Stormwater Management Unified Development Code Requirement(s): The Jefferson County Unified Development Code, Sections 18.30.060,Grading and excavation standards and 18.30.070,Stormwater Management Standards both set standards for erosion and sedimentation control and stormwater management. The Code adopts the requirements set forth by the most current version of the Washington State Department of Ecology, Stormwater Management Manual for Western Washington(SWMMWW). JCPW Findings: The proposal site(APN901113011)is 0.78 acres. It is located at 1291 Chimacum Road in the Chimacum Crossroads Commercial area.The proposal is to convert an existing residence to commercial activity. The site has a gentle slope to the northeast.There are 8,567 square feet(SF)of existing impervious surface(residence, outbuildings,and gravel driveway)on the site(25%).The proposal is the construction of 4,490 SF of new impervious surface to expand the driveway and construct parking spaces.The total new plus existing impervious area would be 13,057 SF or 39%(±)of the site. Based on SWMMWW,Volume 1,Figure 2.4.4 Flow Chart for Determining Requirements for Redevelopment,the proposal is required to meet Minimum Requirements#1-#5. The proponent submitted a Stormwater Mitigation Plan and SWPPP prepared by Justin Wilson,PE,dated 2/3/2017 and updated 3/15/2017; a JCDCD Stormwater Calculation Worksheet dated 4/01/2017; and a project site plan prepared by the proponent's representative Simon Little, dated 4/03/2017 and updated 4/10/2017. The submittals included on-site soil logs prepared by Nathan Cleaver,a licensed septic system designer. There are 2" of duff and 54"of gravelly medium to coarse sand on the site.The soils are appropriate for infiltration. The Stormwater Mitigation Plan proposes infiltration of the stormwater runoff generated by the new gravel parking lot. The infiltration facility was sized using BMP T5.10A for downspouts. The infiltration trench construction detail utilizes BMP T7.20 with Figures 3.3.4 and 3.3.5 from the 2014 SWMMWW. These figures depict stormwater flowing through a 20' wide grass filter strip (BMP T9.40) prior to the infiltration. The 20' wide grass filter strip was deleted from the construction plans. Mr. Wilson did not provide justification for deleting the grass filter strip. Prior to infiltration of runoff from a pollution-generating impervious surface, the SWMMWW requires implementation of an appropriate basic treatment BMP as per Volume 5, Figure 2.1.1 Treatment Facility Selection Flow Chart. These BMPs include grass filter strips and bioretention cells. The proponent's representative has indicated that bioretention cells will be Page 1 of 3 . used to treat the runoff water.The pgWt plan depicts 10 bioretention cells with ipa1 area of 360 SF.This is adequate to treat the runoff generated by the n parking lot. JCPW Recommendations: 1. The proponent shall install the stormwater management facilities and implement the Best Management Practices (BMP's)per the Stormwater Mitigation Plan and SWPPP prepared by Justin Wilson,P.E.,dated 3/15/2017 and the project site plan prepared by the proponent's representative Simon Little, dated 4/10/2017. 2. In accordance with the Jefferson County Unified Development Code, Section 18.30.080(1)(f): stormwater management facilities shall be inspected by Jefferson County Public Works(JCPW). Prior to land disturbing activities,the proponent shall notify JCPWD at(360)385-9160 of the stormwater construction schedule.Critical points requiring JCPWD inspection for this project are: • Installation of temporary erosion and sediment control BMP's; • Infiltration trench bottom prior to backfill; • Final inspection when complete. 3. All applicable temporary erosion control measures shall be installed prior to the start of construction. 4. Construction of stormwater management facilities shall be conducted under the supervision of a licensed engineer.After construction is complete and prior to final Department of Community Development(DCD)project approval,the proponent shall submit a letter to the JCPWD from the project engineer certifying that the stormwater management facilities have been constructed per the approved Stormwater Site Plan.This shall include certification that the Bioretention Soil Media meets the specifications of SWMMWW Volume 5,BMP T7.30 Bioretention Cells. It is the responsibility of the proponent to schedule inspections by the project engineer to enable him to provide final certification. 5. To meet the requirements of the Jefferson County Unified Development Code, SWMMWW Minimum Requirement #9 Operation and Maintenance,and to ensure that the approved stormwater management facilities are appropriately maintained for the life of the project,prior to final project approval,the proponent shall enter into a Stormwater Management Facility Maintenance Agreement with Jefferson County. The Public Works Department will send a copy of the Agreement to the proponent which has been signed by the Public Works Director. The proponent shall sign the Agreement before a notary, file it with the Jefferson County Auditor, and provide Public Works with a copy of the recorded document. B. Transportation Unified Development Code Requirement(s): The Jefferson County Unified Development Code, Sections 