"Surface Water, Hydrologic Setting" Regarding mention in first sentence of "five unnamed
streams." There are a variety of references to three or five streams. I believe two of the
"streams" originate in springs west of U.S. Hwy l0l. The other three are well defrned water
courses that on the Pleasant Harbor site originate at U.S. Hwy l0l culverts and have carved the
defined channels, but have no independent source other than stormwater. I am not suggesting a
change in conditions, only a clarification that the channels owe their existence to t(o)stormwater if that is in fact the case.

Development Agreement between the Applicant and the County." I am not sure this
should be in the Development Agreement. At the time of the preliminary plat approval
one of the conditions of approval could be required employee housing for that section as
issues of number of employees and affordability will change over the duration of the
development.
(Garth you necd to weigh in on this one.) If you want to have an overall term
on this point in the Development Agreement, we Grn add such a provision,
but it will need to deal with affordability over time. The alternetive is simply
to have satisfaction of the condition at the time of building permit approval

I also understand that Garth has elected to go with the second construction alternative as the
preferred alternative. If that is true, I believe it would be appropriate for the public and agencies
to comment on the second option as the preferred alternative-particularly since some of the
reports only focused on the second alternative.
I did not see any detailed discussion of the zoning ordinance and as it implements the
comprehensive plan and enables the project-specific elements discussed, I do not see the need for
a detailed discussion, but I think you should have a section on compliance.
As I believe you are aware, JT Cooke is no longer with our firm. To make sure I have the
correct copies, please forward to me copies of the draft Zoning Ordinance and Development
Agreement drafts you are working with. I willtry and update the Development Agreement to
coincide with present plans in time to include both with the SElS-recognizing that both could
be changed through the review process.
, I have just begun my review of the document and will have comments in the
emphasis is completing revisions to civilsite design for the marina to accompany the Bistro building permit

Thanks for the time yesterday. To confirm my understanding of where we are on the water quality
agreement now
o Three sample locations, one at the north end, one at the south end and one near the middle within
our DNR lease, area are acceptable.
o We need to establish a baseline, Michael can help us with this from data he has access to from
previous State and County monitoring.
o We need to start monitoring prior to start of construction adjacent to a drainage basin that feeds
into Pleasant Harbor.
o We need to define an understanding of responsibility if a water sample fails, who is responsible to
determine source and assign responsibility.
o We will need to work with a lab or consultant qualified to help us define procedures and quality
assurance to finish the agreement prior to testing.

Water Ouality Monitorine Plan
Jefferson County Board of County Commissioners Ordinance No. 0l-0128-08 (63-r) requires the
Pleasant Harbor Master Planned Resort to prepare and implement a Water Quality Monitoring
Plan.
"A County-based comprehensive water quality monitoring plan specific to Pleasant Harbor
requiring at least monthly water collection and testing will be developed and approved in concert
with an adaptive management progftrm prior to any site-specific action, utilizing the best available
science and appropriate state agencies. The monitoring plan shall be funded by a yearly reserve,
paid for by Statesman that will include regular offsite sampling of pollution, discharge, and/or
contaminant loading, in addition to any onsite monitoring program"
Consideration should be taken for the following impacts on the water quality in Pleasant Harbor
1. Private Development
a. 20 different people or agencies own the property surrounding Pleasant Harbor,
including WDFW and State Parks.
b. There are two marinas, Pleasant Harbor Marina and Home Port Marina.
c. There is a State Park public dock and a WDFW boat launch
d. There are at least 6 private docks.
e. There are at least l0 private residence structures visible from the water, including
one house owned by Pleasant Harbor Marina.
f. As of fall 20 I 0 there is ongoing construction on at least one building site on the
southeastern bluffof the harbor.
g. Vessels are sometimes anchored unattended for weeks or months in the harbor.
2. State Property
a. The new WDFW public boat launch sees increased use each year, including
extensive commercial use by Tribal fisheries.
b. With the improvements at the parking area and access to the State Park dock near
the entrance ofthe harbor, the dock attracts more visitors.
3. Pleasant Harbor Marina currently:
a. Offers the only pump out service and fuel for visiting boaters in Central Hood
Canal.
b. Enforces strict rules regarding pump out, fueling, boat maintenance and storage
within the marina property.
c. Is recognized as a Washington Clean Marina and has achieved the EnviroStar
Clean Marina certification.
4. Pleasant Harbor Marina (and Golf Resort): Proposed Improvements and Expansion
a. The proposed Master Planned Resort development will not increase the number of
moorage slips.
b. Fuel dock and fuel systems have been replaced and improved to meet strict
environmental requirements.
c. The Marine Sewage Pump Out system has been replaced and improved to offer
more pump out stations and more reliable equipment to the public.
d. Pleasant Harbor Marina strictly enforces Best Management Practices (BMP's)
including a no discharge policy concerning black water, contaminated bilge water,
fuel, oil or any other chemicals hazardous to the environment.

