HomeMy WebLinkAbout60 20 6111k'k J COUNTY OF JEFFERSON STATE OF WASHINGTON A Resolution Establishing and Appointing Members to a Jefferson County Shoreline RESOLUTION NO. 60-20 Master Program(SMP) Regulatory Reform Task Force WHEREAS,the Jefferson County Board of Commissioners (BoCC) advocates public participation and encourages citizen involvement in all matters of County government; and, WHEREAS, Jefferson County(the County) is required to update the Shoreline Master Program (SMP) as part of the periodic review and update to its shoreline development regulations in accordance with the Washington State Shoreline Management Act (Chapter 90.58 RCW, SMA), as required by RCW 90.58.080(4); and, WHEREAS, on March 25, 2019,the BoCC and the Jefferson County Board of Health adopted Resolution 17-19, a Joint Resolution establishing a Regulatory Reform Program for the County, including directing use of the SMP update as an opportunity to holistically analyze and reform County regulations and procedures providing for efficient development practices and permitting paths increasing economic development, affordable housing, residential development, environmental protection and public health; and, WHEREAS,the BoCC are empowered to create task forces by the general governmental powers with which county legislative bodies are vested; THEREFORE,BE IT RESOLVED, that: 1. The BoCC hereby establishes the SMP Regulatory Reform Task Force (Task Force)to advise the County with recommendations as the County finalizes drafting updates to the SMP; 2. The Task Force will serve as a sounding board informing the BoCC to consider possible revisions to the current SMP through the lens of regulatory reform (Resolution 17-19); 3. The Task Force's process will combine elements of"visioning" in the broad context, and learning about limitations that may reveal some ideas as infeasible; 4. The Task Force will identify critically important aspects, areas, and issues related to the marine environment and shoreline development and regulations that should be considered in the SMP review; 5. The Task Force will also consider various constraints such as the requirements of state law, staffing capacity, and resource allocation; 6. The Task Force will follow-up on issues and refinement of the Periodic Review scope through the iterative process of subsequent meetings; 7. The final outcome of the Task Force will be a Scoping Document produced by County staff and the County's consultant that lays out the parameters of the review and revision, to clearly identify what state law requires and what the Task Force recommends, considering input from the public; 8. The Scoping Document will inform the County of the issues that are included in the required Periodic Review Checklist and the SMP amendments that are proposed for consideration by the Planning Commission and BoCC; and, BE IT FURTHER RESOLVED,that the Task Force is directed to complete its review and deliver its recommendations to the Department of Community Development, with copies to the Planning Commission and BoCC on or before November 30, 2020, after which the Task Force shall dissolve immediately after delivering its recommendations; and, BE IT FURTHER RESOLVED,that the BoCC hereby appoints the following representatives with broad and diverse skill sets that relate to this SMP update effort, to serve as the initial members of the Task Force: 1. Arlene Alen, Planning Commission Member District 1; 2. Lorna Smith, Planning Commission Member District 2; 3. Richard Hull, Planning Commission Member District 3; 4. Cliff O'Brien—Port Ludlow Associates, Residential/Commercial Construction& Development; 5. Gordon King—Coast Seafoods, Aquaculture; 6. Amy Leitman—Marine Surveys &Assessments, Marine Biologist; 7. Chris Kelley—Oceanographer, Aquaculture; 8. Brent Vadopalas - Citizen at large District 1, Aquaculture; 9. Phil Andrus—Citizen at large District 2, former County Planning Commissioner; 10. David Wilkinson—Climate Action Committee, Atmospheric Science; 11. Craig Durgan—Citizen at large District 3, PUD #1; 12. Ron Rempel—Citizen at large District 2, Wildlife Biologist; and, FINALLY,BE IT RESOLVED, that the BoCC may make future changes to the membership of the Task Force by a motion approved by the BoCC to add or remove a member. ANALYSIS: Jefferson County(the County) is required to update the Shoreline Master Program (SMP) as part of the periodic review and update to its shoreline development regulations in accordance with the Washington State Shoreline Management Act (Chapter 90.58 RCW, SMA), as required by RCW 90.58.080(4). On March 25, 2019, the BoCC and the Jefferson County Board of Health adopted Resolution 17- 19, a Joint Resolution establishing a Regulatory Reform Program for the County, including directing use of the SMP update as an opportunity to holistically analyze and reform County regulations and procedures providing for efficient development practices and permitting paths increasing economic development, affordable housing, residential development, environmental protection and public health. The BoCC are empowered to create task forces by the general governmental powers with which county legislative bodies are vested. The BoCC successfully used a task force to assist with the Critical Areas Ordinance update. Similarly, the BoCC wishes to use a Task Force to assist with the 2021 SMP update. Staff has prepared a proposed resolution to appoint a Task Force for the 2021 SMP Update. FISCAL IMPACT: Staff resources to support the Task Force for the 2021 SMP Update.
