Jefferson County Board of Commissioners
Regular Meeting — February 8, 2021, 9:00 a.m.
Jefferson County Courthouse — Commissioners' Chambers
1820 Jefferson Street, Port Townsend, WA
CALL TO ORDER: Chair Kate Dean, Commissioner Greg Brotherton and
Commissioner Heidi Eisenhour participated in the meeting remotely. Chair Dean called the meeting to
order at the appointed time. She stated since next Monday is a holiday, the next Commissioners meeting
will be held on Tuesday, February 16, 2021. She noted there will be a KPTZ radio forum regarding
Homelessness on February 9, 2021 at 6:00 p.m.
PUBLIC COMMENT PERIOD: The following is a summary of comments submitted
by individuals via email which reflect their personal opinions and which were read aloud by the County
Administrator:
• Comment regarding the homeless encampment at the Jefferson County Fairgrounds.
• Comment regarding COVID-19 information and false negative PCR tests.
• Comment regarding the homeless encampment at the Jefferson County Fairgrounds.
• Comment regarding the homeless encampment at the Jefferson County Fairgrounds.
• Comment regarding Washington State Ferries upcoming online meetings February 9 and 10, 2021.
The Commissioners and County Administrator addressed comments and concerns raised during the
Public Comment Period.
APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner
Brotherton moved to approve the items on the Consent Agenda as presented. Commissioner Eisenhour
seconded the motion which carried by a unanimous vote.
1. RESOLUTION NO. 11-21 re: Re-establishing Jefferson County Cash Drawer, Petty Cash
Account and Revolving Fund Amounts in Various County Departments
2. AGREEMENT re: To Provide Vaccine Clinic Volunteer Support and Related Services; No

COMMISSIONERS' BRIEFING SESSION: The Commissioners discussed recent
meetings they attended.
WEEKLY UPDATE re: COVID-19: Public Health Officer Dr. Thomas Locke
provided information on the COVID-19 virus in Jefferson County and Emergency Management Director
Willie Bence provided a situation report.
The meeting was recessed at 10:26 a.m. and reconvened at 10:32 a.m. with all three
Commissioners present.
CLOSED SESSION: A Closed Session was scheduled from 10:30 a.m. to 10:50 a.m.
Chair Dean announced that the Closed Session will be held from 10:33 a.m. to 10:53 a.m. with the
County Administrator, Human Resources Manager, and Central Services Director to Discuss Labor
Strategy or Position for Collective Bargaining not Subject to the Open Public Meetings Act under
exemption RCW 42.30.140(4)(b). The Board resumed the regular meeting at 10:54 a.m. Chair Dean
announced that the Board will be extending the Closed Session from 10:55 a.m. to 11:00 a.m. The Board
concluded the Closed Session and resumed the regular meeting at 11:02 a.m.
HEARING re: Proposed Speed Limit Reduction in Port Ludlow for Paradise Bay
and Oak Bay Roads; re: Revising Exhibit "A" Jefferson County Speed Limits of Ordinance No.
11-1214-98 regarding Traffic Speeds on County Roads Codified as Jefferson County Code,
Chapter 10.05: Public Works Transportation Manager Wendy Clark-Getzin provided information
regarding the hearing on a proposed speed limit reduction in Port Ludlow. Public Works
Director/County Engineer Monte Reinders and Deputy Art Frank commented in favor of the proposed
speed limit reductions. After discussion, Chair Dean opened the hearing to allow for public testimony.
The following individuals provided testimony: Bill Dean, Tom Thiersch and Alan Kiesler.
Hearing no further testimony, Chair Dean closed the public hearing to oral testimony. The Board started
deliberation on the issue. After discussion, Chair Dean closed the hearing to written testimony. County
Administrator Philip Morley stated that staff will coordinate with Public Works and bring back
information requested by the Board within the next two weeks to assist in the Board's deliberations.
COMMISSIONERS' BRIEFING SESSION — Continued: The Commissioners
discussed their desire to attend the Washington State Association of Counties (WSAC) lunch-time

