Re: Pleasant Harbor Marina and Golf Resort Shoreline Setbacks
Dear Todd,
Pursuant to our phone conversation of today, I will explain why the Pleasant Harbor Master
Planned Resort (PHMPR) must comply with the 150 foot marine shoreline setback proposed
under the new Shoreline Master Program (SMP) as I understand it.
When the original Supplemental Environmental Impact Statement (SEIS) alternatives were
drafted last year, two of which included four story marina waterfront development within 150
feet of the Ordinary High Water Mark (OHWM), it was unclear whether the SEIS could be
finished and the development agreement approved before Ecology approval and final adoption of
the new SMP, meaning that the proposed marina development could have been vested under the
current SMP. It was also believed that those alternatives could be used as comparisons to the
preferred alternative, however, SEPA makes clear under WAC 197-11-440(5) that the
alternatives have to be "feasible," that is, buildable under the applicable code. It is now clear and
agreed upon by the applicant and County that the new Locally Adopted SMP will be the
applicable shoreline development regulations for any new resort development and therefore,
makes what was proposed under those alternatives "unbuildable." New alternatives are currently
being drafted by the applicant to address the reality of the resort being constructed under the new
SMP.
To summarize:
• Final draft SEIS alternatives have not yet been completed
Those alternatives will not include new development within 150 feet of OHWM that are
under the new SMP
