the average 1977 monthly billings. The maximum authorized level of SCAN support. per month, for the Jefferson County Health Department will be $50.00. If charges are in excess of this amount, only the maximum authorized level will be paid. Excesses will be billed back to your county auditor if administered by the General Administration Telecommunication Division. All SCAN billings and questions should be referred to Mr. Ralph R. Oct.9 item 2- requirements Environmental Health Specialist S Dear Board of Health: For my "Going Tip" food service prophsal in The Elevator Ms. Blaine notes per item 2 of the above letter "hot water on site via hot water heater is required for hand washing, sanitization of utensils and cleaning." I would like to request a hardship on the operator • due to cost per Jefferson County Ord.2-78 Section VII 7.3"Any section of this ordinance not covered in WAC 248.84(Rules and Regulations of the State Board of Health-Food Service Sanitation) may be waived by 'the Jefferson County Health Department if it causes a hardship on the operator and it can be shown that no health haza#d-will result". I am planning to serve frozen carob/choc.covered bananas, fresh orange juice, and smoothies done in a blender. The previous 3-4 operators of The Elevator served more foods ,and needed more hotwater and prep than my proposal and they did not have to have a hotwater heater; instead they utilized a large coffee pot full of-hot water . As I will be opeaating a blender,knife for cutting oranges, wiping counters, and washing my hands I feel that this adequat3ly can be done -by using the same means-a large pot full of hotwater, therefore I am requeting a waiver of-this requirment. I direct your attention to ;:AG 248-54, The Rules and x- Regulations of the State Board of Health Regarding Public Water Supplies. In ay opinion, it is premature and misleading to imply that you have, "succeeded in a program which will provide water". The enclosed letter 1. (September 13, 1979) indicates significant issues need to be addressed y, before the submarine pipeline.can be considered for review. Furthermore, ' the proposal to resume barging water-will require assurance that the pro- cedures are both reliable, practical, and manageable; the "filter system" and the storage tanks for barged water will need to be reviewed; and the integrity of the existing distribution system on Protection Island must be documented. The appropriate manner to address these concerns is through an engineering report Which analyzes the existing system and selects the most appropriate alternative to provide water in a safe and reliable fashion. An engineering report along with approved plans and specifications are required prior to the construction of any system improvements. . . i I mould urge the Board to have the design engineer contact this office. TimmY Adsinistrators, Local Health Departments ; c 1. ,,'—.a , _-< • • ,e STATE--FUNDING FOR LOCAL HEALTH DEPARTMENTS Local Health Departments are the primary providers of public health services to Washington'State residents. Washington State law provides that DS1iS and the State Boanit°of Health support'and supervise the operation of local Health Departments. To date, this responsibility has been met primarily in the form of technical support with minimal direct state funding of any local Health Department activities. Funding for local Health Departments comes primarily from local tax dollars, fees for services, and a few dwindling federal pass-through monies administered by the State through DSHS. This is in contrast to the situations in most other states where there is significant state funding for public health activities. We conceptually and philo- sophically agree that the provision of public health services should be a joint responsibility of state and local government. With the ever-increasing fiscal demands on local government with no relief from state imposed taxing limitations, state funding for local Health Departments is acutely necessary to assure the provision of adequate services to protect the public's health. (See attached projected revenue and expen- ditures graph from an actual Health District.) Local Health Departments have supported and participated in the DSHS sponsored regional Public Health Study Groups. We have discussed the issues in Environmental Health, Nursing, Health Officers and WSPHA committee groups. In considering your recomnendatio for legislation to provide state funding for local Health Departments, several realitie need to be considered: I. State Mandated.Services - Currently the R.C.W.s and State Board of Health WACs mandate local Health Departments to provide services in the following categories: a. Vital Records b. Environmental Health - water, sewage, solid waste, food, general sanitation, c. Communicable Disease - conmunicable ,disease control, tuberculosis control and hospitalization, sexually transmitted disease, immunization. All local Health Departments have activities in these state mandated categories. We recognize that there are acute public health needs in other areas, primarily Maternal and Child Health, Chronic .Disease and Health Promotion; however, no state standards have been established for these programs and activities in these programs vary widely from one Health Department to another based on local needs and priorities and the availability of local and federal funding. 2. Initiative 62 (R.C.W. 43.135.010 effective January 1, 1980) - This statute assures that the state does not impose on any taxing district, responsibility for new programs or increased levels of service under existing programs unless the costs thereof are paid by the state. We strongly support the intent of this legislation. With this law in effect, the legislature will undoubtedly be cautious in mandating any new services in local Health Departments. Outemmilimmte 3. Local Government Concerns and Support - Local governments are having difficult In balancing their budgets to maintain their current levels of service..Altho st local -Boarrds of Health will acknowledge, the need of additional ai funding, they are realistically wary of the "strings" attached to federal and state funds: elaborate reporting systems, the uncertainties of continued fund the loss of local program control, etc. The Washington Association of Countie. did not support the 1977 bill for- local Health Department-funding because tsf theseconcerns. we..4e1 that:support of proposed legislation by local, Boards of„Health, the Washington Association of Counties and the Washington Associatit of Cities is essential to accomplish the passage of any legislation affecting local Health Departments. The concerns of local government must be strongly considered in writing the bill. With the above realities in mind, our recommendations are: I. Initial legislative action should focus on funding assistance for the current state mandated programs. TB Hospitalization costs should be reimbursed 100% to local Health Departments. The ultimate goal for other state mandated services should be 100Z funding by the state and fees for service. Adequate guidelines for these mandated services are already established in the R.C.W.s and Board of Health WACs. However, the updating of WACs is needed in some environmental health and communicable disease areas. 2. Fund application and reporting requirements for state funds for local public health services should not be unnecessarily complex and time consuming and as much as possible should utilize reporting systems that are already in place (BARS, coinnunicable disease reporting, standards or reporting systems are deemed necessary, If additional representativesp from local Health Departments must be involved in their development. The final • recommendations for any standards or reporting systems-should be approved by our local Health Department Groups - Health Officers, Nursing, Environmental Health, and Administration. 3. A number of funding formulas were recommended by the study groups, all with good rationale. Probably the most logical basis would be with a base amount provided to each district plus a per capita allotment. Any funds remaining 4 after state mandated programs are funded should be made available for local option programs on a matching basis. f 4. The level of local tax dollars and fee for service funding for local Health Departments should not be decreased. Local funds replaced by state funds i ! should be used to fund local priority 'public health programs. 5. The legislation should address the development of ongoing d 1 recommendations for future g g study undung to meke programs to be considered for state funding. The Regional Study Groups have provided an excellent-beginning forum for a review of community and state-wide public health program and funding needs. They would be logical groups to provide ongoing recommendations for public health programs to the Board of Healnt and the legislature. 6. Active involvement with the Washington Association of Counties and the - Washington State Association of Cities in developing the funding legislation is mandatory. Our recommendations are made with the recognition that they represent only a beginning } in the development of a relationship between state and local government to provide shared funding responsibilities for local public health services.
