I agree. It reads like a soap opera! It's also very confusing. rm inclined to stay out of it as much as I can. Here's what I've told the Prices that I will do: Draw a floor plan showing the proposed changes to the house. Give you a copy of it so that you can talk it over with the boss and decide what the requirements will be for dealing with the septic system. I had been suggesting to the Prices that I could follow through on those requirements. I now think that it would be better for them to get in touch with Ryan and ask him to sort it out,. It -s seem that even just designating a reserve area will be complicated -- too close to wells -- too close to shoreline -- crummy ils -- restrictive covenants..... The receptionist at the Health Department told me that you are now handling septic systems on Marrowstone. I am about to start work on a small remodel/addition for Arthur and Margaret Price who own a cabin next door to Ryan Tillman's parents. I looked up the septic record (SEP -74-116) and find that the system seems OK as far as size. It also seems to have survived an inspection in the mid -80s when the Prices bought the place. I was told that all I need to do is designate a reserve area. So, my question is: what is the process for designating a reserve area? I think I've gone through this before but rd like an update so I don't have to spin my wheels. You can call me if it's easier: 385-1172. In response to your other inquiry regarding a sewage disposal permit application made in June 1984 for Tax 89, Griffith Point, I submit the following: Due to the time delay in your preparation of the site for evaluation a reapplica- tion will be necessary when you wish to pursue development of this lot. Review will be under current requirements which were adopted 7/1/84. If you had acted in a reasonable period of time after the 6/29/84 application we would have applied the requirements in effect at the time of application. Our file indicates several attempts were made by this office to determine if the site was ready. Mr. Hayes does not concur that he advised you, or your son, in June 1985 that the old regu- lations would apply. I also received no response to my March 5, 1985 letter to you. I am sorry but we are unable to apply standards that were dropped two years ago. As no site visit was made in 1984, you can apply the $85.00 fee paid at that time to the new permit by submitting an additional $15.00. (Enclosed d:s sewage:disposal application.) The original of this latter plat map was color -coded, and is in Tony Bodenheimer's possession. I will speak with Clyde Gagne in greater detail regarding the circumstances in which Russ Tillman reconstructed the original system in 1981. All that I know for certain at this time is that Mr. Gagne thought Mr. Tillman was to secure the permit in advance of the reconstruction, while Mr. Tillman claims to have thought that Mr. Gagne was to obtain the permit. As I stated in our first telephone conversation on April 4, 1986, our objectives are to not only resolve the oustanding.dispute between the Gagnes and the Prices but to assist you in your investigation of work by the unlicensed contractor in Jefferson County. We have awned property on Griffiths Point Road since 1969 when we bought a 100 foot waterfront lot, We located a Mobile Home on this property in 1971 and contracted with Duke and John Shold for the installation of a septic tank the same year. This septic system has continued to work perfectly through the years. We subsequently bought the adjoining 1001 waterfront lot,, (tax 80) in 1973 with the long term view of building our permanent home there. The preliminary planning for this project began with filing a SDP application with your office June 29, 1984. We were advised that the site would be evaluated according to the rules in effect at that time which was very important because the subsequent 100% backup rule is difficult to accomplish on these lots. In December of 1984, a large fir windfall destroyed our mobile home, we were forced tb move back to our old home in Auburn and our build- ing plans were delayed. You wrote us a letter on March 5,1985, (copy enclosed) regarding dropping our SDP Application. Dropping this application was of great concern to me because we would lose the advantage of utilizing the old rules and therefore went to your office personally to discuss it. Since you were out, another Health Dept. representative, I believe John Hayes, advised me that as long as they knew we intended to pursue the project, the Department would honor the application in its present form when we had the site prepared. we agreed that the 085 fee and Application remain on file with the Department until the site was prepared. The above position was 'again confirmed by John Hayes in June 1985 when my son, Ryan, visited your office to see if the applic- ation needed to.be updated becausel year was about to pass since filing. We have now sold our Auburn house and are planning to get started building our new house this fall. 'However, John Hayes indicated Monday July 7, when I came in to see you that there may be some problem with honoring the application. The site should be prepared by September and we hope it can be evaluated per our original application. Can you advise on this matter? -2- The 2 The second problem I need your assistance with is of course the Gagne/ Price dispute. You have apparently been advised by Gagne and perhaps Price that 1 played a major role in fixing Gagne's drainfield. 'Phis is to state for the record that I did not participate in any way on this project. My son, ttyan, was involved as an employee of Gagne and supplier of materials after advising Gagne he had to be his own contrac- tor. 1 am enclosing a copy of a letter from ttyan to you dated May 27, 1956, which accurately describes the situation and which you maybe didn't receive. The dealings were directly between Gagne and nyan and in no way involved myself. 1 would appreciate copies of any documentation from any source which disputes the above statements. He will have Tony.Bodenhe.imer and Mr.&Mrs. Price do this (Gagne will pay). Will apply, etc., within next 20-30 days. I will then also contact Tillman re violation of Jefferson County Ordinance -installer. Gagne also did not get permit because he thought Tillman did? or Tillman told him he did not need one. RMD 4/9/86 - O.C. MR.&MRS Price. Discussed that they will contact other party and decice who will apply for evaluation of existing system. Mr. Price could uncover outlet side of tank and stake drainfield. He gave me map based on where he found drainfield by digging down. RMD U hour +) 4/9/86 - O.C. Tony Bodenheimer. He says Gagne wants drainfield relocated elsewhere on Price's property. News to me. Told Tony to talk with Price and have both parties decide what they want. END (? hour +) 5/2/86 - Met owner, Art Price, and installer, Tony Bodenheimer, on-site. e -Box - Equal flow to lines 1 & 2 - Line 3 outlet higher. Majority .of flow to line 2. 2) Outlet baffle in tank close to needing replacing. 3) Tank was to be pumped later today. 8) At or near property 4) 18" cover to top of Box. line pipe at 26" & 20" 5) 24 to tog of line 2 outlet pipe. (see map). 6) Appears trenches had been backfilled wth sand. 7) Line 3 "snake" Tony said stopped at 21i. No sign of failure, but system close to beach (50' approx.) Rest of lot treed. 5/6/86 - Met with John Raymond. Discussed history and status of site based onRcIIurrent information. John concurred the system cannot be approved as installed without permit by owner and neighbor.. He does not intend to proceed with any legal action as this occurred three years ago and, based on my description of site conditions, etc., would not likely be a viable option to redo or relocate the septic system. - He concurs with content of evaluation of existing system report. - John also indicated the buyer, Price, has, an "implied easement" as the drainfield was already off the property when he bought it.