meetings together. Staff will work on addressing potential Open Public Meetings Act (OPMA) issues on
this request and report back to the Board prior to the next meeting. The Board discussed the Joint
Oversight Board's allocation recommendations and the Jefferson County Fairgrounds homeless
encampment.
The meeting was recessed at 11:51 a.m. and reconvened at 1:32 p.m. with all three
Commissioners present.
EXECUTIVE SESSION: An Executive Session was scheduled from 1:30 p.m. to
2:00 p.m. Chair Dean announced that the Executive Session will be held from 1:32 p.m. to 2:02 p.m.
with the County Administrator and Chief Civil Deputy Prosecuting Attorney regarding Attorney -Client
Privilege, Potential Litigation under exemption RCW 42.30.110(1)(i) as outlined in the Open Public
Meetings Act. The Board concluded the Executive Session and resumed the regular meeting at 2:03 p.m.
EXECUTIVE SESSION: An Executive Session was scheduled from 2:00 p.m. to
2:30 p.m. Chair Dean announced that the Executive Session will be held from 2:03 p.m. to 2:33 p.m.
with the County Administrator and Chief Civil Deputy Prosecuting Attorney regarding Attorney -Client
Privilege, Actual Litigation under exemption RCW 42.30.110(1)(i) as outlined in the Open Public
Meetings Act. The Board resumed the regular meeting at 2:33 p.m. Chair Dean announced that the
Board will be extending the Executive Session from 2:34 p.m. to 3:04 p.m. The Board concluded the
Executive Session and resumed the regular meeting at 3:05 p.m.
COUNTY ADMINISTRATOR BRIEFING SESSION: County Administrator Philip
Morley reviewed the following with the Board.
• Review of items to discuss
• Legislative Update
• ADDITIONAL BUSINESS: Letter to the Governor regarding Jefferson County COVID-
19/Phase II: After discussion, Commissioner Brotherton moved to authorize Commissioner
Eisenhour to draft a draft letter with input from the Public Health Director, Public Health Officer
and the County Administrator, and the County Administrator will consolidate the letter to
include any edits from the Commissioners and present back- to the Commissioners for_ signature.
Chair Dean seconded the motion. After discussion, Chair Dean called for a vote on the motion.
The motion carried by a unanimous vote. The letter regarding Phase II will be sent to the
Governor's Office and the Washington State Department of Health.
• Calendar Coordination
• County Administrator's Report: Topics included: Jefferson County Fairgrounds, Jail subrecipient
agreement, Production Alliance agreement, Goodman Sanitation agreement, BOCC Senior
Management Retreat cancelled is rescheduled to February 23, 2021, Isolation and Quarantine
rooms contract, Bi-Annual Associate Development Organization (ADO) designation, Economic
Development Council (EDC) Team Jefferson, Strategic Plan, Munis, EnerGov, Department of
Community Development (DCD) staff support, future entheogens discussion, and other
miscellaneous topics.
• Intergovernmental Collaborative Group (ICG): Debrief regarding recent Strong Towns
presentation by Charles Marohn. Upcoming meeting topics also discussed

The Port Ludlow Village Council, through its Transportation Safety Committee, has been working on ways to
make Port Ludlow a safer transportation corridor for residents, guests, and those who drive through Port
Ludlow to other destinations in Jefferson County. Over the last five years several initiatives have been
studied and researched. Since a public hearing is scheduled for the JeffCo Board of Commissioners Meeting
on February 8th at 11:00 AM, we would like to invite you to virtually attend one of our Roadway Safety
Presentations to the Port Ludlow Community before the public hearing.
Below is a copy of the eblast message that was sent out announcing the community presentation. It also
contains links to the roadway safety documentation that data was pulled from for the presentation and
includes login information for joining the meeting. The PLVC Transportation Safety Committee feels it is
important to reach out and invite you to attend. JeffCo Public works has been actively involved in this

Dear Jefferson County Commissioner Greg Brotherton:
My name is Tamra McDearmid and I live in Port Ludlow on Rainier Lane.
I'm contacting you to ask that you approve the change in Speed Limit in Port
Ludlow on a portion of Paradise Bay Road and a portion of Oak Bay Road to
35 mph.
Frankly, I'd love to see the 35 mph speed limit extend south from Teal Lake
Road on Paradise Bay Road, and north from the Fire Station on Oak Bay
Road, but this is a good start.
We've lived in Port Ludlow for over to years, and in that time have observed
many cars driving up to 6omph on these roads where there are several
neighborhood roads adjacent to these main roads through Port Ludlow, plus
walkers and bike riders.
It's a dangerous situation that will unfortunately result in traffic crashes and
roadway disruptions. By lowering the speed limit, the hope is cars will slow
down and observe this change.
It can only happen with your approval, which I respectfully ask for your vote
in the positive.

