Regular Meeting — Monday, December 7, 2020, 9:00 a.m.
Jefferson County Courthouse— Commissioners' Chambers

CALL TO ORDER: Chair Greg Brotherton, Commissioner David Sullivan and
Commissioner Kate Dean participated in the meeting remotely. Chair Brotherton called the meeting to
order at the appointed time.
PUBLIC COMMENT PERIOD: The following is a summary of comments submitted
by individuals via email which reflect their personal opinions and which were read aloud by the County
Administrator:
• Comment regarding noise coming from the Jefferson County Sportsmens Association(JCSA).
• Comment regarding the masking mandate and COVID-19 estimates.
• Comment regarding the masking mandate, censorship in the news and flawed PCR tests.
• Comment regarding Jefferson County's first COVID-19 death as a person who was already on
hospice.
• Comment regarding homelessness in Jefferson County.
The Commissioners and County Administrator addressed comments and concerns raised during the
Public Comment Period.
APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner
Sullivan moved to approve the items on the Consent Agenda as presented. Commissioner Dean
seconded the motion which carried by a unanimous vote.

ADDITIONAL BUSINESS: Hearing Notice Correction: County Administrator Philip
Morley noted that the hearing notice for the Affordable Housing Sales Tax was not properly noticed.
Commissioner Dean moved to approve the revised hearing notice which will reschedule the Affordable
Housing Sales Tax Hearing to December 21, 2020 at 1:30 p.m. Commissioner Sullivan seconded the
motion which carried by a unanimous vote.
PROCLAMATION re: Thanks and Appreciation to Solid Waste Division
Employees: Chair Brotherton and Commissioner Dean read aloud a proclamation thanking Public
Works employees for their work in keeping the Solid Waste Facility open during the pandemic.
Commissioner Dean moved to approve the Proclamation. Commissioner Sullivan seconded the motion
which carried by a unanimous vote.
WEEKLY UPDATE re: COVID-19: Public Health Officer Dr. Thomas Locke
provided information on the COVID-19 virus in Jefferson County and Emergency Management Director
Willie Bence provided a situation report.
HEARING re: Jefferson County 2020-2021 Mid-Biennial Budget Revisions: Central
Services Director Mark McCauley gave a presentation on the proposed budget revisions and County
Administrator Philip Morley provided input. Chair Brotherton opened the hearing to allow for public
testimony. Hearing no testimony, he closed the oral testimony portion of the hearing. He stated that
deliberations and potential action will take place on December 14, 2020, with a time yet to be
determined.
Chair Brotherton indicated that the staffing levels at the Department of Community Development is a
concern for him. Commissioner Dean stated she is concerned about the decrease in fuel tax, which will
affect the County's Road Fund. She is also aware of low-income workers in Jefferson County and their
need for services.
HEARING re: Determination to Declare Certain County Property as Surplus: Four
Corners Road Pit to Benefit Olympic Discovery Trail (ODT),Four Corners Road to Anderson
Lake State Park Segment, County Project No. 18019892, Staff Report per JCC 3.57.050 Transfer:
Public Works Right of Way Representative Mara Dotson provided information regarding the proposed
land transfer. Chair Brotherton opened the hearing to allow for public testimony. Hearing no testimony,
he closed the oral portion of the public hearing. After a brief discussion, Commissioner Dean moved to
approve RESOUTION NO. 83-20 re: Determination to Declare Certain County Property as Surplus:
Four Corners Road Pit. Commissioner Sullivan seconded the motion which carried by a unanimous vote.
COMMISSIONERS' BRIEFING SESSION: The Commissioners reviewed recent
meetings they attended.
The meeting was recessed at 11:58 a.m. and reconvened at 1:31 p.m. with all three
Commissioners present.

