SUPPLEMENTAL AGREEMENT The Local Agency of Jefferson County Public Works hereby amends the agreement with Van Aller Surveying ("the Agreement"), executed on January 28, 2019. All provisions in the Agreement remain in effect, except as expressly modified by this Supplemental Agreement. The changes to the Agreement are described as follows: I. {Scope} Construction Surveying, identified in Exhibit A Task 3 Construction Surveying in the original Professional Services Agreement, is added to the services to be completed by the Consultant. II. {Schedule} Construction is scheduled to start on or after June 15, 2020. The dates when construction surveying services will be required will depend on the Contractor's schedule and progress. Construction of the Center Road MP 14.61 — 15.01 project is to be completed on or before August 31, 2020. III. {Budget} Van Aller Surveying's construction surveying proposal is attached. The cost of the construction surveying is not to exceed $9,792. This Supplemental Agreement shall be effective upon execution by both parties. Work performed consistent with the Agreement prior to execution of this Supplemental Agreement is hereby ratified. Box 757 Carlsborg, WA 98324 Project: Center Road M.P. 14.61-15.01 Resurface and Restore (CRAB Project#1618-02) Scope of Services The work under this proposal consists of all survey work necessary to complete construction staking of the Center Road Resurface project. The work under this proposal consists of staking the Center road horizontal and vertical alignments. This work includes setting grade lath at 50 foot stations along both shoulders for control of roadway excavation, setting red tops (bottom of new paving) at 50 foot stations along the centerline and at un-controlled shoulders, staking the new approach to the US Bank, and painting sawcut lines. The horizontal and vertical datums for the project will be consistent with the work previously performed by this office at the site. It is assumed 6 field days and 1 day in the office will be required to complete the project. Costs Center Road Construction Staking Task 1- Field survey (Staking) $8,352 Task 2-Office construction staking preparation $940 Materials (Hubs, lath, whiskers) $500 Project Total: $9,792 TIME The consultant requires a 2 business day advance notice of staking requests for scheduling and calculation purposes. a ` • GENERAL REQUIREMENTS The consultant shall comply with all Federal, State, and local laws and ordinances applicable to the work to be done under this proposal. The consultant shall indemnify and hold the Client, and their officers and employees harmless from and shall process and defend at its own expense all claims, demands, or suits at law or equity arising in whole or in part from the consultant's negligence or breach of any of its obligations under this proposal. INSURANCE COVERAGE The consultant during the term of this proposal shall provide the following Insurance coverages. A. Worker's compensation and employer's liability insurance as required by the state. B. General commercial liability insurance in an amount not less than a single limit of $1,000,000.00 for bodily injury, including death and property damage per occurrence. C. Professional Liability Insurance with limits no less than $2,000,000.00 limit per occurrence. D.Automobile Liability insurance with limits no less than $1,000,000.00 combined single limit per accident for bodily injury and property damage. Analysis/Strategic Goals/Pro's Et Con's: Jefferson County signed an Agreement with Van Alter Surveying for topographic and other surveying for preliminary engineering of the above referenced project on January 28, 2019. Task 3 in Exhibit A of the Agreement allows the addition of construction surveying to the agreement with the consent of both parties. Public Works and Van Alter Surveying have negotiated a scope and maximum fee for adding construction surveying to the Agreement. Public Works recommends execution of Supplement #1 to the Agreement with Van Alter Surveying to add construction surveying to the Agreement for the not to exceed amount of $9,792. Fiscal Impact/Cost Benefit Analysis: The not to exceed amount for Supplement #1 is $9,792. This will be funded at 90% by the County Roads Administration Board. The remaining 10% will be funded by County Arterial Preservation Program (CAPP) funds. Recommendation: Public Works recommends that the Board execute Supplement #1 to the professional services agreement with Van Alter Surveying and return two signed originals to Public Works for further processing. PROFESSIONAL SERVICES AGREEMENT FOR Surveying Services THIS PROFESIONAL SERVICES AGREEMENT ("this Agreement") is entered into between the County of Jefferson,a municipal corporation("the County"), and Van Aller Surveying ("the Consultant"), in consideration of the mutual benefits,terms, and conditions specified below. 1. Project Designation. The Consultant is retained by the County to perform design surveys and topographic base map preparation for the Center Road MP 14.61 to 15.01 Resurface and Restore Project. 