ORDER: BUDGET APPROPRIATIONS/ }
EXTENSIONS FOR VARIOUS } RESOLUTION NO. 4 3 21
COUNTY DEPARTMENTS }
WHEREAS,the Jefferson County Board of Commissioners did on the 6th day of July,2021 declare that a
need existed for the listed expenses which are funded by additional sources which were not anticipated at the time of
preparing said budgets; and such sources include unanticipated received from fees,or grants from the State and
Federal government,or proceeds from the sale of bonds,or budgeted but unexpended monies from the prior budget
year;and
WHEREAS, the Jefferson County Board of Commissioners did on the 6th day of July,2021, set a hearing on
said need for the 26th day of July,2021,at the hour of 10:30 a.m. in the County Commissioners' Chamber,Courthouse,
Port Townsend,Washington;and
WHEREAS, Jefferson County has published notice of this hearing as provided in RCW 36.40.100 on July 14
and 21,2021 in the official newspaper of Jefferson County;and,
WHEREAS,this being the time and place set forth for said hearing and no objection or objection interposed.
NOW,THEREFORE,IT IS HEREBY ORDERED,by the Board of County Commissioners,that due to
there being sufficient monies available in the other listed funds,that the County Auditor is hereby directed to extend
the budget of the following funds by the amounts listed and per the attached requests:

and DPA II Criminal and Civil Positions
Mark and Andy:
This memorandum supports the Prosecuting Attorney Office's 2nd Quarter 2021 Budget
Supplemental and Grade Increases for DPA I and DPA II Criminal and Civil Positions. We are
requesting a budget supplemental and HR action for the following items:
1, Increase the Grade of DPA I and DPA II Criminal and Civil Positions. Currently,
these positions are MGR 18 and 19 grades. We are requesting that the positions
be changed to MGR 19 and 20 grades. Salaries at the lower DPA positions will
not attract talent. Even Philip Morley recognized this, when he agreed to
retention bonuses for DPA I and DPA II positions, starting in 2019. Philip's plan
was to address the woeful salaries for DPA I and DPA II positions by increasing
the grades as we suggest. Even that may not be enough. We may need a market
adjustment too. But the PAO has an immediate need and this has been long-
planned. This change probably would allow for the discontinuation of retention
bonuses for DPA I and DPA II positions.
2. Permanently Fund and Promote the Current criminal DPA I to DPA II. Melissa
Pleimann was hired in 2019 from Pierce County. The retention bonus made up
for some of her salary loss. Melissa's salary is largely funded by a contract to
represent the City of Port Townsend in District Court. Melissa has been doing an
excellent job and is a very hard worker. Anna Phillips, our most experienced
trial lawyer, has been mentoring Melissa. If Melissa leaves, that training will
benefit some other employer. We should try to keep her.

3. Increase the Top Grade for the Second Civil Deputy to DPA III. We have lost
two civil deputies who were DPA Its to other jobs that paid significantly more
money—Austin Watkins and Randon Draper. In our current efforts to replace
Randon at a DPA II position, there only has been one applicant, Barbara
Erlichman. Because of a confusingjob description (since fixed byAndy), Ms.
Erlichman thought the position was a DPA III position. Ms. Erlichman will not
work as a DPA II, but is highly qualified to be a DPA III. She is currently the
chief civil deputy prosecuting attorney for Island County and previously was the
chief civil deputy prosecuting attorney for Snohomish County. Ms. Erlichman
has significant land use experience that would highly benefit DCD. She lives in
Sequim. If we can pay Ms. Erlichman enough to stay at the County, we may be
{ able to keep her until she retires in 5 plus years. Even if we cannot land Ms.
Erlichman,the change probably will increase the candidate pool.
4. Trial Related Expenses as a Result of the Scarantino Lawsuit. The County
Commissioners already approved payment of consultants and a special DPA, as
we looked to resolve the Scaranino lawsuit. These expenses should be approved
in the budget supplemental.
5. Trial Related Expenses Relate to Murder Trial. The PAO's total budget for the
year for trial related expenses is $10,575.00. Already, the PAO has spent nearly
that much already just on the murder trial. Murder trials are unexpected. The
County even excludes them from its contract for public defender services. We
think a supplemental budget of $15,000.00 likely would cover the past and
expected future expenses for the murder trial.
The Prosecutor's Office is Down 3 DPAs. The Prosecutor's office has become the place where
things are backing up. One criminal DPA is on maternity leave. One criminal DPA was
terminated. The Civil DPA left for a job paying much more money in Thurston County. The
PAO is barely getting by now because of the loss of DPAs.
There already is a backlog of work on both the criminal and civil sides. If we cannot recruit
quickly and effectively—the backlog will become much worse. Among other things:
1. COVID 19 Back Up in Criminal Cases. There already is a substantial backlog of
criminal cases because there have been a limited trials possible since the
pandemic began. Trial dates get cases resolved because the either will be a trial
or a settlement. However, only a limited number of actual trials are possible,
mostly due to available courtroom space. Currently, District Court is setting more
case for trial than possibly can be tried. There is uncertainty about which cases
actually will go to trial and this forces significantly more preparation because
when cases are prepared for trial and not tried, significant preparation is required
again before the next trial setting.
2. Blake Fallout. Eventually, there will be a flood of more Blake-related vacations
of convictions. This will require prosecutor time. In addition, there may be
litigation with the State over funding for legal financial obligations (LFOs)

because: (a) The legislature did not provide enough funding to repay all the
Blake-required LFOs; and, (b) The Administrative Office of the Courts is trying
to keep some of the money funding for dealing with LFOs for itself.
3. Pent Up Code Compliance Work. Enforcement litigation for public health must
be filed for the sake of addressing serious environmental and solid waste
violations. Much of this litigation has been delayed for three reasons: (a) COVID
19 delayed finalization of new Title 19 JCC (Compliance Code); (b) We have
been putting together an amnesty program that has taken longer than expected;
and,(c)The departments are on a learning curve about Title 19 JCC.
4. SMP Update. The Shoreline Master Program update is due June 30,2021.
5. Sewer Ordinance. Public Works advises that it will need a sewer ordinance
sometime next year to implement the Hadlock Sewer project. This will be a
significant project for the PAO.
With the permission of the prosecuting attorney, it is possible that some of this work can be
sent to special deputies paid by the County, but the cost likely will be much greater than the
cost of the additional funding.
Please approve the budget supplemental and changes to the DPA I and II grades as discussed
above.

SUBJECT: HEARING re: Proposed 2021 Second Quarter Budget Appropriations/Extensions for
Various County Departments
STATEMENT OF ISSUE:
Various County Departments have requested increases to their 2021 budget. Per RCW 36.40.140 the Board
of County Commissioners must hold a public hearing regarding the proposed budget changes.
ANALYSIS:
These budget changes are intended to address unanticipated revenues and expenditures of the requesting
departments. The Hearing Notice was published in the Leader on July 14 and 21, 2021.
FISCAL IMPACT:
See attached department fund requests.
RECOMMENDATION:
Hear public testimony and consider approval of a resolution to adopt the 2nd quarter supplemental budget
appropriations.
