Year 3 Projects:
Two primary projects: 1) attempt to re~establish Olympia oysters while creating and enhancing
partnerships, especially with Tribes with Usual and Accustomed Fish Rights in eastern Jefferson County;
and 2) continue the process for developing marine protection and enhancement strategies by targeting
specific locations and developing public support and specific strategies for selected sites.
Priority Habitat Stewardship Program - identify one or more sites for possible stewardship by interested
community groups, conduct workshops to educate the groups on those site(s) and develop the framework
for a priority habitat Stewardship Program.
Olympia Oyster Restoration -
· Habitat Survey and Site Selection: The MRC wil1 hold a workshop and may conduct site visits to
assess the viability of sites for re~introduction of Olympia oysters in eastern Jefferson County. PSRF
will provide project oversight and management.
· Community Outreach & Involvement: The project will be publicized locally with a large education and
outreach component. Educational materials will be developed and distributed through planned outreach
events. This component will occur throughout 2003.
· Site Seeding: The MRC will participate in obtaining seed and in the seeding process. The PSRF will
also provide oyster seed and technical consultation. Seeding will occur in Fal12003.
· Monitoring: Tribal and citizen monitoring is scheduled for Spring/Summer 2003 under an existing
PSRF grant.
on Spill ResponselEmergency Management - Provide infonnation to local emergency response officials
who are in the process of developing a comprehensive emergency response plan for the County. This
element will be developing a database that identifies equipment necessary to provide early action response
to oil spill events.
Forage Fish Spawning Surveys - The MRC will work with Jefferson County staff, the Shorelines
Advisory Committee and the Jefferson Board of County Commissioners to provide education as to the
location of forage fish spawning beaches and the activities that can threaten those beaches. The MRC will
provide the NWSC with an update on the progress of the North Olympic Salmon Coalition forage fish
survey and regulatory issues surrounding the protection of those areas identified as providing forage fish
spawning habitat.
Grant Management - Jefferson County will perfonn administrative tasks as necessary to complete the
tasks described in this grant. Jefferson County will manage the linkages between projects, the Northwest
Straits Commission and communication with the MRC.
Year 4 Projects:
Expand the Olympia Oyster Project and include water quality monitoring, and implement site specific
Habitat Stewardship Projects in Discovery Bay, Tarboo Bay, and Port Townsend Bay. These Habitat
Stewardship projects will continue the process for developing marine protection and enhancement
strategies by: 1) expanding the seeding of Olympia oysters in Discovery Bay, monitoring water quality
parameters, and enhancing partnerships 2) identifying and removing spartina in both Discovery and
Tarboo Bay locations, 3) assessing fish use and distribution in Tarboo Bay, 4) establishing a Port
Townsend Bay Eelgrass Voluntary Anchor Protection Zone. These projects make progress in addressing
NWS benchmarks associated with nearshore habitat, shellfish, other key marine indicator species,
establishing MP As, broad county participation, and public outreach and education. Jefferson MRC will use
category B funds to hire a MRC Coordinator and improve web services to accommodate internet group
meetings and educational presentations. The MRC has identified a strong need for a paid Coordinator to
improve communication and organization among the Exec. Committee, contractors, members, Board of
County Commissioners, and the local communities.

FRED fiLL MATERIALS, INC. (FHM) PROPOSALS OR PENDING PROPOSALS
FOR THE SIDNE- THORNDYKE AREA
The following is an informal, general description of the application review process timelines
for current and anticipated proposals submitted by FHM to Jefferson County.
The Department of Community Development (DCD) prepared this two-page document for
the Board of County Commissioners (BOCC) public hearing December 5, 2002 on the FHM
Mineral Resource Land (MRL) overlay application.
This document represents ONLY a best estimate of what will occur, and the application(s)
submitted by FHM may lead to different results.
MINERAL RESOURCE LAND (MRL) OVERLAY
Process:
· Comprehensive Plan (Comp Plan) 2002 amendment cycle docket: FHM MRL is one of 19
proposals. Planning Commission recommended approval of a 690-acre MRL oveday (reduced
from the 6,240-acre overlay proposed by FHM in the original application).
· DCD transmitted the Planning Commission recommendation to the BOCC, along with the
2002 Comprehensive Plan Amendment Docket Final Supplemental Environmental Impact
Statement (FSEIS), dated November 25, which contains the final staff recommendation with
conditions of approval. Copies at DCD or on County website: http://www.co.jefferson.wa.us
· BOCC is holding public hearing on MLA02-235 December 5, when oral comment accepted.