2. Scope of Services. Consultant agrees to perform the services identified on Exhibit"A" attached hereto including the provision of all labor. 3. Time for Performance. Work under this Agreement shall commence upon the giving of written notice by the County to the Consultant to proceed. The Consultant shall perform all services and provide all work products required pursuant to this Agreement on the dates listed on Exhibit"A". Time is of the essence in the performance of this Agreement. 4, Payment. The Consultant shall be paid by the County for completed work and for services rendered under this Agreement as follows: a. Payment for the work provided by Consultant shall be made as provided on Exhibit"B"attached hereto, provided that the total amount of payment to Consultant shall not exceed $9,863.00 without express written modification of the Agreement signed by the County. b. The Consultant may submit invoices to the County once per month during the progress of the work for partial payment for project completed to date. Such vouchers will be checked by the County, and upon approval thereof,payment will be made to the Consultant in the amount approved. Payment of Consultant invoices shall be within 30 days of receipt by the County for any services not in dispute based on the terms of this Agreement. c. Final payment of any balance due the Consultant of the total contract price earned will be made promptly upon its ascertainment and verification by the County after the completion of the work under this Agreement and its acceptance by the County. d. Payment as provided in this section shall be full compensation for work performed, services rendered and for all materials, supplies, equipment and incidentals necessary to complete the work. The Center Road MP 14.51 — 15.01 Resurface and Restore Project is located in Quilcene, Washington, on Center Road approximately between the Little Quilcene River bridge and US Hwy. 101. The intent of this project is to resurface and restore this section of Center Road.. The proposed scope of work for this project is the development of a project pre-engineering base map showing the following items within the Project Area, as defined in the Exhibit B map: 1) Rights-of-Way at the intersection of Center Road and East Columbia Street(west side of Center Road only) and at the Intersection of Center Road and Frank Beck Road(east side of Center Road only). 2)Topographic information throughout the project area. Task 1 Rights of Ways Determine the Rights-of-way at the intersection of Center Road and East Columbia Street(west side of Center Road only and to 200 feet north of the intersection), at the Intersection of Center Road and Frank Beck Road(east side of Center Road only), and at the south end of the project on the east side of Center Road at Tax parcel 702134006.. Work under this Task involves: • Researching right-of-way record maps,plats, deeds and documents. * Compiling and calculating rights-of-ways. • Field verification of rights-of-ways with existing monumentation. • Drafting rights-of-ways into Base Map. Task 2 Topographic Information Provide topographic survey and mapping of the project area. Work under this Task shall include mapping the following features: * Calculated property and Right-of-Way boundaries at the locations noting in Task 1 any survey monuments found. • Topography mapping with one foot contour intervals. • Outline of existing sidewalk,curbs, depressed curb and driveways Professional Services Agreement, Preconstruction Surveying for Project# 18020500 Page 11 of 13 • Centerline, striping, breaklines and edges of pavement, curbs and sidewalks of Center Road and at E. Columbia St, and Frank Beck road to 75 feet from the Centerline of Center Road, • Identification of above ground and underground utilities, storm drainage and culverts • Fence lines, walks,trails, etc. • Trees with a DBH equal to or greater than 4 inches • Generally all substantial features and improvements within the limits of the project within 5 feet of the edge of pavement or back of curb or sidewalk. The horizontal datum for mapping shall be Washington State Plane North and vertical datum shall be NAVD 88, (North American Vertical Datum of 1988). At least three permanent on-site benchmarks (control points)will be established for future survey and construction work within the project area. Task 3 Construction Surveying The Consultant may be considered for construction surveying services during the construction phase, depending upon the Consultant's satisfactory performance of the current work scope, upon the Consultant's level of interest in providing construction surveying, and upon negotiation of an agreement covering construction surveying. Deliverables The final survey Topographic base map shall be delivered in a digital AutoCAD and/or Civil 3D file format with an accompanying stamped mylar hard copy. Time for Performance: A 90% level of completion base map will be submitted to Jefferson County for review and comment within 60 days of the notice to proceed. The final topographic and right-of-way base map will be submitted on mylar and in AutoCad and/or Civil 3D".dwg"format within 14 days of the County's approval.
