HomeMy WebLinkAbout082420_ca10 .,50, „Q. o, DRAFT MINUTES Jefferson County Board of Commissioners Regular Meeting — Monday, August 17, 2020, 9:00 a.m. Jefferson County Courthouse—Commissioners' Chambers 1820 Jefferson Street, Port Townsend, WA CALL TO ORDER: Chair Greg Brotherton, Commissioner David Sullivan and Commissioner Kate Dean participated in the meeting remotely. Chair Brotherton called the meeting to order at the appointed time. PUBLIC COMMENT PERIOD: The following is a summary of comments submitted by individuals via email which reflect their personal opinions and which were read aloud by the County Administrator: • Comment regarding the Jefferson County Fairgrounds providing homeless camping. • Comment regarding mail in ballots for voting. • Comment regarding COVID-19 cases and Brinnon postal employees not wearing face masks. • Comment regarding a masking compliance surveyor. • Comment regarding affordable housing funding allocations and camping at the Jefferson County Fairgrounds. • Comment regarding wearing of face masks. • Comment regarding shooting noise from the Port Townsend gun range. The Commissioners and County Administrator addressed comments and concerns raised during the Public Comment Period. Discussion ensued regarding mail in ballots. APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Dean moved to approve the items on the Consent Agenda as presented. Commissioner Sullivan seconded the motion which carried by a unanimous vote. 1. HEARING NOTICE re: Community Development Block Grant(CDBG) Public Services and Local Microenterprise Assistance Programs; and Public Health, Emergency Response, or Temporary Housing Facilities that Address COVID-19 Impacts; Hearing Scheduled for Monday, August 31, 2020 at 10:30 a.m. via Virtual Meeting and Live Streamed on AV Capture All 2. AGREEMENT NO. WA JEFF 91420(1) re: Upper Hoh Road/Olympic National Park Federal Lands Access Program(FLAP) Project, M.P. 0.0—M.P. 12.0, County Road No. 914207, County Project No. 18019410; In the Amount of$15,080,803; Jefferson County Public Works; Federal Highway Administration, Western Federal Lands Highway Division; US Department of Transportation 3. AGREEMENT NO. ICA21008 re: Support of Family and Juvenile Court Improvement Plan (FJCIP); In the Amount of$14,420.00; Jefferson County Superior Court; Washington State Administrative Office of the Courts 1 Commissioners Meeting Minutes of August 17,2020 4. BID AWARD re: Upper Hoh Road Repair, Project No. 1802038 Cf.P�8.0, County Road No. 914207, Federal Aid No. ER-WA-20-03; In the Amount of 109,898.25; Jefferson County Public Works; Rognlins, Inc. 5. MINUTES re: Regular Meeting Minutes of August 10, 2020 and Special Meeting Minutes of August 12, 2020 6. ADVISORY BOARD RESIGNATION: Solid Waste Advisory Committee (SWAC); District 3 Representative, Samantha Janes 7. ADVISORY BOARD REAPPOINTMENT: Solid Waste Advisory Committee (SWAC); Term Expires 2/13/22; Industry Representative, Chad Young(Murrey's Olympic Disposal) 8. Payment of Jefferson County Vouchers/Warrants Dated August 17, 2020 Totaling $721,185.88 (Records of all claims submitted for payment along with vouchers approved and signed by the Board of Jefferson County Commissioners are retained by the Jefferson County Auditor and Public Works Department.) 9. Payment of Jefferson County Payroll Warrants A/P Warrants Done by Payroll Dated August 7, 2020 Totaling $139,095.27 (Records of all claims submitted for payment along with A/P Warrants approved by the Payroll Services Manager are retained in the Jefferson County Auditor's Office) COMMISSIONERS' BRIEFING SESSION: The Commissioners reviewed upcoming Washington State Association of Counties (WSAC)meetings this week. WEEKLY UPDATE re: COVID-19: Public Health Officer Dr. Thomas Locke provided information on the COVID-19 virus in Jefferson County and Emergency Management Director Willie Bence provided a situation report. HEARING re: PORT LUDLOW DRAINAGE DISTRICT ASSESSMENT SYSTEM: Public Works staff member Jim Pearson explained the Port Ludlow Drainage District's assessment system and draft ordinance with the Board which would enable the District to continue to provide drainage facilities in Port Ludlow. Mr. Pearson noted a correction to the Appendix, Page 3, where it reads the"2016 rate" it should read the"2020"rate. County Administrator Philip Morley noted a scrivener error. After discussion, Chair Brotherton opened the hearing for public testimony. The following individuals provided oral testimony: Nancy Lockett. The following individuals provided written testimony which was read aloud by Deputy Clerk of the Board Carolyn Gallaway: Art Moyer, Matt Kolbeck, and Peter Leenhouts. Hearing no further testimony, Chair Brotherton closed the public hearing and the Commissioners continued discussion on the issue. Chair Brotherton re-opened the hearing to allow for testimony. The following caller provided oral testimony: Deborah Helleson. Hearing no further testimony, Chair Brotherton closed the public hearing. After discussion, Commissioner Dean moved to adopt ORDINANCE NO. 06-0817-20 re: Repealing and Replacing Ordinance No. 02-0806-16 Finalizing the Assessment System for the Port Ludlow Drainage District. UPDATE re: Federal CARES Act Coronavirus Relief Funds (CRF): COVID Pandemic Response and Recovery Finance Section Chief Patty Charnas briefed the Board on the first round of Coronavirus Relief Funds (CRF), public process, and CRF allocations. The Commissioners decided to table discussion until the afternoon session. 2 Commissioners Meeting Minutes of August 17,2020 RAFT The meeting was recessed at 12:02 p.m. and reconvened at 1:32 p.m. with all three Commissioners present. EXECUTIVE SESSION: An Executive Session was scheduled from 1:30 p.m. to 2:30 p.m. Chair Brotherton announced that the Executive Session will be held from 1:33 p.m. to 2:33 p.m. with the County Administrator and Chief Civil Deputy Prosecuting Attorney regarding Attorney-Client Privilege, Actual Litigation under exemption RCW 42.30.110(1)(i) as outlined in the Open Public Meetings Act. The Board resumed the regular meeting at 2:33 p.m. Chair Brotherton announced that the Board will be extending the Executive Session from 2:35 p.m. to 2:55 p.m. The Board concluded the Executive Session and resumed the regular meeting at 2:56 p.m. After the Executive Session, Commissioner Sullivan moved to authorize the Prosecuting Attorney to make an Offer of Judgment under Rule 68 on the Lorecki public records case, consistent with the authority discussed in Executive Session. Commissioner Dean seconded the motion which carried by a unanimous vote. COUNTY ADMINISTRATOR BRIEFING SESSION: County Administrator Philip Morley reviewed the following with the Board. • UPDATE re: Federal CARES Act Coronavirus Relief Funds (CRF)—Continued: COVID Pandemic Response and Recovery Finance Section Chief Patty Charnas continued to brief the Board on the first round of Coronavirus Relief Funds (CRF), public process, and CRF allocations • Emergency Management Masking Survey and continued discussion about the CRF process • Commissioner Briefing Session—Continued: The Commissioners and County Administrator discussed recent meetings they attended, reviewed upcoming meetings and discussed miscellaneous topics • County Administrator Philip Morley left the meeting at 4:30 p.m. • Review of the County Administrator's performance; review date to be determined NOTICE OF ADJOURNMENT: Commissioner Dean moved to adjourn the meeting at 4:32 p.m. until the next regular meeting or special meeting as properly noticed. Commissioner Sullivan seconded the motion which carried by a unanimous vote.
