SUBJECT: Discussion of Community Development's FY2021-2022 Long-Range Work
Program and Potential Action Directing Community Development to
Initiate Unified Development Code Updates
STATEMENT OF ISSUE:
The Department of Community Development ("DCD") seeks input from the Board of County
Commissioners ("BoCC")regarding its proposed Fiscal Year ("FY") 2021-2022 Long-Range
Work Program. The FY21-22 Long-Range Work Program will direct DCD's long-range
planning and code development work on: (1) affordable housing/community development; (2)
regulatory reform; (3) state mandated periodic review and updates; and(4)the existing docket.
Based upon the input from the BoCC, DCD seeks to initiate Unified Development Code
("UDC") revisions to implement portions of DCD's FY21-22 Long-Range Work Plan.
ANALYSIS:
DCD seeks input on its proposed FY21-22 Long-Range Work Program ("Work Program").
The Work Program will direct DCD's long-range work products for the fiscal year and direct
DCD and the Jefferson County Planning Commission's work.
DCD proposes a comprehensive and balanced Work Program which addresses long-range
planning and code development work on: (1) affordable housing/community development; (2)
regulatory reform; (3) state mandated periodic review and updates; and (4)the existing docket.
The Work Program includes items that are on-going, items that the BoCC has already directed
DCD to initiate work on, and items that DCD recommends. Below is an overview of the
proposed Work Program:

Affordable Housing/Community Development
• Port Hadlock/Irondale Urban Growth Area Sub-Area Plan
o Project Overview: Sub-area plan analyzing current and future conditions of the
Port Hadlock/Irondale Urban Growth Area with a focus on aligning
development regulations (zoning) with implementation of the Port Hadlock
sewer project.
o Timeline: Summer 2021 - Project scoping, kickoff, initial research/data
collection, and draft public participation plan. Fall/Winter 2021 —Development
of pre-draft sub-area plan and public outreach. February 2022—Draft sub-area
plan.
• Recommendation that the draft sub-area plan, including implementing
actions be included in the 2022 Docket.
• Affordable Housing Study and Implementation Strategies
o Project Overview: Holistic study analyzing potential DCD strategies and
implantation actions to address affordable housing in the County. The study
will analyze: (1) regulatory revisions (e.g., UDC revisions); (2) policy changes
(e.g., code interpretations or building policies); (3) incentive programs; and, (4)
voluntary/innovative programs (e.g., offering pre-reviewed building plans, pilot
projects). Study will create an implementation plan with strategies based upon
efficacy and cost/time effectiveness.
o Timeline: Summer 2021 —Project scoping, kickoff, initial research/data
collection, and draft public participation plan. Fall/Winter 2021 —Development
of pre-draft affordable housing study and implementation plan, and public
participation. February 2022—Draft study.
• Recommendation that implementation strategies from the study are
selected for inclusion on the 2022 Docket.
• Transient Housing Code Revisions (Jefferson County Code 18.20.210)
o Project Overview: Code revisions to align Jefferson County's transient rental
regulations with current practices (e.g., Airbnb, VRBO, and Hipcamp). The
County's transient rental regulations lack modern standards, such as building
requirements, and do not address the variety of current and future regulatory
situations, such as camping. The code revisions will also analyze whether or not
the County should limit future transient rentals.
o Timeline: Summer 2021 —Project scoping, kickoff, initial research/data
collection, and draft public participation plan. Fall/Winter 2021 —Development
of pre-draft development regulations and public participation. Spring 2022—
draft development regulations.

