". Repetitive lssues raised that have been previously addressed, will not require additional explanations by the applicant."We aoreed that issues in the FEIS or the Jt/larina would not require further analvsis under the SEIS. The Final SEIS responses would include references to the applicable discussion in the Draft SEIS with clarifyino discussion where appropriate; these responses would be prepared bv EA. ". Positive lssues are to be acknowledged without further comments." Comments from the Draft the or were not substantive would n ea to each commen in the Draft SEIS comments. ". New lssues raised that have yet to be addressed will require a written description from EA Engineering to the Applicant's Consultant for a written response." Correct, for issues that were received throuqh comments SEIS that require further analvsis. For new ues raised that require input from the Pleasant Harbor technical team (for the areas of transportation, qroundwater/aquifers, surface water/critical areas, and fiscal as listed in the EA Final EIS proposal dated Februarv 5.2015), the comments requirino team inputwill initiallv be identified bv EA with concurrence by Jefferson Countv and Craio Peck. Concurrence has been received and EA is preparino a memo listino the applicable comments related to the technical areas which will be provide to Craiq Peck for distribution to the appropriate Pleasant Harbor team member. "Could you please confirm the date for the Final Public Hearing as either May 6's or June 3'd, 2015?" Because of the nature of the work we are now engaoed in, it is lmpossible to confirm the date of the "Final Public Hearino," because the results of further analLsis could reouire revisions to the proiect or SEIS that cannot now be anticipated. See the attached timeline schedule for this process and understand well that these are tentative tarqet dates only. "Could you please confirm the date for the Development Agreement and the detail required for this application and the anticipated date for another public hearing?" See my response above. l'm not sure what vou mean bv "the detail for this application." Results of further analysis of the SEIS comments could cause revisions to the Development Aqreement (DA). Also, there could be chanoes to the DA as a result of the the final public hearing_bv the Board of Countv Commissions. conclusions of the FSEIS, recommendations by Staff or chanoes proposed by the Board, "Could you please provide the date for the resolution for the release of the Development Agreement, and whether this is by phase or for the full development?" See my response above. The Development Aoreement will cover all phases of the resort build-out, but there mav be specific requirements for each phase within the DA. "Could you further advise if a non- residenVnon- tax -payer of Jefferson County has Standing that would be considered by Jefferson County should they vocalize for or against a proposed development within the County." All persons or entities that submit comments have standinq as far as DCD is concerned. lf the FSEIS ts aopealed to Superior Court, then the Court would determine standinq.