Please don't waste Jefferson County resources doing any of your possible proposed
traffic changes in Port Ludlow. Things are fine as they are! If anything, make sure the
striping on the roadways are up to date for good visibility at night and in the fog.
Consider when applicable of reducing the ditches at the sides of Paradise Bay Rd. or
putting up more roadway guards. Most accidents I bet are caused just by bad drivers!

The Port Ludlow Village Council Transportation Safety Committee has been
working on this program and engaging with JeffCo Public Works for nearly 5

I am categorically opposed to the proposed initiative. The problem would be readily solved by enforcing the existing
speed limits. A further traffic safety improvement would be made by enforcing posted STOP signs. The Port Ludlow
community should set an example for other drivers by observing all traffic regulations.

Jefferson County Commissioners,
I am in favor of all the recommendations in the speed limit reduction initiative. I live less than one block
from the intersection of Oak Bay Road/Walker Way/Marina View Drive and observe the difficulties of
pedestrians and vehicles attempting to negotiate that intersection coming from Walker Way. A reduced speed
limit combined with a four way stop will dramatically increase the safety of everyone involved.
I urge you to approve these important safety proposals.

I support reducing the speed limit along Paradise Bay Road in Port Ludlow. The section of road as proposed by the Port
Ludlow Village Council is a dangerous section of road with several difficult feeder intersections.
Even though it is not on the agenda now, I believe that a traffic circle would an effective improvement for the four way
stop at Paradise Bay Road and Oak Bay Road. I recognize that it could be expensive, but hope that money might be
found for such a project.

The following motion was made and favorably approved by a vote of 6 to 1.
Whereas the Board of Trustees of the Ludlow Maintenance Commission is
required to take reasonable measures based on evidence, and conforming to
statutory and common law, to enhance the safety of members of the
Homeowners Association,
And,
Whereas a Traffic Study commissioned by Jefferson County and conducted by
experts informed by federal, state, and local laws and policies and best practices
suggested by the American Association of Retired Persons has recommended
changes to the roadways used by our members,
And,
Whereas the appropriate officials have recommended as Priority One a
roundabout where the roadway accessing our Beach Club and one
neighborhood, along with a reduction in speed limits, that will improve safety for
our members and other persons
And,
In general, other recommendations will provide safety improvements for all
persons using the Master Planned Resort of Port Ludlow,

the Jefferson County Department of Public Works.
The Ludlow Maintenance Commission represents over 1,000 owners in the North Bay
section of Port Ludlow and it is hoped that you will vote favorably to adopt these speed

Dear Board Members,
I am writing to express my thoughts on the speed limit change being considered for Port Ludlow. PLEASE DO NOT
CHANGE IT. It is already too slow and encourages driving faster than 40 miles per hour, which many drivers do. Dropping
it by 5 mph will not change a thing and will cost taxpayers, I suspect, for sign changes, notifications, etc. There are ample
shoulders for walking and biking, which might concern some residents. Although I have never seen data regarding traffic
accidents in Port Ludlow, my hunch is that it rarely, if ever happens. I imagine that is why data have not been
reported..... nothing is happening in that regard. So why change something that works!

I want to thank Public Works Director Reinders and his staff for bringing these speed
reduction requests for Oak Bay Road and Paradise Bay Road in Port Ludlow before
you. I am urging you to approve them as the first part of the traffic safety upgrades for
Port Ludlow.
The Transportation Solutions, Inc. Port Ludlow Village Traffic Safety Report dated June
2020 clearly shows that speeding and stop sign running is very common within the
Master Planned Resort on Oak Bay and Paradise Bay Roads. As our population has
increased significantly in Port Ludlow over the last 20 years the speeding and stop sign
running has become increasingly dangerous. These speed reduction changes are
proactive to help reduce the risks of dangerous accidents.
I would also like to encourage the Commissioners to have Public Works and the Port
Ludlow Village Council Trails Committee work together to improve the two trail
crossings on Oak Bay Road between Waterhouse Lane and Scott Court. The reduced
speed limit will help pedestrians but increased signage and removing vegetation for
better lines of sight would also increase safety. This could all be done with the change
in speed limits and the chipseal-repainting narrowing the road widths.
I would like to think of all of the above as the first phase of traffic safety improvements
for Port Ludlow and would ask that Public Works begin planning for mini -roundabouts
at Oak Bay, Walker Way and Marina View Drive and Paradise Bay, Oak Bay and
Osprey Ridge. It is clear from the TSI study and the National Traffic Safety Council
that mini -roundabouts are safer than 4-way stops for bicycles, cars and pedestrians.
No land would have to be acquired for these roundabouts and they would be paid for
using grant money. It will take years to get the funding and engineering studies done
for the roundabouts so I would ask that you have Public Works begin the planning for
them.
I want to thank you for holding the Public Hearing on the speed limit reductions as put
forth by Public Works and again I urge you to vote in favor of these changes.

