CONDITIONS:
1 | The proposal requires a Building Permit and Flood Development Permit consistent with approvals in
BLD19-00506.
2.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and
sediment during constructlon. BMPs shall address measures to stiabilize soil exposed during construction, and
in the design and operation of stormwater and drainage control systems. Erosion control measures must be inplace prior to a..ny clearing or grading and prior to beginning any construc{ion, as sand, silt, clay, and soil areconsidered pollutants.

The proposal will be located in Discovery Bay, in an area that is mapped on the Federal Emergency
Management Agency Flood lnsurance Rate Map Panel No. 53031C01 10C as Zone AE & SFHA with High Flood
Risk. The proposed project is subject to the requirement for a flood development permit, which is incorporated
into this decision. The proposal meets the definition of development but not structure in the flood damage
prevention ordinance, as codified in JCC 15.15.050. The Administrator has determined that a Habitat
Assessment is not required.
6.) Base Flood Elevation:
The proposed p@ect will not result in any increase in flood levels during the occurrence of base flood
discharges-
7.) Flood hazard reduction measures are to be used as required by the Jefferson County Flood Damage Prevention
Ordinance 07-0515-06 (Jefferson County Code Chapter 15.15).
8.) Materials and Methods:
Construction Materials and Methods: (1) All new construction and substantial improvements shall be
constructed with materials and utility equipment resistant to flood damage; and (2) AII new construction and
substantial improvements shall be constructed using methods and practices that minimize flood damage.
All materials that may come in contrct with water shall be composed of nontoxic materials, such as wood,
concrete, approved plastic composites or steel, that will not adversely affect water quali$ or aquatic plants or
animals. Materials used for structural components shall be approved by applicable state agencies for contacl
with water to avoid discharge of pollutants from wave splash, rain, or runoff. Wood treated with creosote, copper
chromium arsenate or pentachlorophenol is prohibited in shoreline water bodies.
All lumber and other materials treated with preservative shall be sufficiently cured to minimize leaching into the
water or shore bed, in accordance with the Best Management Practices approved by the Washington
Department of Fish and Wildlife.
Fill materials placed within shoreline jurisdiction shall be from an approved sour@ and shall consist of clean
sand, gravel, soil, rock or similar material. The use of contaminated material or construction debrls shall be
prohibited.
The proposal shall retain existing vegetation. Any disturbance within the shoreline buffer shall be restored
immediately.
9.) The applicant shall ensure that wet concrete does not enter the marine environment as wet concrete has the
potenUal to negatively affect water quality and habitat conditions ln the event that wet concrete extends beyond
the footprint of the existing bulkhead, DCD (and other federal or state agencies) may require mitigation.
Protective measures include, but are not limited to, using a fast curing additive, beginning the work as the tide
goes out, ensuring the curing occurs during a low tide, using forms to prevent wet concrete from flowing beyond
the existing fooprint of the bulkhead, and implementing an appropriate spill prevention plan.
1O ) Driving or taking heavy equipment onto the beach is prohibited. All work shall occur ftom the upland side of the
Poect area.
11 ) The applicant shall comply with the lnadvertent Discovery Protocols, as presented in the attached lnadvertent
Discovery Plan attached to this permit. All contractors and personal shall be familiar with the inadvertent
discovery plan. lf any possibb historic, archaeological and/or cultural artifacts are inadvertently discovered, the
applicant shall immediately stop all work on the p@ect and shall notify the Washington State Department of
Archaeology and Historic Preservation (Stephanie Jolivette, 360-586-3088), Jefferson Coun$ Department of
Comm unity Development (360-3794450), and affected tribes.
12) Work within the jurisdiction of the Shoreline Master Program other than as described above shall receive
separate review from this Department.

Comprehensive Plan and Land Use map.
This approval is for a 60-foot bulkhead replacement, repair and maintenance only. Any future permits on this
site are subject to review for consistency with applicable codes and ordinances and does not preclude review
and conditions which may be placed on future permits.
The site plan as submitted with the Bulkhead Replacement, Repair and Maintenance building permit
BLD19-m506 application on November '12,2A19, has been reviewed for consistency under the UDC, and has
be91 apqrgved by Jefferson County Department of Community Devetopment. Any modifications, changes,
andlor additions to the stamped, approved site plan dated December 5, 2019, shall be resubmitted for review
and approval by Jefferson county Department of community Development.
SDP Exemption Approval-The Development Revierry Division finds that this proposal is consistent with
Shoreline Master Program Section 18.25.560(2) Maintenance and Repair, and is consequenly exempt from the
substantial development permit (SDP) req uirements.
Development reviewed under the exemption for maintenance and repair shall be essentially the same as theoriginal in location, size, configuration, and external appearanoe.
Exemptions from the substantial development permit requirements do not exempt a proposed development
from compliance with the applicable policies and standaids of the Shoreline Master erogram or other applicable
Federal, State, or local permit or license requirements.
The Geographic lnformation Systems mapping review identified the following CriticalAreas on the subject
property: Wetlands, Flood Zone AE, SFHA with High Flood Risk, Medium to High Liquefaction Area.
The project area is partially in a mapped Geologically Hazardous Area-High Hazard Landslide area which is
{e0icted primarily for the steep slopes above and behind Beckett Point. The project area is over 250 feet ftom
tltg loe of the slope, but the mapped hazard area extends to the shoreline. Piojdct proponents applied for aWaiver from GeotechnicalRe-port for_Geologically Hazardous Areas. The waiver wis ipproveO 6i tneAdministrator November 19,2019. Signed Release and Waiver indemnification documenb were received from
Marianne VanDiver and Elizabeth Lee.
Jefferson County determined that this proposal is categorically exempt from review under the State
Environmential Policy Act (SEPA) pursuant to WAC 197-11-800(3) Repair, remodeling and maintenance
activities. No work will be done below the Ordinary High Water Mark.
414-Day Review Letter was sent to DAHP on 1012212019 and no comments were received.
NOTICE: This permit does not excuse the proponent from complying with other local, stiate, and federal
ordinances, regulations, or statutes applicable to the proposed devebpment, but consistent with RCW 90.Sg.

