It must,therefore, be 55 feet from the ordinary high water mark(OHWM) of the stream.The county biologist and I visited the site and were unable to say conclusively if it is a stream or not without a qualified biologist evaluating the site and submitting a habitat management plan. We measured that the remaining carport slab is approximately 51 feet from the OWHM of the stream.This means that the proposed garage and apron should be moved eastwards at least 6 feet to ensure that it complies with the 55 foot setback. Please submit: 1) A revised site plan that shows the correct location of the stream and proposed development that adheres to the 55 foot setback. 2) Alternatively,the applicant may submit a habitat management plan from a qualified biologist that complies with 18.22 Jefferson county Code.