RE: TRAFFIC SAFETY PROPOSAL BY THE PORT LUDLOW VILLAGE COUNCIL
SNYOPSIS:
Approximately five years ago the Port Ludlow Village Council appointed a committee to research possible
solution to a serious traffic safety problem. On February 8th, 2021 they are submitting their
recommendations to the Jefferson County Board of Commissioners.
The problem is caused by drivers who by intentional act or omission violate traffic laws.
The proposal by the Port Ludlow Village Council will take a considerable amount of time, exorbitant costs
and at the best be unable to quantify any positive results.
RECOMMENDATION:
I respectfully recommend that the recommendations of this committee be held in obeyance until such
time as the inconsistencies, reasons for the consultant's lack of support, cost of implementation and
overall methodology are reviewed, and alternative solutions studied.

TRANSPORTATION SOLUTIONS Inc.
Jefferson County Department of Public Works at some point contracted with TSI to conduct a study of
materials and ideas developed by the PLVC Traffic Safety Committee. That study is put forth in a 123-
page report that does an excellent job of describing the problems reported and evaluations of the
complaints by TSI along with recommendations. It was noted that the consultant's findings in all five of
the key requests were negative. It was interesting to note that the capacity of the streets and roads
involved has not been reached since the roads were developed for traffic volume expected many years
from now.
BACKGROUND:
This issue is due to the concern of residents over traffic safety. There have been complaints to Jefferson
County, the Department of Public Works, and the Jefferson County Sheriff for over twenty years. While
there are many facets involved the primary concerns are speed both on major arteries and residential
streets, pedestrian safety, and failure to stop for stop signs. The Department of Public Works has surveyed
some of the streets and documented speeds in the high fifties and low sixties in twenty-five mph zones.
ALTERNATIVE SOLUTION:
The Jefferson County Sheriff's Department is responsible for traffic enforcement in the unincorporated
areas of Jefferson County. The Sheriff's Office currently receives more than $750,000.00 in taxpayers
money per year and has for the last ten years according to Commissioner Greg Brotherton.
Since this is a traffic related issue that the Sheriff's Office is trained and equipped to handle with the
mobile radar units and vehicle mounted radar units it has, It is a relatively simple matter to increase traffic
enforcement in any specific area, and specifically those violations causing the complaints and hazards.
I am aware of the manpower situation with the Sheriff's Office but then again, I am very well aware having
been in command of two traffic divisions that this solution is not only possible with a limited staff it is
necessary and fiscally viable.
This solution can be extremely effective in a matter of weeks instead of the five years that the current
traffic safety committee has taken without any effect.
I would be very willing to meet with any of those persons that wish to discuss this matter further.

My husband and I are retired and consider ourselves to be excellent drivers. We continue to take on-line driving
classes and intend to monitor our driving abilities as we age.
We are FIRMLY AGAINST the proposed changes. There is nothing wrong with the way it is now. Have you ever been
behind someone who has driven all the way to QFC at 20 miles/hour? Changing the speed limit will not change the way
the elderly drive.
I do believe that walking paths especially near the Fireside Inn would be an asset. Perhaps a cross walk in this area
would help those crossing the street. A few tickets to those who violate this and word will get out to stop and let
people cross.
PLEASE DO NOT change the speed limits!

I totally support the recommendations submitted by the committee from Port Ludlow. People drive way too fast along
Oak Bay Road.
In addition, walking paths away from the shoulder need to be installed along Oak Bay Road from Baldwin Lane to the 4
way stop sign at the intersection of Oak Bay Road, And also from that intersection out to the end of Oak Bay Road, the
shoulder is narrow to non existent along several sections of Oak Bay Road and there are a lot of people who walk to stay
healthy.

exist. They were repealed in 1993.
These should not be treated as mere "scrivener's errors".

