2. Building Permit Application. Tiie Owner(s) have applied or will apply for a building permit
through the Jefferson County Departrnent of Community Developrnent ("the County") to rnake
certain improvernents upon the above-described property.
3. Purpose. ForpurposesofcomplyingwiththeCounty'sbuilclingandlandusecodesancl
ordiuatlces, the Owner(s) desire to treat ail of the above-described property as one br-rildi,g tract,
and in particular,.desircs to do so for the purpose of constructing a
single family residence as requirecl by county code.
4. Assurance to County. The Owuer(s) desire to assllre the County tirat the property described
above shall be and reurain as one building tract for plrlposes of improvements to be constructecl

NOW, THEREFORE, in consideration of the benefits derived by this Restrictive
Covenant, the Owner(s) declare, covenant and agree as follows:

B. CO\/ENANT
1. Specific Restriction and Covenant. Tlie property described above, sha1l constitute a single
building site, and uo lot or lots or any part tliereof shall be transferred or conveyed in any ulanner

provisions on a reduced site. This restrictive covenant shall not be retnoved unless such an
action is approvcd by the Cor.rnty,
2. Covenant Running lvith the Land. Tliis restrictive covenant aflects and restricts the
dcscribed property and shall be construed as a covcnant running with and touching and
conceming the land and inuring to the benefit of the Owner(s), the public generally, arrd the
County.
3. Binding upon Successors and Assigns. This restrictive covenant shall bincl ald restrict the
land, tlie Owner(s), their heirs, grantees, successors ancl assigus.
4. Recording. Upon its executiou, this Declaration shall be recordecl u,ith the Jefferson Coulty
Auditor. A11 contracts and deeds or other instruments of conveyance relating to the property or
any part thereofshal1 contain reference to this covenant.
5. Enforcement. In addition to any other party having a legal right to enforce this covenant, the
County shall have the right to enfbrce and compel compliance with this covenant, including all
reuredies available at law and equity. The County shall have the right in auy such proceeding to
recover its attorney fees and costs.
6. Compliance with Code Requirements. This Declaration cloes not amend or rnodify, nor is it
intended to amend or modify any requirements of the County's orclinances or any other law or
regulatiotl dealing witli or affecting the use of lancl or constrliction of irlprovemellts Llpon lalcls.
7. Estoppel. The Owuers by this Declaration specifically estop themselves and all ol'their
successors aud assigns and all persons presently or hereafter l-raving any interest in the property
from assefiing or contending in any lrallner that this restrictive covenant is not a full and
adequate covenant running with the land and binding upon the property.
8. Severance. Invalidation of this covenant by judgment or conrl order shall not afl.ect any of the
other covenauts which shall remain in full force and effect.
9. Warranty of Authority. The Owner(s) signing below warrant that they are the sole Owners
in fee of the realproperty described above and are authorized to make tiris Declaration and so
brnd the property,
10. Governing Larv. This RESTRICTIVE COVENANT shall be governed by the laws of the
State of Washington.
11. Disclaimer. Since l1o surveywas submitted as part of your Restrictive Covenant, the County
accepts no liabiltty for what facts a survey mrght liave revealed. A slrrvey might irave revealed
that a sttuctllre or improvement believcd to be on the grantor's property is, in fact, located wholly
or partially upon sol11eone else's property or upon property that is not the subject of this
application. But, iu the absence of a survey, the GRANTOR be ars sole responsibility if such a
problern arises.