18.30.020(5), General Development Standards, states that all land use activities shall be served by appropriate transportation facilities. Transportation facilities shall be adequate to meet the level of service standards adopted in the Jefferson County Comprehensive Plan and the appropriate design standards referenced in JCC 18.30.080 (1)(a). JCPW Findings: • The site has an installed access on 1291 Chimacum Road. JCPW Recommendation: • N/A C. Public Works Department Fees Requirement: Unified Development Code Requirement(s): The Jefferson County Unified Development Code Chapter 18.30.080(1)(u)authorizes the Public Works Department to assess fees in accordance with the Jefferson County Fee Schedule Ordinance for development review activities including application and plan review, inspections,meetings, hearings, and final review. • Prior to project approval,the proponent shall pay all costs related to the Public Works Department's application review,plan review,inspections,and preparation of the Stormwater Management Facility Maintenance Agreement. In accordance with the Jefferson County Public Works Department Fee Schedule,the proponent has paid the Department's$670.00 Stormwater Management Permit fee which covers the first 8 hours of review.The hourly fee Page 2 of 3 fpr work exceeding 8 hours is$8 hour. The results of the review are detailed below: A pre-opening inspection is required before you can operate. Before scheduling your pre- opening inspection, ensure that all conditions in the plan review letter are met and fees are paid as listed below. If more than one pre-opening inspection is required, you will be invoiced for a re- inspection at$87.00/hour. The following items have been accepted for use: 1. Menu 2. Floor Plan 3. Site Plan Prior to pre-opening inspection and approval to operate the following items need to be completed. Outdoor Walk-in Cooler-- Indirect Drain: On 3-1-17, in response to an e-mail from the Food Inspector, you responded with the following information: (a) As per Manufacturer, condensate vaporizer is not available for use on their outdoor cooler models (b) Condensate line from refrigeration system will be mounted atop the outdoor walk-in cooler. (c) Condensate on outdoor units is usually allowed to run to the outdoor environment. (d) Fitting available to allow condensate line to be plumbed to septic system,if required. (e) Plumber would route the condensate line from the roof of the outdoor cooler back into the building and have it drain via air gap into the floor sink at the back bar. Based on the above information that you submitted to Jefferson County Public Health, you may choose one of the two options below for the condensate on your outdoor walk-in cooler. REQUIRED APPROVALS FROM OTHER PROGRAMS&AGENCIES: o Septic —As per the Sanitarian for onsite septic system, the conditions for the septic system are as follows: • The septic system serving this establishment is not designed for typical restaurant waste water, or any other form of high strength waste. No preparation of food items can be permitted utilizing this category 1 septic system. • Owner is responsible for annual testing of BOD, TSS and Oil and Grease waste strength. This testing should be conducted during peak season. Waste strength sampling and an annual O&M report must be submitted for the annual food service permit. • Waste water system must be maintained in accordance with WAC 246- 272A and Jefferson County Ordinance 8.05. This system requires annual monitoring by a licensed O&M provider. • Maximum seating allowed is 55 seats with 3 employees until water use records can establish actual data for revision. • Weekly OSS dose counter readings during peak use months is required. o Water System—must be approved public water system.You stated on the application that potable water is supplied by Jefferson County PUD 05783U. You are therefore compliant with this requirement. o DCD — Building, Zoning, Planning — You must ensure any issues with these departments are"finaled"and signed off prior to the pre-opening inspection. 1. The menu is approved and consists of food items such as: (processed)meat(meat sticks),cheese, crackers, sandwiches and salads. Other menu items include: peanuts and other nuts, pretzels, snack mix,packaged yoghurt,fruit mix and bakery items such as croissants etc.Beverages include draft and bottled varieties of beer, cider, wine and kombucha. Other beverages include: bottled soft drinks,bottled sparkling and regular water. 2. Based on the information on the application and the conditions from the Septic review, preparation of food is not allowed at the facility. All food items on the menu must be prepared offsite. All items listed on the menu will supplied as pre-packaged food by licensed wholesale companies (such as Costco, CB Nuts, Mt. Townsend Creamery, etc.) If possible, proprietor must obtain copies of valid WSDA Food Processor's License from suppliers,each year. 4. All heated food will be served immediately or discarded. 5. The Food Code requires the prominent posting of Consumer Advisory about undercooked or raw food,at the food establishment and/or on the menu. Asterisks must be used to identify such food items on the menu. 6. You stated on the application that"items with raw components will be indicated on the menu and linked to consumer advisory. This will be verified during the pre-opening inspection and future routine inspections. 