To have a usable, enforceable statute, meaningless references must be removed and valid references must be
supplied before the proposal can be evaluated.
The fact that our county code is so seriously out of date should be a concern!
While reviewing and correcting the Code, it would be appropriate to also decide if it is still necessary for the
county to not adopt by reference the entire state traffic ordinance.
That is, ask yourselves what it is that makes Jefferson County so different that we have to have our own
subset of laws when traffic control really should be standard everywhere. The sections of the Washington
Model Traffic Ordinance that were previously "not adopted" all deal with the licensing and operation of bicycles
on public roads.
Our county spends large amounts of money on parts of roads that are of benefit only to bicycles. Why isn't it
time to license and regulate bicycles in a manner that is consistent with state law?
By adopting the state laws in full, the problem of obsolete references in the local code is greatly reduced.
Missing Pages
Pages 62 through 138 of the agenda packet item ( "020821_ra01.pdf" ) are completely blank.
The public cannot be expected to testify on an agenda item where 53% of the pages are blank. The BoCC
must not approve a proposal based on so much non-existent information.
Abrupt Changes to Speed Limits are not safe
Speed limits should not `jump' abruptly from 40 to 25, as is being proposed. That situation is found in several
places throughout the county and adding more such areas is not a good idea. Gradual slowing in 5 mph
increments is a much safer approach.
Adequate warnings [ "Speed Limit NN ahead" ] must also be posted, consistently, throughout the area.
Conclusion
This proposal should not be approved in its current form. A corrected proposal should be resubmitted and
another hearing should be scheduled.

We understand there is a review of the speed limit on Oak Bay Road.
This we understand is being driven by the difficulties people are having in safely crossing this rather wide
roadway.
Noting the number of pedestrians in Port Ludlow is small, a high percentage being seniors, and that they are
normally out walking only during a few hours of each day.
Speed limits having a twenty four hour a day impact.
To ensure safety, would not the best solution be to leave the speed limit as it is, and install pedestrian crossings
with "on demand" traffic lights at say two locations.
One could be near the Walker Way or Swansonville roads, with another in the area of Scott road.

Dear County Commissioners,
We wholeheartedly support the reduction in the speed limits on the two main roads within Port Ludlow, Paradise Bay
Road and Oak Bay Road.
The Village Council has sponsored the review of this subject within the framework of other enhancements for several
years and has worked closely with Monte Reinders and his Public Works personnel to address this" bite of the elephant"
as a first step. The other recommendations are also supported, but taking this step is recommended at this time
considering budgets and funding realities. It needs to be recognized that this was not a staff and board developed
recommendation as multiple public hearings were held with residents to obtain their input and Public Works hired an
outside consultant to review the suggestions developed by community members. This recommendation is the result of
a significant collaborative effort.
Port Ludlow is a community with its own trail system of over 20 miles which is used regularly by a large number of
residents and visitors to our community. In addition, there are two recreation centers in Port Ludlow, the Bay and Beach
Clubs which are used by the members. We mention these items to support the proposition that residents of Port
Ludlow are active and use the facilities that are available for them to maintain their health and wellness through
exercise. The trails and recreation centers funnel hikers onto the roadways and it must be stressed THERE ARE NO
SIDEWALKS within the Master Planned Resort. The net effect is the roadways are used for more than just driving.
The age of the Port Ludlow population is over 66 years. As tough as it is to admit this, we are not physically able as we
were when we were younger and this has an impact both on our driving and our walking awareness. Speed reductions
in this recommendation recognize this reality and enable the community to continue to safely obtain the exercise that is
so necessary. Needless to say, the COVID-19 pandemic has increased the usage of the roadways for hiking and walking
which is another supporting reason to approve this recommendation.
We appreciate the efforts of Monte, his staff, and the Village Council Committee members that have brought this
recommendation to the forefront, strongly support your approval and hope you will authorize Public Works to
commence implementation as soon as possible.

Hello Commissioners!
I have been out of town in January and haven't been able to participate in the Roadway Safety Presentations. I support
lowering the speed limit on Oak Bay Road, but I would LOVE to see it expanded to include more of the north side of
Swansonville Road.
Specifically, traffic speeds by the fire station area (Mats Mats). In fact, my husband was in an accident on the corner of
our own street (Maple Lane). LuAnn Spitzbart, owner of Tootsies has been trying for years to RETURN this strip of Oak
Bay to the 30 mph speed limit that it was when the quarry was in use.
I'm probably too late to the party, but I did want to lobby for increasing the length of the slower zone. When my
