Setback from wetlands are required by the County, so in this sense setbacks are driven by County regulations. Development within the wetland buffer (approximated in the red area I mapped for you) is prohibited. However, you may request a wetland buffer reduction of up to 25% if you can demonstrate that the constraint prevents reasonable use of the property. Assuming a 150 foot buffer, the buffer could be reduced by 37.5 feet to 112.5 feet. However, the concurrence of shoreline jurisdiction and the moderate CMZ may render the buffer reduction of limited value, as CMZs within shoreline jurisdiction impose their own constraints on development. I am happy to continue assisting you with your questions, however we have worked beyond the 30 minutes scheduled for this CAM and the Department will require that I invoice you for time spent on additional questions. Please let me know if you would like to receive an invoice for more time to detail regulations applicable to this property. You can follow up with neighbors or the realtor to see if a wetland delineation report was produced—for the individual property or the neighborhood (including the parcels of interest). Any existing wetland materials should not be dated before 2015, as these reports expire every five years. I went ahead and looked through our archived wetland reports, and did not find any for this property in the last five years. If no report exists, or is not up to date, the next step is to have a wetland biologist produce a wetland delineation report for the property. The biologist will make a site specific determination for the appropriate buffer size—which may or may not be different from neighboring properties depending on a number of site specific considerations. As prospective buyers, usually the cost of a wetland delineation report is factored into the purchase price and the report completed once the property has changed hands. However, I have seen a couple of cases where a report is negotiated before sale. We were told by a neighbor that the wetland setback is 150 ft but we need to know if that is true, an actual # to work with. Please advise us on this point.