chromium arsenate or pentachlorophenol is prohibited in shoreline water bodies.
All lumber and other materials treated with preservative shall be sufficiently cured to minimize leaching into the
water or shore bed, in accordance with the Best Management Practices approved by the Washington
Department of Fish and Wildlife.
Fill materials placed within shoreline jurisdiction shall be from an approved source and shall consist of clean
sand, gravel, soil, rock or similar material. The -Use of contaminated material or construction debris shall be
prohibited.
The proposal shall retain existing vegetation. Any disturbance within the shoreline buffer shall be restored
immediately.
9.) The applicant shall ensure that wet concrete does not enter the marine environment as wet concrete has the
potential to negatively affect water quality and habitat conditions. In the event that wet concrete extends beyond
the footprint of the existing bulkhead, DCD (and other federal or state agencies) may require mitigation.
Protective measures include, but are not limited to, using a fast curing additive, beginning the work as the tide
goes out, ensuring the curing occurs during a low tide, using forms to prevent wet concrete from flowing beyond
the existing footprint of the bulkhead, and implementing an appropriate spill prevention plan.
10.) Driving or taking heavy equipment onto the beach is prohibited. All work shall occur from the upland side of the
project area.
11.) The applicant shall comply with the Inadvertent Discovery Protocols, as presented in the attached Inadvertent
Discovery Plan attached to this permit. All contractors and personal shall be familiar with the inadvertent
discovery plan. If any possible historic, archaeological and/or cultural artifacts are inadvertently discovered, the
applicant shall immediately stop all work on the project and shall notify the Washington State Department of
Archaeology and Historic Preservation (Stephanie Jolivette, 360-586-3088), Jefferson County Department of
Community Development (360-379-4450), and affected tribes.
12.) Work within the jurisdiction of the Shoreline Master Program other than as described above shall receive
separate review from this Department.
FINDINGS:
1.) The Administrator finds that this application complies with applicable provisions of the Unified Development
Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County

2.) This approval is for a 60-foot bulkhead replacement, repair and maintenance only. Any future permits on this
site are subject to review for consistency with applicable codes and ordinances and does not preclude review
and conditions which may be placed on future permits.
3.) The site plan as submitted with the Bulkhead Replacement, Repair and Maintenance building permit
BLD19-00506 application on November 12, 2019, has been reviewed for consistency under the UDC, and has
been approved by Jefferson County Department of Community Development. Any modifications, changes,
and/or additions to the stamped, approved site plan dated December 5, 2019, shall be resubmitted for review
and approval by Jefferson County Department of Community Development.
4.) SDP Exemption Approval --The Development Review Division finds that this proposal is consistent with
Shoreline Master Program Section 18.25.560(2) Maintenance and Repair, and is consequently exempt from the
substantial development permit (SDP) requirements.
Development reviewed under the exemption for maintenance and repair shall be essentially the same as the
original in location, size, configuration, and external appearance.
Exemptions from the substantial development permit requirements do not exempt a proposed development
from compliance with the applicable policies and standards of the Shoreline Master Program or other applicable
Federal, State, or local permit or license requirements.
5.) The Geographic Information Systems mapping review identified the following Critical Areas on the subject
property: Wetlands, Flood Zone AE, SFHA with High Flood Risk, Medium to High Liquefaction Area.
6.) The project area is partially in a mapped Geologically Hazardous Area --High Hazard Landslide area which is
depicted primarily for the steep slopes above and behind Beckett Point. The project area is over 250 feet from
the toe of the slope, but the mapped hazard area extends to the shoreline. Project proponents applied for a
Waiver from Geotechnical Report for Geologically Hazardous Areas. The waiver was approved by the
Administrator November 19, 2019. Signed Release and Waiver indemnification documents were received from
Marianne VanDiver and Elizabeth Lee.
7.) Jefferson County determined that this proposal is categorically exempt from review under the State
Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(3) Repair, remodeling and maintenance
activities. No work will be done below the Ordinary High Water Mark.
8.) A 14-Day Review Letter was sent to DAHP on 10/22/2019 and no comments were received.
9.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal
ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58.
Development pursuant to this permit shall be undertaken subject to the applicable policies and performance
standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified
Development Code.