7. As per the Food Code,the food preparation sink must be sufficient in number,and size to process any food that requires placement in the sink.The sink must also be appropriate for the menu,food preparation and volume of food prepared. Food prep sinks cannot be used for hand-washing, utensil washing or othcr activities that would contaminate the food. 8. Preparation of food is not allowed at the facility so food prep sink is not required at the facility at this time. However, in future if you wish to start preparing food on-site, you must submit application and required fees to Jefferson County Public Health for food and septic review. Installation of food prep sink will be required as part of that application process. 9. A 3-compartment sink is required,even if a dishwashing machine is also installed.The floor plan indicates that you are compliant with this requirement. This will be verified during the pre- opening inspection. 10. All equipment used must be able to fit inside of all the 3-compait,nent sinks and/or dishwasher to be properly cleaned and sanitized. 11. You must provide space in the dishwashing sink area for adequate storage of dirty dishes and air drying of the clean dishes. Air drying racks are recommended above the sinks. 12. If a dish washing machine is installed, then a pre-rinse sink with a sprayer is required for proper ware washing. An overhead pre-rinse nozzle may be installed above the wash sink of the 3- compartment sink instead of a separate pre-rinse sink. 13. Back flow protection needs to be provided for all applicable equipment such as ice machines,well dips, food sinks, dishwashing sinks and soda machine. 14. You must provide air gaps on 3-compai Intent ware washing sinks,ice machines,condensate lines, salad bars, and soda machines. This gap must be a physical gap above the floor sink and at least 1 inch. A mop sink is required that is within easy access of the kitchen.The floor plan shows that you are compliant with this code.This will be verified during the pre-opening inspection. 16. Splash from mop, dishwashing and hand-washing sinks must be isolated from other kitchen operation either with a splash guard or by providing at least 18 inches of space separating the hand-washing sink from other items. 17. The surfaces of all equipment and utensils must be easily cleanable, smooth, nonabsorbent, corrosion-resistant and durable. Walls, floors and ceilings must be easily cleanable, smooth, and durable. 18. Screens are required on windows and doors that will be opened directly to the outside during hours of operation. All exits and restrooms doors shall be equipped with self-closing mechanism. 19. You must provide adequate facilities for orderly storage of employees' clothing and personal belongings. You stated on the application that a rack in the utility room will be used for this purpose. This will he verified during the pre-opening and future routine inspections. 20. The lighting in the kitchen area needs to be at least thirty(30) foot-candles and shall be shielded with guards in food preparation areas. There is no food preparation at the facility at this time. 21. Provide air temperature measuring thermometers accurate within±3°F within all refrigeration equipment. 22. Ensure that adequate storage of garbage is provided and that receptacles are constructed of either metal or hard plastic. 23. Hot water supply must be sized to meet peak demand requirements. If you ever run out of hot water or potable water, you must stop food service immediately and notify Jefferson County Public Health (JCPH) of the temporary self-closure. Food service may not resume until the shortage of hot water or potable water is resolved and you are re-opened by JCPH. 24. All equipment must meet applicable National Sanitation Foundation (NSF) standards or be of comparable design criteria. Domestic-grade equipment is not allowed in licensed food establishments. 25. You stated on the application that "bar towels will be laundered at Laundry Station in outbuilding". This will be verified during the pre-opening and future routine inspections. Access to the Outbuilding will therefore be required for this purpose. 26. Please provide a written policy regarding ill food handlers working in the establishment. 27. All employees and owners must have valid food worker cards prior to opening.Online classes are available at www.foodworkercard.wa.gov this is the only valid website. The parking lot geometry suggests that the north road approach should only allow one way traffic to enter the site. It appears that there is not ample room for the full spectrum of vehicle sizes to turn around and exit from the north road approach. We recommend that the exit arrow from the two way traffic flow at the north road approach is removed from the site plan, and that ample communication is made to direct drivers that the north road approach is a one way entrance to the site. I have attached excerpts from the Architectural Graphic Standards, and my notes on the Keg& I site plan that describe the geometry. I can put these comments in a formal review summary when the stormwater review has been completed. These are small cars! 12' is like a Geo Metro. 