I have also copied David Wayne Johnson (Jefferson County), as the County is the SEPA Lead Agency for the Pleasant Harbor Marina and Golf Resort Supplemental EIS (SEIS). I will forward this message to Garth Mann, Statesman Corporation (project applicant). I described to Mr. Tweit that several MOUs are required of the Resort by Board of County Commissioners conditions specified in Jefferson County Ordinance No. 01-0128-08. While a MOU is not specifically required for adaptive management of tunicates within Pleasant Harbor, BoCC Condition 63.t does require the Resort to address this issue "in participation with the County and State agencies." You have drafted an agreement in a manner comparable to other MOUs being prepared between the Resort and public service providers. The draft MOU for adaptive management of tunicates was submitted to Larry Leclair (WDFW) in October 2010. Bill is going to check his file to confirm that he has this. If not, he will contact you to send him the file. I described to Bill that the provisions of draft MOUs will be listed in Mitigation Measures sections of the SEIS (under respective elements of the environment), and that the full text of the draft MOUs will be reproduced as an appendix to the 0EIS. As such, the draft provisions will be available for public review and comment. Bill believes that this process will atisfy WDFW's need for SEPA compliance before entering into an agreement. He asked whether the conditions of the OU would be "locked in" at the stage of publication with the Draft SEIS. I replied that the draft MOUs would be subject to change by virtue of the opportunity for public and agency comment during the DSEIS comment period, they will not be final until both parties are ready to execute the MOU following completion of the environmental review process, at the stage when Statesman and the County are ready to enter into the Development Agreement. This timing all sounded workable to him. In the interest of juggling priorities, Bill indicated that he would work to complete the provisions of the draft MOU on adaptive management measures for tunicates by the July -August timeframe this year. David: Please advise if you, on behalf of Jefferson County, have any different input to this issue. I am writing to summarize our conversation, and outline some next steps. Your interest in and support for efforts to control and manage the presence of invasive tunicates in Pleasant Harbor is greatly appreciated. To further our collective efforts, WDFW is willing to consider an MOU that would outline future steps in invasive tunicate management, and our expectations for our respective roles in that effort. I'll do some internal reconnaissance on our authority to enter into such an MOU, as well as the considerations that we would want to include in a potential MOU. A potential MOU would be directed primarily at control and management activities, including the marina's commitment to participate in and support those activities, and could specifically address hull inspection and cleaning objectives. You indicated that you would check with your consultant on SEPA matters, and determine whether a potential MOU could be included in the EIS for this project. This might be of benefit, if the SEPA process could cover two alternatives: whether or not to commit to an MOU, and provide notice to the public regarding the potential terms and conditions of an MOU. I also appreciated your offer of providing an overview of the planned development, and the opportunity to explore in more depth what the implications of being a "green" marina are. 1 will make sure agency staff are aware of this •pportunity.
