and assigns for the purposes hereinafter set forth, a nonexclusive perpetual easement over, under, along, across and

901111009 LEGAL DESCRIPTION: SEC 11 QTR SEC NE1/4 TOWNSHIP 29N RANGE 1 W. SEE EXHIBIT "A"
ATTACHED HERETO AND BY THIS REFERENCE MADE A PART HEREOF.
1. Purpose. Grantee shall have the right to use the Easement Area to install, construct, operate, maintain, repair,
replace, improve, remove, PUD electrical and PUD fiber optic facilities and associated appurtenances. Together with
the right of access over and across said Property to enable Grantee to exercise its rights hereunder. As used herein, the
term "systems" shall include all appurtenances and facilities as are necessary, in the judgment of Grantee, for the
operation and maintenance of said systems. Compliance with all associated environmental permitting and regulations
shall be the responsibility of the grantee.
2. Grantor's Use of Easement Area. Grantor agrees not to erect any structures on said Easement Area, and further
agrees not to place trees, rockeries, fences or other obstructions on the Property that would interfere with the exercise
of Grantee's rights herein. �Q-

PUD UTILITY EASEMENT LEGAL DESCRIPTION
A utility easement over, under and across a portion of the the Northeast Quarter of Section 11,
Township 29 North, Range 1 West, W.M., Jefferson County, Washington, more particularly described
as follows:
Beginning at the East Quarter corner of said Section 11, Thence North 87°25'45" West along the South
line of said Northeast Quarter, a distance of 145.34 feet;
Thence North 42° l Y 12" West, a distance of 129.58 feet to a point on the East margin of Elkins Road;
Thence North 00°22'41" East along said East margin, a distance of 22.16 feet;
Thence South 42° l 3' 12" East, a distance of 139.65 feet to a point 15 feet Northerly of said South line;
Thence South 87°25'45" East parallel to and 15 feet Northerly of said South line, a distance of 138.92
feet to the East line of said Northeast Quarter;
Thence South 01 °53'22" West along said East line, a distance of 15.00 feet to the point of beginning
Containing 4,151 square feet more or less.
The above described Easement is depicted on the accompanying map labeled Exhibit B, which is
attached herewithin and made part of this legal description.

Subject: Elkins Rd., Utility Non -Exclusive Easement
Statement of Issue:
A county parcel (901111009) is situated at the end of Elkins Rd. The Jefferson County PUD#1
is requesting a 15' Non-exclusive Utility Easement across the county owned parcel to install
utilities.
Analysis / Strategic Goals / Pros £t Cons:
The county parcel is partially in use by the Elkins Rd right of way. The Utility company desires
to run utility conduits to the east to improve their utility services in the area. This portion of
county property is not in use by the county. By granting this easement, PUD#1 will be able to
access, develop, install and maintain their utility systems.
Fiscal Impact/Cost Benefit Analysis:
There is no financial impact to the County at this time. The Department of Public Works does
not presently foresee any other beneficial uses for this portion of the subject property and
supports the PUD's operations. The PUD has provided all legal descriptions, site maps and
survey data as necessary to draft the Utility Easement document. The PUD has also agreed to
pay the County for expenses incurred with the execution and recording of the Utility
Easement document.
Recommendation:
Please sign the attached Non -Exclusive Utility Easement and return it to Public Works for
recording and distribution.