• Development Regulations for Temporary Homeless Facilities*
o Project Overview: Ordinance for the siting, establishment, and operation of
temporary homeless facilities. RCW 36.01.290 authorizes counties to adopt
development regulations allowing temporary homeless facilities on properties
owned or controlled by religious or nonprofit organizations. Currently, the
County has adopted an interim ordinance which expires on December 22, 2022.
o Timeline: Summer 2021 —BoCC update, SEPA, and Public Review and
Planning Commission Review. Fall/Winter 2021 BoCC adoption.
Regulatory Reform
• Legal Lot of Record Code Revisions (Chapter 18.35 Jefferson County Code)
o Project Overview: Code revisions addressing a regulatory gap in the UDC
relating to nonconforming lots. The UDC's definition and treatment of"legal
lots of record" is ambiguous. County Departments, including DCD,
Environmental Public Health, and the Assessor's Office have struggled with
how to determine if a lot is "legally created" and/or which parcels are non-
conforming legal lots of records. This code revision would provide clear
standards on which substandard lots are recognized as legal nonconforming
lots.
o Timeline: Summer 2021 —Project scoping, kickoff, initial research/data
collection. Fall/Winter 2021 —Development of pre-draft development
regulations. Spring 2022 —draft development regulations.
State Mandated Periodic Review and Updates
• Shoreline Master Program (SMP) Periodic Review and Update* (Chapter 18.22
Jefferson County Code)
o Project Overview: SMP periodic review and update (code revisions) ensuring
that the SMP is consistent with the Shoreline Management Act ("SMA"), SMA
administrative rules, the County's Critical Areas Ordinance, and the
Comprehensive Plan/County Code. The periodic review and update also
analyzes changed circumstances, new information, new guidelines, and
improved data.
o Timeline: Planning Commission review and recommendation June—July 2021
—BoCC review and final adoption August— September 2021.

Existing Docket (2021)
• Mineral Resource Land Overlay Designation (MLA2021-00019)*
o Project Overview: Designation of site-specific mineral resource land overlay
(MRLO) to add 199 acres to an existing MRLO in the CF80 Commercial Forest
zone.
o Timeline: Summer 2021 —Staff analysis, report and recommendation—Fall
2021 Planning Commission review and recommendation—Fall/Winter 2021
BoCC review and final action.
• Green Burials Suggested Text Amendment(MLA2021-00018)*
o Project Overview: Suggested code amendment to development standards
allowing alternative green burials for cemeteries in the Forest Resource zones
with a conditional use permit.
o Timeline: Summer 2021 — Staff analysis, report and recommendation—Fall
2021 Planning Commission review and recommendation—Fall/Winter 2021
BoCC review and final action.
* Denotes that the BoCC has already directed DCD to work on this item.
It is important to note that DCD has limited resources dedicated to long-range planning.
During FY21-22, it is estimated that 2 FTEs will be assigned to complete the proposed Work
Program. DCD proposes that the Work Program items be completed in-house. However,
consultant support may be required for certain items or portions of those items if
circumstances change.
Direction for DCD to Initiate Code Revisions
Pursuant to Jefferson County Code ("JCC") 18.45.090(1)(a), the BoCC must direct DCD to
initiate code revisions. The Work Program includes two items which require code revisions:
(1) "Transient Housing Code Revisions"; and (2) "Legal Lot of Record Code Revisions". If
the BoCC agrees that DCD should begin work on these items, the BoCC should direct DCD to
initiate work on these items.
The BoCC has already directed DCD to work on certain items, such as "Development
Regulations for Temporary Homeless Facilities" and the "Existing Docket". Additionally,
Work Program studies, such as the proposed"Port Hadlock/Irondale Urban Growth Area
Sub-Area Plan" and"Affordable Housing Study and Implementation Strategies" do not require
BoCC direction prior to DCD work initiation. However, DCD seeks input and concurrence
from the BoCC on these studies prior to dedicating DCD's limited resources to these Work
Program items.

FISCAL IMPACT:
Cost of work associated with the County's Comprehensive Plan and related activities under the
Growth Management Act are largely supported by the County's general fund. It is estimated
that the proposed FY21-22 Work Program will cost at least $200,000 in already budgeted
general fund dollars to support personnel and project costs. If consultant support is required,
additional budget authority will be requested. The site-specific amendment is supported by
application fees.
RECOMMENDATION:
Review the DCD proposed FY21-22 Long-Range Work Program, provide comments and
direction on the proposed FY21-22 Work Program, and consider a motion directing DCD to
initiate the code revisions for the "Transient Housing Code Revisions" and "Legal Lot of
Record Code Revisions" Work Program items.