Written comment by close of public hearing December 6. Comments may pertain to any facet of
the proposal.
· BOCC will deliberate on the 2002 Docket on Monday, December 9, beginning at 2:00 PM.
· County will publish decision of the governing body and forward to State Office of
Community Development.
· If a petition if filed by any aggrieved party within 60 days of the published notice of a
Growth Management Act (GMA) action, the case goes before the Western Washington Growth
Management Hearings Board (WWGMHB), which reviews the action for consistency with GMA
(and by extension, State Environmental Policy Act::=SEPA). If deemed out of compliance, it goes
back to BOCC.
· Appeals of WWGMHB decisions may go to Superior Court, Court of Appeals and
Washington State Supreme Court.
FUTURE MINERAL EXTRACTION PROPOSALS IN MRL (IF ADOPTED BY BOCC)
Process:
· MRL does not constitute approval for mineral extraction activities. Permits required from
Jefferson County, Department of Natural Resources (DNR), Department of Ecology (Sand and
Gravel permit, NPDES=National Pollutant Discharge Elimination System), and potentially
others.
· Jefferson County and DNR to be co-lead under SEP A for future mineral extraction proposals
in Shine-Thorndyke area. Memorandum of Understanding will need to be prepared.
· County permit is Type I (stormwater management), which is an administrative review (no
hearing; appeal is to Superior Court). Regulations from UDC 4.24 (Mineral Extraction, Mining,
Quarrying and Reclamation) apply, in addition to those of other applicable UDC sections (e.g.,
3--environmentally sensitive areas protections-and 6------development standards).
· SEP A conditions from MRL approval, if any, also apply to project action proposals.

CONVEYOR AND PIER FACILITY (PRE-APPLICATION STATUS)
Process:
Upon receipt of application from FHM with applicable fees, the review and public participation
process will be carried out per Section 8 of the Unified Development Code (UDC), summarized
as follows:
· Assignment of a project planner.
· Notice of Application and Notice of a threshold determination pursuant to the State
Environmental Policy Act (SEP A) will be published in the Peninsula Daily News (PDN), mailed
to adjacent property owners and other parties of interest, and posted on the County website and at
the Courthouse.
· The threshold will likely be a Determination of Significance (DS), which prompts the
preparation of an Environmental Impact Statement (EIS). The Notice of Application will likely
be combined with the DS and Scoping Notice in one document.
· The first formal opportunity for the public is to participate is in the scoping process for the
EIS, which is intended to narrow and specify the issues to be analyzed in the EIS. There will be a
public meeting and a written comment period.
· Draft EIS will be issued to or made available to agencies, citizens, and local Tribes, followed
by a public comment period. A Final EIS will be prepared and issued together with a Notice of
Public Hearing for a Type ill permit application (conditional use zoning and shoreline). (Notice
win be published and distributed as original Notice of Application and DS/Scoping Notice.)
· The Hearing Examiner, a quasi-judicial independent 3rd party hired by Jefferson County, will
conduct a public hearing. Written comment is accepted until at least the close of the open~record
hearing. Oral comments are accepted at the hearing, as well.
· The Hearing Examiner will approve, deny, or approve with conditions. The Hearing
Examiner shoreline conditional use permit decision will be forwarded to Ecology, which has final
authority over shoreline conditional use permits per the Shoreline Management Act.
· Other agencies involved; US Army Corps of Engineers (ACOE-and by extension National
Marine Fisheries Service and US Fish and Wildlife Service), DNR (7), Washington Department
ofFish and Wildlife (Hydraulic Project Approval), Ecology-with only ACOE having a public
comment process.
· County permits include: zoning conditional use (Type ill permit per UDC Section 8),
shoreline conditional use (Type III permit), stormwater management (Type I permit).
· Time line for County permits; 120-day clock to make a decision once DCD receives a
"substantially complete" application. Clock stops for EIS preparation or other additional
information request made to the applicant. Once EIS is ready or information request is fulfilled,
clock is up and running again.
· Appeals of a shoreline substantial development permit or shoreline conditional use permit
heard by the Shoreline Hearings Board. There may be a local appeal process to an Appellate
Hearing Examiner for County zoning conditional use.
· Enforcement of County permit conditions managed by OCD through UDC Section 10, with
participation of the Prosecuting Attorney's office, when necessary. Ecology and other agencies
could be involved depending on the nature of the violation.
· BOCC is not the hearing body involved in the permitting process for proposed conveyor and
pier facility, but can be approached at anytime by concerned citizens. (BOCC meets every
Monday to conduct public business. Public comment periods are usually from 9:30 to 10:00
AM).