CLOSED SESSION: A Closed Session was scheduled from 1:30 p.m. to 2:00 p.m.
Chair Brotherton announced that the Closed Session will be held from 1:35 p.m. to 2:05 p.m. with the
County Administrator, Labor Consultant, Clerk of the Board/Human Resources Manager, and incoming
Human Resources Manager to Plan or Adopt the Strategy or Position to be taken by the governing body
during the course of Collective Bargaining, Professional Negotiations, or Grievance or Mediation
Proceedings, or to Review the Proposals Made in Negotiations or Proceedings while in progress not
subject to the Open Public Meetings Act under exemption RCW 42.30.140(4)(b). The Board resumed
the regular meeting at 2:10 p.m. Chair Brotherton announced that the Board will be extending the
Closed Session from 2:11 p.m. to 2:16 p.m. The Board concluded the Closed Session and resumed the
regular meeting at 2:18 p.m.
EXECUTIVE SESSION: An Executive Session was scheduled from 2:00 p.m. to
2:15 p.m. Chair Brotherton announced that the Executive Session will be held from 2:20 p.m. to
2:35 p.m. with the County Administrator and Chief Civil Deputy Prosecuting Attorney regarding
Attorney-Client Privilege, Potential Litigation under exemption RCW 42.30.110(1)(i) as outlined in the
Open Public Meetings Act. The Board concluded the Executive Session and resumed the regular
meeting at 2:34 p.m.
EXECUTIVE SESSION: An Executive Session was scheduled from 2:15 p.m. to
3:00 p.m. Chair Brotherton announced that the Executive Session will be held from 2:36 p.m. to
3:21 p.m. with the County Administrator, Chief Civil Deputy Prosecuting Attorney and Central Services
Director regarding Attorney-Client Privilege, Actual Litigation under exemption RCW 42.30.110(1)(i)
as outlined in the Open Public Meetings Act. The Board resumed the regular meeting at 3:22 p.m. Chair
Brotherton announced that the Board will be extending the Executive Session from 3:23 p.m. to
3:35 p.m. He also announced that the Public Records Administrator has been, and will continue to be,
participating in the Executive Session. The Board concluded the Executive Session and resumed the
regular meeting at 3:36 p.m.
COUNTY ADMINISTRATOR BRIEFING SESSION: County Administrator Philip
Morley reviewed the following with the Board.
• Future Agenda topics
• Gardner Community Center; request for additional funding coming soon
• Review of items to discuss, and Humane Society licensing agreement
• County staff; workload
• Combined Interlocal Agreement(ILA); upcoming combined ILA with the City of Port
Townsend, Jefferson County, the Jail, District Court and City prosecution services.
• Calendar Coordination
• Board of County Commissioners; office rotation/schedules
• Washington State Association of Counties (WSAC); request for estimate of anticipated 2021

consider mid -biennium revisions to the 2020-2021 biennial budget including the General Fund,

Statement of Issue:
During the course of right-of-way negotiation, Jefferson County PUD expressed interest in the
transfer of County property in exchange for an Olympic Discovery Trail (ODT) easement across
their Four Corners Road property. A Notice of Intention to Surplus County Property and a Public
Hearing are required prior to the surplus of County real property.
Analysis/Strategic Goals/Pro's Et Con's:
The Board has previously discussed this issue at a regular meeting on October 26, 2020.
Jefferson County Code Chapter 3.57, Rules for Sale, Disposition or Lease of County Surplus Real
Property, states that property can be transferred from agency to agency when property is
deemed surplus and is a public benefit. The transfer of this county owned property is necessary
in order to conclude the acquisition of an ODT trail easement across the PUD property.
Fiscal Impact/Cost Benefit Analysis:
The difference in appraised value between the County property and the ODT easement will result
in approximately $12,700 in proceeds which, after associated sale expenses are deducted, will be
returned to the fund that originally purchased the property.
Recommendation:
Approve Resolution for Notice of Intention to Surplus County Property and Notice of Public
Hearing.

WHEREAS, it is the desire of the County Commissioners of Jefferson County to dispose of
surplus property;
WHEREAS, the Department of Public Works has indicated a need to dispose of surplus
County property, commonly known as Four Corners Road County Pit, and partially described as,
S33 T30 R1 W Tax #2 (Gravel Pit), situate in the County of Jefferson, State of Washington, by way
of an agency to agency transfer and in exchange for a trail easement from Jefferson County PUD; and
WHEREAS, RCW 36.34.020 and JCC Ch. 3.57 requires that the intention to declare surplus
property be published with a Notice of Public Hearing regarding the disposal of any County Property;
NOW, THEREFORE BE IT RESOLVED, by the Commissioners of Jefferson County that a
Notice of Public Hearing shall be published as required by RCW 36. 34.020 and JCC Ch. 3.57,
particularly describing the property to be sold and designating the place where, and the day and hour
when, the hearing will be held for such consideration.

Subject: Support for the Olympic Discovery Trail Project
Jefferson County Public Works has requested a 2.043-acre Olympic Discovery Trail easement from Jefferson
County PUD #1 (PUD). The trail easement is on portions of three PUD parcels (APN 001333014, 001333037
& 001333038). Just Compensation for the proposed trail easement, determined by a fair market appraisal
and review appraisal, has been determined to be $18,600.
In lieu of Just Compensation in the form of cash for the Trail easement, the PUD has expressed interest in
acquiring the 1,38-acre, County owned parcel (APN 001333013) adjacent to the PUD's Four Corners Road
facility. fair market value for this parcel, determined by appraiser and review appraiser, has been
determined to be S31,300.
In order to create an equal exchange, Jefferson County proposes that the PUD pay the $12,700 difference
in values between the County parcel and the proposed Trail easement.
