IN THE MATTER OF AMENDING } ORDINANCE NO.04 0726 21
JEFFERSON COUNTY CODE }
SECTIONS 3.28.030(2)(B) & 3.36.030 }
WHEREAS, Jefferson County Code Section 3.28.030(2)(b) requires that 50% of Public
Infrastructure Fund (PIF) revenues collected be transferred to the Tri-Area Sewer Fund to help
finance, design and construct the Tri-Area Sewage Treatment Facility; and
WHEREAS, Jefferson County Code Section 3.36.030 references the 50% of PIF revenue
to be used for the Tri-Area Sewage Treatment Facility; and
WHEREAS, the funds thus far transferred have been used to service debt related to the
dedicated to the facility; and
WHEREAS, at the 50% rate the Tri-Area Sewer Fund will collect approximately
$800,000 more than needed to retire the debt; and
WHEREAS, county staff briefed the PIF Board on this issue and recommended the
Jefferson County Code be amended to establish a flat payment of an amount that would
accumulate funds in the exact amount needed to retire the debt, which would be $240,000 per
year beginning in 2021; and
WHEREAS, this proposed change would make significant funds available to other eligible
public entities; and
WHEREAS, the PIF Board voted unanimously on June 16, 2021 to recommend that the
Board of County Commissioners approve such amendment to county code; and
NOW, THEREFORE, BE IT RESOLVED that the Jefferson County Board of
Commissioners hereby directs the Jefferson County Code amendment to sections 3.28.030(2)(b)
and 3.36.031 Indicated in Exhibit A, attached.

Section 3.28.030(2)(b) as it currently reads:
b) To finance the planning, design and construction of the tri-area sewer system using 50 percent
of monies collected under this chapter to the tri-area sewer fund, pursuant to JCC 3.36.030. In
addition, after consultation with the public infrastructure fund board, additional public
infrastructure funds may be awarded to the tri-area sewer system as an eligible public facility,
pursuant to subsection (2)(a) of this section;
is amended to read:

annually of monies collected under this chapter to the tri-area sewer fund, pursuant to JCC
3.36.030. In addition,after consultation with the public infrastructure fund board,additional public
infrastructure funds may be awarded to the tri-area sewer system as an eligible public facility,
pursuant to subsection (2)(a) of this section;
Section 3.36.030 as it currently reads:
Of the funds provided to the county under RCW 82.14.370 50 percent shall be dedicated to the
tri-area sewer fund for the planning, design and construction of the tri-area sewer system. In
addition, after consultation with the public infrastructure fund board, additional funds provided
to the county under RCW 82.14.370 may be awarded for the tri-area sewer system as an eligible
public facility, pursuant to JCC 3.28.030(2)(a).

SUBJECT: Public hearing regarding amending Jefferson County Code (JCC) Sections
3.28.030(2)(b) and 3.36.030 to change the annual Public Infrastructure Fund
transfer to the Tri-Area Sewer Fund from 50% of revenue to a flat $240,000
STATEMENT OF ISSUE: Current Jefferson County Code requires that 50% of monies collected
under Chapter 3.28 JCC be transferred to the Tri-Area Sewer Fund to finance the planning, design and
construction of a sewage treatment facility.A proposed code amendment to change to this arrangement
was presented to the Public Infrastructure Board,which is being proposed for approval to the Jefferson
County Board of Commissioners.A public hearing is required prior to enacting this proposed
amendment.
ANALYSIS: Monies transferred from the Public Infrastructure Fund to the Tri-Area Sewer Fund have
been used to service debt related to the facility. The Tri-Area Sewer Fund will accumulate significantly
more funds than are required to retire the debt in 2032. We have calculated that an annual flat payment of
$240,000 will provide just enough funding to retire the debt. Reducing the transfer to the flat amount will
make significantly more funding available for distribution to other public agencies eligible to apply for
Public Infrastructure Fund(PIF) funds.
This was presented to the PIF Board at their June 16, 2021 meeting and the Board voted unanimously to
recommend amending the code to the Board of County Commissioners. The Board subsequently
published a public hearing notice for today's hearing.
Amending the code requires a public hearing.
Code revisions related to this public hearing are attached.
FISCAL IMPACT: This request will reduce annual PIF transfers to the Tri-Area Sewer Fund. The
reduction will vary year to year based on PIF revenues collected.
RECOMMENDATION: That the Board of County Commissioners conduct a public hearing to consider
amending Jefferson County Code sections 3.28.030(2)(b)and 3.36.030.
