Dear Garth,
As you know, Jefferson County DCD chose to author the SEIS for the Pleasant Harbor Marina and Golf Resort
project per our letter to you of April 20, 2011. Also, you may recall that Al Scalf retired and we have acquired a
new Director, Carl Smith as of May I". Assessing our workloads and priorities for the remainder of the year, it is
apparent that we will not be in a position to continue the authorship of the SEIS "in-house" as agreed.
As such, we propose the alternative of hiring an outside consultant as described under WAC 197-11-420(2) which
states, "the lead agency may have an EIS prepared by agency staff, an applicant or its agent, or by an outside
consultant retained by either an applicant or the lead agency." To proceed with that, we will advertise a "Request
for Proposals" for outside EIS consultants within the next few weeks.
The consultant, when chosen, will report directly to County staff, work closely with the Peer Review Team, Craig
Peck, the Technical Team, and bill the County for their time. The County in tum will invoice you on a monthly
basis, similar to the billing for the Peer Review Team. In an effort to maintain good relations, a level of comfort,
and control costs, we will keep you informed on consultant proposals we receive and solicit your input as to the
final selection of the consultant.

Based upon the attached letter sent to us by Vicki Morris, there is currently no County approved author
of the Pleasant Harbor MPR SEIS. SEPA rules, Washington States Administrative Code for environmental
review makes clear under WAC 197-11-420(1) & (2) that, "...it is the EIS of the lead agency...The lead
agency may have an EIS prepared by agency staff, an applicant or its agent, or by an outside consultant
retained by either an applicant or the lead agency." As such, DCD has determined the best course of
action at this point is to assume authorship of the SEIS, and produce the drafts and final "in-house" draft
SEIS with the assistance of Craig Peck, the Technical Team and the Peer Review Team.
In order to proceed toward a preliminary draft SEIS, DCD Staff require the following items:
• Final Technical Reports including impact analysis, alternative analysis and mitigation
• The still outstanding energy proposal
• Direct communication with the Technical Team
• Craig Peck as Technical Team Coordinator
• Additional information as required
A key component to the success of the SEIS in terms of legal sustainability is the clear and definitive
separation of the applicant from the drafting for technical information and subsequent SEIS. Since it is
considered a certainty that the SEIS will be legally challenged, any evidence that the applicant has
influenced the information contained within would likely lead to an unfavorable decision on appeal. In
order to achieve an SEIS that will withstand an appeal it must be thorough; covering every possible
aspect of environmental impact, and it must be objective and uninfluenced by any party's desired
outcome. What this means in terms of you as the applicant, is that you must not influence or be

involved in directing the content of the technical reports or the conclusions they reach. We understand
the necessity of overseeing your project in financial terms; however, it is essential that the Technical
Team be unencumbered by restrictions on content simply to constrain costs. They must be free to
produce the best, most thorough work possible if the SE►S is to withstand scrutiny.
Finally, DCD staff will bill you for the time spent preparing the SEIS. As you know, we charge an hourly
rate of $71. This is well below the standard fee in the private sector and should result in some saving to
you.

I regret to inform you that I resigned from the Pleasant Harbor SEIS project effective March 28, 2011.
I confirmed with David Johnson on March 29 that he has the February 1, 2011 files that provide the
structure and baseline information for the SEIS comparison of alternatives and formulation of mitigation
measures. Please let me know if there is anything else you need.
It has been a pleasure working with you over the past two years. I hope there will be another opportunity.