reinforcing the BMP's of the Marina.
f. The Resort Development will follow strict environmental standards during and
after construction.
In the context ofthe affected environment described above, the Pleasant Harbor Marina and Golf
Resort proposes to participate in a program to monitor the impact ofdevelopments, both private
and public, to the water quality of Pleasant Harbor.
Performance Standards
Performance standards will meet Washinglon State Ecology requirements per WAC 173-
201A. WAC 173-201A-600 (l )(a)(iv) designates all fresh waters that are tributaries to
extraordinary quality marine water, which Hood Canal is so designated, as core summer
salmonid habitat for aquatic life uses. @Iethodolog and Quality Assurance guidelineslwill be

Water Quality Monitoring Plan
Schedule
The Resort proposes to coordinate with Jefferson County Water Quality Department, Washington
State Department of Health, the Hood Canal Salmon Enhancement Group and the University of
Washington to verifo acceptable ltandards fur Pleasan! _!arbg1, Ttp qyelql! 9ly!loqrrlg!!!q! tr94!!h
of Hood Canal can fluctuate greatly from year to year and season to season depending on a
number of factors including rainfall, temperature, wind, influx of ocean water, sfatification and
currents. Water quality can be dramatically different from southem Hood Canal near Belfair,
Hoodsport, Hamma Hamma, Dabob Bay and Seabeck. The samples taken in Pleasant Harbor
should be compared with samples taken in the central part of Hood Canal considering the overall
environmental situation at the time the samples are taken. Historical ls44p!gs and {luctuations
should be compared with Jefferson County Water Quality data to help u""urately erituate any
changes in sample data from test to test.
Jefferson County Water Quality Department will receive quarterly reports and will be notified
immediately of any unacceptable results. In the event that lunacceptable tte ! re qults arg fouqd,4!
property owrers surrounding Pleasant Harbor shall be considered partners and act to identify as
closely as possible the source and cause. Additional sampling may be needed to identify the
source, expense for additional sampling will be the responsibility ofthe property owner ofthe
suspected source.
Adaptive Management
This water quality monitoring plan may be modified based on an analysis of results, comparison
of existing data sources and consultation with Jefferson County. Altemative management
decisions will be addressed as more project details develop and as results are analyzed. The
monitoring plan may be revised over time so that it remains effective and reflects industry
standards. Examples of revisions that may be addressed include

It has been a challenge to move forward with the transit MOU.
I understand Garth had met with Transit previously, then Craig Peck worked with Leigh Kennel to address their
concerns in the 2010. In January 2011 we learned Ms Kennel was no longer with Transit. On January 24201I
Craig Peck and I met with Peggy Hanson and Sarah Crouch, resulting in what we thought was
agreement. March 28 I learned Peggy and Sarah had resigned and no one at Transit had knowledge of our
meeting. I met with Dan DiGuilio and Tammi Rubert Wednesday 4127lll to explain the project to Transit
again, and the need for a transit MOU. Mr. DiGuillo sent me the below e-mail after the meeting.
Attached is the MOU draft that was given to Ms. Kennel, Ms. Hanson and finally Mr. DiGuillo.
I'm hoping the e-mail acceptance below will suffice for completion of this requirement for purposes of the
SEIS. Please let me know if I need to do more with this one at this time.

The FEIS identified the following potential mitigation measures that the Company would
implement to mitigate impacts to Transit:
3.4.3.6 Public Transportation Impacts
Jefferson Transit Route I stops approximately one-third of a mile from the
project site at the intersection of US HWY 101 at Black Point Road,
providing transit service four times per day to the main enfrance of the
Pleasant Harbor properties. The applicant proposes to purchase and
maintain a van or small shuttle bus available for guests and tenants to
utilize on an as-needed basis for use in group trip making, coordinated
events, airport shuttle, and other miscellaneous traffic, The applicant also
proposes to work with Jefferson Transit in scheduling and expanding
service as necessary to the resort as well as considering joint opportunities
to provide layover or transit service and facilities within the site.

THIS MEMORANDUM OF UNDERSTANDING ('MOU'), by and between Pleasant Harbor
Marina and Golf Resort, LLP ("Company') and Jefferson Transit Authority ("Transit') is
designed to memorialize the mitigation the Company will provide to mitigate against potential
impacts to Transit associated with the development of the Pleasant Harbor Marina and Golf
Resort (the "Resort').

