TAX-TITLE PROPERTY )
WHEREAS, it is the desire of the County Commissioners of Jefferson County to dispose
of tax title county property;
WHEREAS, Jefferson County has the opportunity to acquire privately held land in
exchange for tax title land, thus providing public benefit with development of the Olympic
Discovery Trail segment between Four Corners Road and Anderson Lake State Park;
WHEREAS, RCW 36.35.010 provides the legislative authority of each county the power
to devote tax title lands to public use under its own control or the control of other governmental
or quasi-governmental agencies, to exchange such lands for lands worth at least ninety percent of
the value of the land exchanged, and to manage such lands to produce maximum revenue
therefrom in the manner which derives the most income from such lands; and in
acknowledgment that this proposed exchange would provide public benefit and exchange such
land for land worth at least ninety percent of the value of the land exchanged; and
WHEREAS, the following land and timber property values were determined based upon
appraisal and review appraisal certified respectively on 3-12-2020/4-20-2020 and 3-12-2020/5-
15-2020:

NOW, THEREFORE, BE IT RESOLVED, by the Commissioners of Jefferson County
that they make a finding and determination as required by RCW 36.35 to declare the particularly
described property as suitable for exchange to provide public benefit.
BE IT FURTHER RESOLVED, The Jefferson County Board of County Commissioners
does hereby establish just compensation as stated above. The Board does hereby indicate its
concurrence and gives authorization for the Department of Public Works to proceed with the
offer, negotiation, and acquisition of the above-designated properties in accordance with Right-
of-Way Acquisition Procedures Resolution 05-11, approved February 7, 2011 that include land
and timber value.
BE IT FURTHER RESOLVED, this authorization further directs the Department of
Public Works, in coordination with the Jefferson County Treasurer, to execute the documentation
to close said transactions and coordinate with the approved funding sources to pay for acquisition
expenses.

Subject: BOCC Authorization and Concurrence to proceed with right-of-way
acquisition for the Olympic Discovery Trail, Four Corners Road to
Anderson Lake State Park segment
Statement of Issue:
The Department of Public Works is requesting Authorization and Concurrence from the
BOCC to proceed with the acquisition of right-of-way for the Olympic Discovery Trail
(ODT) segment proposed between Four Corners Road and Anderson Lake State Park.
The trail right-of-way (as shown on the attached right-of-way plan) would be acquired
through a Timberland Exchange Agreement which would exchange County held tax-title
land acquired in 1928, for portions of Pope Resources property plus cash, for a 100
percent value. Tax-title land is land acquired by the County for lack of other bidders
at a tax foreclosure sale and held in trust for the taxing districts. The Assessor Parcel
Number (APN) for the County property is 701071002. The right-of-way to be acquired
from Pope Resources includes portions of (APN) 901042001 and 901092001.
Analysis/Strategic Goals/Pro's Et Con's:
Pope Resources is the largest property owner along this proposed ODT segment, and is
willing to exchange timber properties of equal values in support of the Trail. Appraisals
for all associated properties have been completed and Public Works is prepared to move
forward with negotiations to complete the property exchange. The Board's
Authorization and Concurrence will grant Public Works the authority to proceed. This
exchange complies with Chapter 36.35 RCW and is in the public interest as it will
provide the property necessary to complete a segment of the Olympic Discovery Trail.
Fiscal Impact/Cost Benefit Analysis:
The Jefferson County property was appraised at $115,000 and the Pope Resources
property was appraised at $78,700. The Timberland Exchange Agreement will reconcile
the difference with a cash amount of $36,300 to be paid to the County with
disbursement to cover costs associated with the sale, and with the remainder of the
proceeds to be justly apportioned to the appropriate taxing districts for the parcel's
location.

Recommendation:
Per Jefferson County Right-of-Way Procedures, Resolution 05-11, adopted Feb. 7, 2011;
Public Works recommends that the Board of County Commissioners pass a motion
approving the attached Authorization and Concurrence Resolution directing staff to
proceed with the aforementioned property negotiation and acquisition in coordination
with the Jefferson County Treasurer. The Board will be provided a copy of the fully
recorded documents upon their filing with the Jefferson County Auditor.