13' is like a Kia Soul. This is a farming area,where people drive Crew Cab full sized pickup trucks that are more like 20' long. I have shown a few of these sized vehicles in the parking lot on the attached review drawing to show how tight this lot will be. The open flow path might neck down to 9'to 12' between parked cars &trucks with current geometry. I believe it is unrealistic to think that there will be room to turn around and exit from the north road approach. JCPW Ouestion/Clarification/Comment: EOR has not provided adequate justification for the reduction in grass filter strip from 20' down to 1'. Prior to infiltration,the 2014 SWMMWW Volume 3, Section 3.3.9,Design Criteria—Pretreatment, describes basic treatment options applicable. JCPW Recommendations: Approval of 3/15/2017 Stormwater Site Plan is not recommended until the above noted Question/Clarification/ Comment has been adequately addressed by the EOR. The surface area numbers do not match. From the site plan, it appears that there is approximately 7000 sf of new gravel parking area. If so, Minimum Requirements#1-#9 may apply which includes the need for treatment. Neither of the calculation worksheets show this magnitude of new gravel parking area. Recommend labeling the surface area of each building and other impervious surfaces on site plan for clarity of understanding. 3) The site is proposing to use infiltration. According to the SWMMWW, all infiltration BMP's require on-site soil verification for design. Soil survey information provided is not acceptable. On site soil test pits are required in conformance with the applicable section of the SWMMWW amended in 2014 for the selected BMP that show ample vertical separation, soil texture, compaction, structure, similar to those performed when evaluating a site for on-site sewage dispersal system design. Since the proposed location is adjacent to the parcel to the north, verification of horizontal separation from the neighbor's well and drainfield should be provided. 4) There are no sizing calculations provided to justify the infiltration trench size. 5) According to the topographic lines on the site plan,the location &size of the infiltration trench does not intercept all of the impervious surface run off. 6) There is no proposal for sedimentation control between the parking area and the infiltration trench. 7) The layout of the infiltration trench is along an existing grade that changes 3' to 4'vertically. The sign code requires signs to be on private property(not in the right of way) but does not require a setback from the right of way. Per 18.30.150 Section (6)(j) says the "No sign shall be placed to obstruct a driver's view or traffic, bike, pedestrians, or traffic signs." Per 18.30.150 Section (6)(m)(ii) signs must be located on private property. The development code 18.30.050 requires right of way setbacks for certain structures but excludes fences, mailboxes, wells, pump houses, bus shelters, utility poles. Other structures may be allowed by the Administrator. It is silent on signs. However,when combined with the Sign Code 18.30.150 it appears that the intent is only that signs not be located in the right of way and that they not block traffic sight lines. Therefore,we conclude that this sign does not require a setback variance and it would not be appropriate to charge a PW fee. It appears the Applicant has considered sight triangles and located the sign to avoid them. Historically, DCD has approved signs within the front right-of-way setback as allowed at the administrator's discretion by JCC 18.30.050,Table 6-1 Density, Dimension and Open Space Standards Note 6,stating that"no other structures or accessory uses shall be located in the front setback area unless approved by the administrator." Therefore,the administrator can allow the placement of signs within this setback if the proposal is in compliance with the performance standards as set forth in the ICC.These standards are based off of life safety standards such as line of sight for motor vehicles,bicyclists,and pedestrians along right-of-ways,traffic intersections or signs.As such,each proposal will be reviewed individually to ensure that the proposal is consistent with performance standards when determining if a sign will be allowed within the front right-of-way setback. In addition,there are also standards through the appropriate agency with jurisdiction of the right-of-way, being Jefferson County Department of Public Works or the Washington State Department of Transportation. Each sign proposal will receive comments from the applicable agency which will address a safe setback and contribute to the determination made by DCD on the proposal. No sign shall be placed in the public right-of-way or in the vision clearance triangle of intersections and curb cuts,unless otherwise approved by the State Department of Transportation or Public Works. In addition to performance standards from other agencies with jurisdiction and any other sections of the County's Unified Development Code,the County's sign code,(JCC 1830.150),contains performance standards that will be used to guide the decision of the Administrator when determining if,and under what conditions,a particular sign may be placed in the right-of-way setback.