3.4.2.5 Public Tran sportation Services
Jefferson Transit Route I provides public transportation services in the
area, with a stop on US HWY l0l at Black Point Road, adjacent to the
project site. Route I provides Monday to Saturday service to Brinnon,
Quilcene, and the Hadlock/Irondale/Chimacum Tri-Area. Service at US
HWY 101 and Black Point Road is provided between 7:10 a.m. until 7:55
p.m. with stops every 2 to 3 hours. Saturday service is provided at the US
HWY 101 and Black Point Road intersection from 8:55 a.m. until 7:10
p.m. with stops every 4 to 5 hours.
FEIS at p.3-46.
In 2010, Transit received 0.60/o of all sales tax generated in the County. Resort construction is
expected to generate $20,000,000 in sales tax revenue and operation of the Resort is projected to
inject approximately S95,000,000.00 in taxable sales annually. FEIS at p. 3-63. This substantial
addition to the sales tax revenue base is expected to more than cover any additional incremental
costs of providing fransit service to the Resort.
The Company and Transit agree that the Company shall provide on-site transit stop(s) in the
location(s) shown on the attached sketch as part of the first phase of both the Marina and Golf
Resort are completed, and to prominently maintain a current bus schedule in the Marina District
and Resort areas so the schedule is publicized and easily accessed. In addition, the Company
shall purchase and maintain an operational shuttle for use by Resort guests during the prime
season (May-September). The shutfle shall be in operation before more than 25% of the golf
resort rooms are available for use.
The Company and Transit agree that the mitigation proposed above is consistent with the
requirements of RCW 82.02.020 and is within the authority of the County to require under
Chapter 43.21C RCW and is not duplicative of any other conditions.
This agreement is entered into for the benefit of the parties to this agreement only and shall
confer no benefits, direct or implied, on any third persons.

by the local fire authority.3. All subsurface parking will have to provide fire systems, including air handling, water, and
emergency access and egress.4. lnstall hydrants, two portable fire pumps with hoses and related fire suppression equipment at
the marina and maintenance area as approved by the local fire authority.5. Develop an "emergency action plan" with the Fire District in conjunction with predevelopment,
development, and operation to assure clear lines of responsibility and response in the event of
any incident requiring emergency response.6. Any development of the existing marina complex as part of an MPR shall include improving
emergency vehicle access to this portion of the resort.7. Through a memorandum of agreement with District #4, provide the equipment necessary
to mount rescue and fire fighting operations on any structure over 18 feet from ground
level, including but not limited to the Golf Terraces and Conference Center/Spa Building.8. Enter into an "action plan" with the local f re authority at District #4 to assure coordinated control
of additional services necessary to achieve an adequate level of service to the resort.9. Provide a back-up electrical power supply to the resort to ensure continued operation of
emergency systems and water supply during any outage.
10. Comply with the provisions of a memorandum of agreement with local service providers to
address service equipment and personnel needs created by the resort, taking into consideration
increased tax revenues from the resort activity.

Purpose
This agreement is to cover the current proposed impacts and their mitigations as it
applies to the proposed Pleasant Harbor Master Planned Resort (PHMPR) at Black
Point in Brinnon, Washington. The impacts in question are tiose that directly or
indirectly affect the provision of fire and EMS services to the PHMPR. This
agreement is to also address impacts identified in the 2007 FEIS as well as conditions
ofthe Jefferson County Ordinance 0l-0128-08
General Requirements
1. The Departments Responsibilitv:

in the locations and at the capacities that the Board of Fire Commissioners of the Department
deem appropriate in order to provide adequate fire and EMS coverage to the Brinnon
Community. As well as to maintain all licenses and insurances to effect the same.
1.2. Provide first due fire and EMS services to include equipment and personnel to over 1000
residential homes, a 2 sq mile commercial area, US National Parks, WA State Parks, private
recreation areas as well as the proposed Pleasant Harbor Master Planned Resort (PHMPR).
All contained within the 131 sq mile boundaries of the fire district.
2. The Resort's Resoonsibilitv
2.1. To provide mutually agreeable mitigation measures for all impacts on the fire & EMS
services that the Department provides as identified with in the 2007 FEIS and Jefferson
County Ordinance 01-0128-08 as a result ofthe construction and continued operation ofthe
PHMPR at Black Point.
2.2. The Resort agrees to comply with all negotiated mitigations at the start of each specified
phase of construction. The mitigation will be considered complied with, when the mitigations
are actually completed or a signed waiver has been executed by both parties involved. The
waiver shall stipulate the reason for not meeting the negotiated mitigation as well as the
mutually agreed upon solution.
2.3. General Access
2.3.1. Allalarmedstructuresshallhavearemotealarmenunciatorpanellocatedoutsideatthe
main entrance of th€ structure with a KNOX key box. Actual physical location shall be
mutually agreed upon by the Department and the Electrical Engineer.

