Achieving compliance for vegetation removal and building construction in a wetland:
-Under provisions of the Growth Management act (36.70A of WAC), Jefferson County maintains maps of
critical areas pursuant to implementation regulations outline in 365-190 of WAC. The County’s GIS
mapping describes critical areas maps which indicate potential critical areas onsite, as determined by
the Department of Natural Resources. GIS mapping data is updated frequently at the local level and
periodically by DNR.
-Our maps assist in the critical area review component of consistency review for development permits.
All project proposals that come through DCD undergo critical area review.
-In this case, your property (PID#821271019) has been cleared and graded and had two structures built
without a permit. These are regulated activities in wetlands and wetland buffers (18.22.270(a) and
18.22.270(f), respectively).
-We understand that property owners might not be aware of wetlands or other critical areas on their
property, so when code compliance issues are raised we allow property owners to bring projects up to
code through the Built Without Permits (BWOP) process.
-Moving forward via BWOP, property owners will submit the projects for review as though they are
proposals. We will perform consistency review and request any additional information or special reports
necessary. Considering this project’s proximity to/encroachment on a wetland, we will require wetland
delineation (18.22.710(4)(a)(ii)).
-Under 18.22.740(1)(c), mitigation efforts for potential adverse impacts to wetlands includes repairing,
rehabilitating, or restoring the affected environment to the historical condition of the wetland. This
section’s goal and overarching policy is to establish a ‘no net loss’ of wetland value, function, and area.
-Since potential damage has already occurred the county will require a habitat assessment that includes
a restoration and rehabilitation plan under 18.22.740(1)(c).
-You will need to submit the following items in order to meet code compliance:
-A permit application;
-A wetland delineation report;
-And a habitat restoration and rehabilitation plan
