Dear Mr. Sheppard:
We have completed our review of the materials submitted by BDN via your email from October 22, 2020
and provide the following comments. We apologize for any delay in getting this response to you. Among
other things, County operations have been affected by the pandemic.
1. Updated Biological Evaluation. We appreciate the substantial work BDN has done to update its
Biological Evaluation at the request of the Department of Ecology.
2. Inconsistencies in the Attachments identified in the SEPA Environmental Checklist. As noted in your
email from October 22, 2020, the attached files were intended to serve as the latest version of the
application. However, there were some inconsistencies between text in the SEPA Environmental
Checklist (Checklist) and the attachments to that email. We recommend that the following be clarified
before the application is noticed.
The four attachments below were referenced in the Checklist, but were not included in the most recent
submittal. If the following are no longer part of the application, any reference to them should be removed
from the Checklist. If the following are to be included in the application, DCD would add any of these
documents intended to be included from the October 18, 2019 submittal, when the application is noticed.
Please clarify if any of the following are to be included in the current application under review.
A2. Addendum to the Biological Evaluation (dated September 13, 2016) prepared by Confluence
Environmental Company.
B1. BDN Eelgrass Delineation and Depth of Culture Survey, Draft (dated October 16, 2015).
H. Letter from Plauche Carr (dated March 29, 2017).
I. Gear Management Plan.
3. Four Attachments in Section A.8 of the Checklist. The four attachments below are included in section
A.8 of the Checklist (pages 2 and 3). Please provide the clarification discussed below.
C. The Visual Assessment report was revised in September 2020 but the most recent submittal was
missing Appendices A and B. Please clarify if the appendices were updated when the report was
revised. If so, submit the revised Appendices A and B; if not, please confirm that DCD can use
copies of these appendices from the October 18, 2019 submittal.

D. A Cumulative Impacts report (dated May 2019, revised September 2020) was submitted, but the
date of this report does not agree with either date for Attachment D10 or Attachment D2 refenced
in the Checklist. Should Attachment D10 be Attachment D1?
F. and G. Three letters from the U.S. Army Corps of Engineers were submitted, none of which
appear to be dated November 1, 2016. Please clarify which documents should be included as
Attachment F and Attachment G, and submit the November 1, 2016 document, if it is to be
included in the current application. Note that a Programmatic Endangered Species Act (ESA)
and Magnuson-Stevens Fishery Conservation and Management Act Essential Fish Habitat
Consultation Specific Project Information Form (dated October 27, 2016) was included in the
October 18, 2019 submittal. If this document is intended to be part of the current application,
please clarify if it should be Attachment F or G.
4. Stormwater Submittal. Thank you for the stormwater submittal for the upland parcels. The
stormwater submittal indicates no ground-disturbing activities (such as vegetation clearing) and no new
impervious surfaces will be needed for the four upland parcels to be used for materials storage and staff
parking. Based on the information submitted, an approval would be conditioned to prohibit any
ground-disturbing activities or new impervious surfaces on the four parcels addressed in Attachments M1
through M4 of the Checklist.
5. Modification of the October 28, 2013 Biological Evaluation. Please submit a letter from Marine
Surveys & Assessments explaining the changes to the October 28, 2013 Biological Evaluation.
Please provide a response to the numbered comments above.
Please submit the above information to the Department of Community Development within 90 days of the
date of this letter which would be 5/25/2021. Please call 360-379-4450 to speak with the assigned planner
if you have any questions.