2.3.3. Multi occupancy structures will have one centrally located KNOX key box at the
buildings alarm enunciator panel.
2.3.4. All electric gates shall have KNOX key switches.
2.3.5. All manual gates shall have KNOX padlocks.
2.3.6. FDC connections shall have KNOX FDC covers.
2.3.7. All roadways in the PHMPR shall be clearly marked so as to not allow any parking on
the shoulders for any reason. The only exception will be a tumout adjacent to the path to
G thru K dock for loading and unloading.
2.4. Aerial Apparatus
2.4.1.The-Resort shall Lease/obtain and provide to the Department one aerial type apparatus
with a ladder reach of not less than 75 feet. fthe aerial apparatus shall be no more then

2.4.2.The Resort shall provide a bond for the total cost ofthe aerial apparatus, to include the
final lease payment prior to ownership, to ensure the Department will not be obligated
under any circumstances for the lease payments ofthis equipment. The title for the aerial
apparatus shall show the Department and the lease company as the legal owners ofthe
apparatus and must also show the Department as the registered owner ofsame.
2.4.3. The aerial apparatus shall comply with the most current edition of the NFPA l90l
"Automotive Fire Apparatus" as to all applicable chapters, h{fpe tSt t "Inspection,

Department to conduct training and familiarization with the actual construction type of
the buildings. This access is not to interfere with the construction ofthe structures and
may be conducted after normal working hours. This is to include photographs by the
Department at each phase of construction as well as a complete set of as built drawings
for each type ofbuilding.

3-2.3. The existing FDC connection for docks G through K will be relocated to the shoulder
area ofHighway 101, north ofthe Marina entrance to facilitate tender shuttle operations
for docks G through K. Specific design to be by mutually agreed upon between the
Developer and the District. This fire protection service area shall be clearly marked and
protected with bollards ofthe appropriate design.
3.2.4. Should section 3.2.3 not be possible due to failure to obtain WADOT approval the
following shall apply; The Resort will install one 6 inch galvanized pipe from the FDC
connections south of the Maritime Village to the exisisting FDC connection for docks G
thru K. This pipe shall be dry and shall have a 5" Storz type fitting on each end. The
fitting shall be clearly marked at the supply end as to what area it supplies.
3.2.5. There shall be a FDC connection within 6 feet ofthe hydrant on the upper roadway
south ofthe store that will feed FDC connections for the FDC for D dock. The FDC
shall be clearly marked as to the area it supplies.
3.2.6. There shall be a FDC connection within 6 feet ofthe hydrant on the upper roadway
south ofthe store that will feed the future FDC connections for A through F docks. The
FDC shall be clearly marked as to the area it supplies.
3.2.7. Nl fire hydrants within the PHMPR shall have three ports, two ports shall be 2.5 inch
NH thread and the steamer port shall be a 4 inch Storz type fitting.
3.2.8. All fire hydrants shall have a minimum flow rate of not less ttran ItSOO CfU las
confirmed by actual flow testing by the Department. Each hydrant shall be color coded
as per NFPA 24 Annex D. Exceptions may be made to the flow rate by the District on a
case by case basis, with the exceptions noted in writing,
3.3. Wastewater / Sewase Trertment Plant
3.3.1. DuringtheconstructionphaseofthewastewatertreatmentplanttheResortwillprovide
the Department with reasonable access for training. This access is not to interfere with
the actual construction and may be conducted after normal working hours
3.3.2. The Department and the Resort will work together to develop an emergency response
plan for the wastewater treatment and sewage treatment plant during its construction.
3.3.3.The Resort shall provide on-site, in a separate structure at the Agri-Center all necessary
personnel HAZMAT equipment as required by State, County and industry standards.
3.2.2. The FDC connection for the Marina Store, laundry and Docks A-F shall be placed on
the upper roadway south of the store building with a minimum flow rate of 1500 GPM
hydrant within 6 feet. As improvements are made to Docks A-C and E-F a dry
standpipe system will be connected to this FDC location.

