These notes may contain spelling/factual errors. 1:58:53 PM BRIEFING - Project Update and Status Report on Plesant Harbor Master Planned Resort Note: Clerk, Superior Matt Sircerly, Tom GIske, David Sullivan, Kathleen Kler, Kate Dean, Lorna Smith, Cynthia Koan, Mark Evans. Philip Morley, Phil hunsucker, patty charnas, michelle farfan all present. Patty Charnas - Director of DCD. Passed out copies of the slideshow. Over view of the Pleasant Harbor MPR. Brief overview of proposed project, history, detailed overview of two key elements of MPR designation, dev agreement; purpose and item it contains as well as the dev regulations. When we scheduled this briefing, we anticipated to circulate the first public draft, it is unavailalbe for this briefing. Because she is still relatively new director with the county, invites morley to add where he believes good points need to be made. Physical location shown on a map. Supports residential and some commercial. She is going off of the power point presentation and handout. Morley 2:14 explained Environmental Impact Statement. Commissioners make informed decisions based on EIS, it is the env'l disclosure statement that helps make those decisions. Kler - how long was this open for public comment? Patty - an adequate amount over the years. About 100 comments commenting on impacts, and quality of life. She went on to explain the project process slide 12. Correction to slide 12, should say 2016 consultations with PGST and County. PGST Port Gamble Skallam Tribe. Forwarded to bocc in july of last year, which voiced concerns about process and project as a whole. Tribal consultations included 3 staff level meetings re: dev agreement.. tribal consultations continue, and are still ongoing. 2 key public documents set forth mandates on developing and operating the MPR. Ordinance 02-01128-08 and FSEIS. 2:28.. end of slideshow. Morley - in the slide re: finalizing the dev agreement - finalizing a proposal of a dev agreement, subject to review and public comment. Allowing for a significant amount of time between setting of meeting to time hearing is - about 60 days. Allows for - makes sure there is adequate time, public, all interested parties... and staff proposed revisions to those regulations. And consult with tribe so that consultation could be entered into the hearing record... so if there is general public input and tribal input.. if there are refinements the board wishes to make to the PC dev ? 2:31. Mark Evans? - Is there to be a formal signed agreement with the tribe? Morley - in 1989, the tribes within wa state met with gov office and agencies and mapped out the process for govt to govt consultation, tribes as independent nations and state of washington as a subsidiary of the united states. Now we are talking at the county level.. we have ? that process. It requires county to make an earnest effort to communicate, look for opportunities to come to consensus, but it does not require to reach agreement. It respects the fact that parties may disagree. They retain legal rights. If tribe felt their treaty rights were? , they could resort to legal action. Tom - last letter from tribe seems to show a great deal of frustration, the process is progressing, open and in a constructive way... if you read the letter, there are issues in that process, how are those being addressed? Sullivan - i'm scheduling further meetings with the tribe and jeromy sullivan. I was the author of many of those conditions of the dev regs? If you look at the record, those conditions went beyond what the tribe was asking for at that time. Some people look at tribal rights different today than they did 10 years ago. Their concerns are our concerns as well. ... 2;36 once everything is right, it will come forward. He hopes it will happen fairly soon. Cynthia - hope there is another meeting when staff is ready, a joint meeting with PC would be appropriate. ANother piece is to think of hte regs independent of the developer. WHat would be appropriate on that land, regardless of who the developer is. We kept that in laser sharp focus when we were developing the regs. THe idea that the dev agreement could be more specific about what THIS development could do. THe pC had a session last week august 2 where morley and charnas came and talked about the development and what we would hear today, its still pretty vague. Important to know the details. Morley - When we set this meeting in the beginning of august, we thought it would be riper, cant control all actions of all parties. Fully intent for second briefing when we have all the documents, if it convenient with the PC to hold meeting at the sane time. THe tribe may be frustrated because at the technical level when we first met, there has been quite a bit of time.. .. taken some time to address tribal concerns. Tom - discussions with tribe continue, theyre active, while no agreement is required, their ? are continued to be addressed 2:42. Morley - balancing act with the rights of the tribe and the rights of the developer under the law. Lorna - what are the developers rights? Morley - cannot speak to that without? Lorna - the approval process never really spelled out for us...what comes with the more specific requirement and footprint? 2:44 we never saw what was submitted... missed what she was talking about. patty - the ordinance that approved the dev of land for the mpr, are you asking how it began? Lorna - almost like a residential dev permit approval...?Patty - happened as a supplement... lorna - we have an eis that says...? check audio for more discussion. Sullivan - there is a lot of history here. Its important to keep respect tribal rights, applicant and neighbors rights too. We have a good record of doing it. Trying to find that sweet spot where we can reach consensus.THanked the PC for attending. Appreciates the work PC has done. ...mark - talking about the tribe... giske - contention between bocc and PC. they have spent more time on this. ...concerns are with the property. Confident we will end up with something that is good for the county...may be up to 10 years. Lorna - change conditions need revisiting... water quality in disco bay... conditions have changed which require them to revisit. A lot has changed in 10 years. ...sullivan - really think theres a positive outcome we all working towards. ,,,3:18 most of the PC members here, is that because of working schedules or conflicts? Patty - 2 said they couldn't attend. Giske - we have a quorum, on a work day. Morley - looking for a similar timeframe if we reconvene. Audience may want clarification about kettles... statesman group had previously said they would save kettles and turn them over to the tribe, but now they said they are reverting to previous plan...and use as an artificial runoff... people are really interested in those kettles. Morley - cant do that today, discussions with developer is still ongoing. ...3:25 cynthia - large concern, deadline of june 30 of 2018 for the comp plan... schedule, both the DCD, and BOCC, is jam packed. It is hard to imagine how to do something else on top of that, it is a big concern. Lorna - after this briefing, the public deserves and would appreciate some written communication update.
