Monitoringisrequiredtobeperformedby a personauthorizedbythePublicHealthDepartment,and WHEREAS,theOwnerisrequiredbyJeffersonCountyPublicHealthDepartment,asperWAC 246-272Athrough JeffersonCountyCode8.15toimplementaprogramforperiodicmonitoringtoassurethecontinuousandsatisfactory operationandmaintenanceofthesewagesystem,and NOW THEREFORE,inconsiderationofthepremisesandthemutualpromisesandcovenantshereaftersetforth,the partiesheretoagreeasfollows: 1.Construction: a.The Owner hasconstructedand installedasewagecollection,treatmentand disposalsystemtogether withappurtenantfacilitieswhose capacityanddesignaresatisfactorytotheJeffersonCountyPublicHealth Department. b.The plansandspecificationsforthisconstructionhavebeenapprovedby theJeffersonCountyPublic HealthDepartmentpriortoconstruction. c.The sewagesystemwas installedand designedtoreceiveand treatsewagewithstrengthtypicalofa residentialsource. 2.Owners responsibilities: a.Maintainallcomponentsasaccessibleandunobstructedtothesurfaceincludingsafeaccesstothe componentsfromtheroadorright-of-way.Non-accessibleorobstructedcomponentswillnotbe serviced andmay resultina violationofpermitrequirements. Page 1 of2 b.Maintainallaccessrisersina securemannertominimizeinjuryorunauthorizedaccess. c.Utilizethesystemconsistentwithproducingresidentialwastestrengtheffluent. d.OperateandmaintainthesysteminaccordancewithconditionsofthepermitandJeffersonCountyCode 8.15. 3.Attachment:Ifbox checkedthissepticsystemcontainsaproprietarydevicethatrequires Attachment#1 titled"NoticeforMaintenanceand Monitoringofa ProprietaryOnsiteSewage SystemDevice be recordedwiththisdocument. 4.Schedule:The Owner shallhavetheirsewagesysteminspectedby a personauthorizedby Jefferson CountyPublicHealthinaccordancewiththeschedulesetforthinJeffersonCountyCode asadoptedand hereinafteramended.Forsome proprietaryproductsregisteredwiththeStateDepartmentofHealth,the inspectormustalsobe authorizedby thedevicemanufacturer. 5.Reminder:The JeffersonCountyPublicHealthDepartmentshallprovidea reminderofrequired monitoring.The lackofreceiptofsaidreminderdoesnotrelievethepropertyownerfromcompliancewith themonitoringschedulepursuanttoJeffersonCountyCode. 6.Records:A reportofeachinspectionconductedshallbe submittedtotheJeffersonCountyPublicHealth Departmentwithin30 daysofcompletionoftheinspection.Suchrecordsshallbe opentotheinspectionof theOwner. 7.Hold Harmless:The GrantorshallholdGrantee,itsagencies,divisions,officers,agents,and employees harmlessand indemnifythem againstany liability,damages,judgments,claimsorotherexpenses,including attorney'sfees,thatmightariseasa resultofthenegligentactsand omissionoftheGrantor. 8.Fees:A feeassetforthintheJeffersonCountyFee scheduleand adoptedby theBoardofCounty Commissionersshallbe paidupon submittalofeachinspectionreport. 9.Terms:Thisagreementshallremaininfullforceand effectuntilthedateofnotificationtotheOwner by theJeffersonCountyPublicHealthDepartmentthattheOwner'sSewerSystemhasbeeninterceptedand connectedtoa generalsewersystem. 10.Amendments:Thisagreementshallnotbe modifiedexceptwiththeexpresswrittenapprovalofthe EnvironmentalHealthDepartmentofJeffersonCounty.