THIS AGREEMENT, by and between Pleasant Harbor Marina and Golf Resort LLP (Company)
and Brinnon School District #46 (District) is designed to identify those impacts to the District
associated with the development of the Pleasant Harbor Marina and Golf Resort (Resort), now
under regulatory review by the County, not addressed by increased revenue from the proposed
Resort and subject to supplemental mitigation to assuro concurrency in accordance with the
ordinance of approval, Ordinance 0l-0128-08, paragraph 63(c), which provided a requirement
that the SEIS review memoranda of understanding on appropriate mitigation for the following:

The November 2007 FEIS provided the followins commentary:
3.5.4 Schools
The Brinnon/Black Point area is located within the Brinnon School District #46 and
serves grades K-8 plus the District has a pre-school program. Students of high school
age attend their district of chotce. The Brinnon School utilizes four regular classrooms,
one serviceable portable classroom, a combtnation computer/library rootn, gym, and
administrative offices.
In 2000, the school district had a total enrollment of 74 students. This declined to a low
of between 30 and 40 students in 2005, but rose to 56 students during the 2005-2006
school year. School enrollmentfor 2O06-2007 was 49, and the enrollment for the2007-
2008 school year was 45. In 2010, the enrollment declinedto 31.5 full+ime equivalent
students (including kindergarten which is counted as half days). The current average
enrollmentfor the 2010-2011 schoolyear is 34.0fuU time equivalent students. The
District also enrolls thirteen (13) pre-school students on campu* Thirty-five (35) hish
school students are enrolled in the district of their choice, withfunding provided by the
B rinnon S cho ol District.
Seasonal recreational homes are not expected to add students to the school district, so no
irnpacts are expected from that component of the resort population. Since the proposed
Resort Staff Housing is intended for both resort staff and Brinnon residents, it is expected
that some of those units would be occupied by families with school-age children.
The Capital Facilities Element of the County BSAP MPR Alternative has established an
LOS standard for the Brinnon School of 23 students per classroorn. With four regular
classrooms and one serviceable portable classroom, the school can accommodate up to

115 students based on the established LOS. For the last six years the school has had an
excess capacity and the coming year will reach 32Vo of its capacity.
The Resort and the Brinnon School District
The Resort will endeavor to team with the Brinnon School District to explore ways to increase
revenue to the District's budget. However, in the long term, increased revenue will come from
increased enrollment.
In addition to the above described measures, the Resort would contribute to the District as
follows:
Two dollars for each paid round of golf.
Two dollars for each paid spa treatment,
A bonus of one dollar per hour when employment-age students of Brinnon residents
attending Brinnon or other Jefferson County Public Schools are employed by the Resort.
Visitors to the Resort will be given the opportunity to contribute a financial gift to the
Brinnon School Development Program.
If local Brinnon residents are stimulated to enjoy the Resort amenities, their support of
the Resort would also contribute to the Brinnon School District through the methods of
contribution described in measures 1 and 2, above.
Education opportunities :
a. The Resort will have a conference center that will be available at specific times
for the District for teaching pu[poses.
b. The Resort's employees and consultants will be available to teach students about
the high standards of Green Technologies used to develop and operate the Resort.
c. Scholarships will be available to Jefferson County students interested in
Environmental Studies, Health-Care studies, and Hotel Management programs.
All of the above items 1-6 shall have no sunset provision and shall continue to be carried
forward should the development be sold at some future date (" run with the land" ).

The Brinnou/Black Point al'ea does nol currently have a nredical facility in the local community.
The area is serviced by Jeflerson General Flospital in Polt J'ownsend arrd Masou Gerreral Hospital
in Shelton. A medical clinic has been established in Quilcene, suppofted by Jefferson General
Flospital.
Expected irrcrease regarding health care rvould prinrarily involve accidental injury or
unanticipated illrress. The Resort will take the following steps to ensulp proper carc for visitors
and employecs:
1. Upon development the resort proposal includes 500+/- square feet ofclinic space on resort
property fol a certified nurse and/or general practitionerto be staffed and equipped by the
resort.
2. Selected resoft staff rvill receive training to a minitnutn level of first resporrder and receive
ongoirrg training to stay curerlt in CPR, AED, Oxygen Adnrirristration and First Aid. This
progranr is currently in place at the resort urarina with seven staff trained as first
lesponders or better,
3. If an agreement can be rnade with the Hospital and the Jefferson County Medical Director,
selected staff will be tlained to the level of EMT-B and/or EMT-I.
4. Rcsort emelgerrcy staff and facility will be available to the corunrunity fol emergencies
such as local disaster.
5. These steps do not replace the need for local EMS or hospital care. The goal is to ensure
pal.ients receive the best possible care as quickly as possiblc, to reduce response time in an
elnergency, to mininrize impact ou local EMS for rron emergency care.
6. The resort will work to develop the best possible workiug relationship rvith local EMS and
other nredical serviccs
7. Should the Resort expand and rcquire enrergency Air-Lift capabilities, a suitable landing
