The application was reviewed by Jefferson County Permit Center staff on 7-8-98 for the potential presence of critical areas regulated under the provisions of the Ordinance, as the following critical areas were confirmed as potentially present on the subject property: landslide hazard,seismic hazard. 2. Jefferson County Permit Center staff issued Findings and Conditions of Approval for the proposed project on July 9, 1998. The Findings and Conditions of Approval required the applicant to submit and have approved a geotechnical report, as per recorded plat conditions for the parcel and ICAO requirements. 3. Said geotechnical report was submitted to the Permit Center on August 6, 1998. Review fees were paid August 13, 1998. Staff reviewed the submitted report on August 19, 1998 and now issues this Addendum to the original Findings and Conditions of Approval. 4. Shannon&Wilson,Inc.provided a geotechnical review of the plans and building site at the above address. In addition, Shannon&Wilson had previously prepared a geotechnical report (Geotechnical Report, Mats View Terrace Subdivision, Port Ludlow, Washington,dated June 12, 1995)for development of parcels within the subdivision. 5. The Shannon&Wilson combined reports(the subdivision report and the 92 Mats View Terrace report)state specific recommendations regarding all aspects of site development. 6. The 92 Mats View Terrace report concludes that the site is relatively stable and provided that the recommendations contained in the 1995 geotechnical report are implemented,the proposed building will not have a significant adverse impact on the stability of the site or adjacent lots. However,it was added that "there is some risk of future instability on all hillsides, such as the one on this site, which the owner must be prepared to accept." This waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is granted subject to the following conditions. All conditions previously agreed to in original Findings and Conditions of Approval shall remain in effect. 2. The applicant shall submit,and have approved,a Small Parcel Erosion and Sediment Control Plan, as specified in section 11 of the ICAO. Recommendations as stated in the geotech reports shall be incorporated into the Small Parcel Erosion and Sediment Control Plan(see attached worksheet). 4. Surface drainage shall not be directed across the face of the slope. 5. Damage to vegetation retained during initial clearing activities shall be minimized by directional felling of trees to avoid critical areas and vegetation to be retained. 6. Buffers(area along the slope)shall be retained in their natural condition;however,minor pruning of vegetation to enhance views may be permitted by the Administrator on a case by case basis. 7. The proposed development shall be located on the subject property exactly as identified on the Universal Plot Plan, or other site plan approved by the County as part of the triggering permit application. Pg. 64) and is subject to the following restrictions as stated on the face of the plat : Site development for lot 5 is not restricted to a building envelope based on existing site conditions . Building envelope for this lot is restricted by requirements within adopted building codes and or zoning regulations . A plan specific geotechnical review, together with a foundation plan, each prepared and stamped by a licensed engineer shall be required at the time of building permit application, and my further limit building envelopes or construction requirements . 4) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms . 5) An applicant submitting a triggering application shall submit, and have approved, a geotechnical report as specified in Section 11 (Special Reports) of the Jefferson County Interim Critical Areas Ordinance when the triggering application involves any of the following: (a) The alteration of landslide hazard area or its buffer; (b) The creation of a new parcel within a known landslide hazard area; (c) The construction of a publicly owned facility in a designated . seismic hazard area. 6) All special reports shall be the responsibility of the applicant, including payment of costs incurred for report preparation, and review by County personnel . A Special Report Fee is charged by the County and must be submitted prior to the Counts review of such report . Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. No alteration shall be made to the landslide hazard area or its associated buffer without prior authorization by the Critical Area Administrator. 2) Prior to construction of any structures, the applicant shall submit and have approved a geotechnical report as specified in Section 11 of the Critical Areas Ordinance . 3) The geotechnical report shall certify all of the following: (a) There is minimal landslide hazard as proven by a lack of evidence of landslide activity in the vicinity in the past; (b) An analysis of slope stability indicates that the proposal will not be subject to risk of landslide, or the proposal or the landslide hazard area can be modified so that hazards are eliminated; (c) The proposal will not increase surface water discharge of sedimentation to adjacent properties beyond predevelopment conditions; (d) The proposal will not decrease slope stability on adjacent properties; and (e) All newly created building sites will be stable under normal geologic conditions (if appl le) .
