Rodgers County Administrator: David Goldsmith Clerk of the Board: Lorna Delaney MINUTES Week of February 17, 2004 Commissioner Dan Titterness called the meeting to order. Commissioner Patrick Rodgers was present. Chairman Glen Huntingford was absent. APPROVAL OF MINUTES: Commissioner Rodgers moved to approve the minutes of February 9,2004 as presented. Commissioner Titterness seconded the motion which carried. The Board met in Executive Session with the County Administrator and Treasurer regarding real estate negotiations fYom 8:15 a.m. to 8:29 a.m. From 8:30 a.m. to 8:59 a.m., they met in Executive Session with the Deputy Prosecutor and County Administrator regarding potential litigation. COUNTY ADMINISTRATOR'S BRIEFING: County Administrator David Goldsmith reported on the following: · The State Legislature is working on a bill that will redefine where sales tax is collected. Eighteen states are involved in a "sourcing study" to set protocols for the definition of sales tax. Currently, if a person buys an item that is delivered from a store's warehouse in another jurisdiction, the jurisdiction where the warehouse is located gets the sales tax. If this bill passes, the sales tax would go to the jurisdiction indicated by purchaser's zip code. Some jurisdictions will lose a large portion of their sales tax revenue and the Legislature is looking at options to mitigate the loss. This could mean an extra $150,000 in sales tax redistribution revenue for Jefferson County. · The Department of Community Development will be advertising for two positions on the Planning Commission because two of the Planning Commissioner's terms expire soon. · The contract for the Courthouse front door project is moving forward. At this point, it appears that the work on the project will be scheduled for July or August. · The contracts for the Courthouse infrastructure project are also moving forward. When they are put out to bid, the County will know whether the State's proposed Courthouse Renovation Fund will be a funding resource. Page 1 Commissioners Meeting Minutes: Week of February 17, 2004 ;IJ"'" ''\ ,.~" 1'\-1// "";~" · WSAC proposed an amendment to the law regarding water rights that would clarify the Department of Ecology's responsibility regarding one party wells. The DOE didn't like the original language and proposed new language that defeated the purpose of the amendment. Commissioner Titterness added that he feels the DOE doesn't want to deal with this issue because they can't afford it. · When the Sheriffs Annex project went out to bid, $30,000 was set aside to furnish the new building. The definition of "furniture" included the track shelving system for the evidence room and lockers which costs $23,000. Most of the track system isn't necessary right now, but it is anticipated that it will be needed in the future. The Sheriff wants the furniture budget increased because most oftheir current furniture isn't serviceable or can't be moved. A compromise has been negotiated. Commissioner Rodgers said that he is concerned that more money is needed at this late date to finish the project. David Goldsmith replied that when the project costs were cut back to meet the budget, the $30,000 was put in without knowing that the track shelving system was considered furniture. · Originally, the Conservation Futures Fund was being considered as a funding source for the wetland acquisition in Irondale. On further review, it was decided that the funding is better qualified under the Title III Forest Fund program. Natural Resources staff is developing a proposal. · At the workshop last week with the Department of Community Development regarding the permitting process, there was a discussion on "clock stoppers." DCD staff compiled a spreadsheet using data from 2003. The largest number of slow downs came from stormwater review. The reason for this could be that more details were added to the stormwater review process last year. · Representatives rrom several Departments will attend a meeting this week to discuss how to deal with junk vehicles. Ordinances from other jurisdictions will be reviewed. Some funding may be required to set up a program. PUBLIC COMMENT PERIOD: The following comments were made: a compliment to the Board for working together and concentrating on the issues; although the golf course/performing arts center controversy is the City's issue, if the County owns property near the golf course, it could be rented or leased for the performing arts center; when the publisher of The Leader made his 2004 predictions, they included a prediction that the City of Port Townsend would purchase 40 acres of property outside the city limits for a municipal golf course and the current golf course be turned into a college campus, small business incubator, and a performing arts center, but none of the elected officials say they knew anything about this; the golf course has been in the same location for 77 years and it has a history; the Board was encouraged to attend the City's meeting on the golf course/performing arts issue; and in 2003, the arts people never contacted Fort Worden, the schools, or The Rose Theater to find out about renting space for performances. APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Rodgers moved to approve the Consent Agenda as presented. Commissioner Titterness seconded the motion which carried. 1. AGREEMENT re: Repair of Fire Damage at the Solid Waste Transfer Station Facility; Jefferson County Public Works; Fischer General Contracting 4. AGREEMENT re: Professional Outreach Coordinator Services; Jefferson County Sheriffs Office, Department of Emergency Management; Daphne Kilburn 5. AGREEMENT NO. E04-131 re: Federal Emergency Management Agency (FEMA) Performance Grant Funding for Emergency Management Programs; Jefferson County Sheriffs Office, Department of Emergency Management; Washington State Military Department At 10:05 a.m. the Board interviewed Bob Wheeler who has expressed an interest in serving on the Jefferson County Developmental Disabilities Board. From 10: 15 a.m. to 10:45 a.m., the Board met with the Department of Community Development staff for a workshop regarding the Brinnon Subarea Plan. The Board met in Executive Session with the County Administrator, Deputy Prosecuting Attorney, Director of Community Development, Associate Planner, and Natural Resources Manager regarding actual litigation from 10:45 a.m. to 11: 14 a.m. From 11: 15 a.m. to 11 :30 a.m. they met in Executive Session with the Deputy Prosecutor, County Administrator, Director of Community Development, and Associate Planner regarding potential litigation. The meeting was recessed at the close of business on Tuesday and reconvened on Wednesday at 9:30 a.m. All 3 Commissioners were present. The Board interviewed Cathy Barsukoffwho has expressed an interest in serving on the Jefferson County Tourism Coordinating Council. Advisory Board Appointment; Developmental Disabilities Advisory Board: Commissioner Titterness moved to appoint Bob Wheeler to serve a 3 year term on the Developmental Disabilities Advisory Board. Commissioner Rodgers seconded the motion which carried by a unanimous vote. His term will expire February 9,2007.
