The Board then interviewed Belinda Gonzalez and Betty Johnson who are both interested in serving as Chief Examiner for the Civil Service Commission. COMMISSIONERS' BRIEFING SESSION APPROVAL OF THE MINUTES: Commissioner Wojt moved to approve the Minutes of August 28, as corrected (page 5, second paragraph, change Chainnan Huntingford moved to Commissioner Hinton moved) and September 5, 1995 as submitted. Commissioner Hinton seconded the motion which carried by a unanimous vote. Request for Funds to Complete Emergency Plan; Bob Minty, Jefferson County Emergency Management: Commissioner W ojt stated that there is an opportunity to contract with the fonner Civil Defense person from Clallam County to work on the amendment to the County's emergency services plan at the same time he is in the area working on the plan for the City of Port Townsend. Commissioner Wojt moved to approve funding this request to bring the emergency services plan up to date. Commissioner Hinton seconded the motion which carried by a unanimous vote. PUBLIC SERVICES BRIEFING: Public Services Director Gary Rowe briefed the Board about the following issues/items being worked on by County staff: !»+- Working on procedures for the ordinance adoption process to clarify and clean up how ordinance updates are done. !»+- Working on developing a computerized Action Request Tracking system. !»+- Ordinance codification - County Code is printed and the adoption ordinance should be on the Board's agenda for setting a public hearing. !»+- Water Resources Council Charter - Prosecuting Attorney has done a preliminary review and forwarded their comments to the Planning Department. !»+- County Risk Management Policy - Prosecuting Attorney is reviewing the section that puts the Auditor on the Claims Review Committee to see if it would be more appropriate to have the Claims Coordinator be on this committee. !»+- FEMA Ordinance has been reviewed by the Prosecuting Attorney and will be forwarded VO!_ 21 'H,r : -, . r !<',b~ o 1092 Page: 1 f£~.~~!~~~.~.M~~~~~~.~.~~!~~;.~~~~.~K.§.~.e!~~~~~..!.~.~..t~~~................................................................. to the Board soon. ~ The Western Washington Growth Management Hearings Board found the County's Ordinance establishing Port Ludlow as an IUGA out of compliance with GMA. He explained that he will be reviewing the status of issues for the Board each week and the Board can advise if there are any policy issues that they would like more infonnation on. PUBLIC COMMENT PERIOD: The following items were discussed: The cost of GMA to the County; the Washington State Association of Counties is compiling infonnation on the cost of GMA planning for all counties; the cost of defending ordinances that have been found to be out of compliance with GMA need to be identified when this infonnation is compiled; how the MOU discussed at the meeting with the PUD was drafted and given consideration; and the issue of whether the City has enough water to handle the projected future growth. Letter to City of Port Townsend re: Invitation to participate in a committee to oversee an analysis of the Solid Waste Operations BUSINESS FROM COUNTY DEPARTMENTS: PLANNING AND PERMIT CENTER Clarification of the term "Play Ground" on Lot 34 of Melwood Terrace Subdivision: Pennit Technician Michelle Grewell reported that Lot 34 of the Melwood Terrace Subdivision is listed as a "playground" on the plat map. There is no dedication on the face of the plat, or explanation of what the tenn means, or any indication that this area is dedicated to the plat. The Covenants recorded with the plat do not give any indication of what this tenn means to this plat. The County's archives were checked and nothing was found that explains what was meant for this lot. Commissioner Hinton moved to approve RESOLUTION No. 81-95 clarifying the tenn "play ground" on Lot 34 of Melwood Terrace. Commissioner Wojt seconded the motion. The Chainnan called for a vote on the motion. Commissioner Hinton and Commissioner W ojt voted for the motion. Chainnan Huntingford voted against the motion. The motion carried. Application for Assistance from the Veterans Relief Fund: Commissioner Hinton moved to approve two applications for assistance from the Veterans Relief Fund from the American Legion #26 in the amounts of $495.00 and $129.29. Commissioner W ojt seconded motion which carried by a unanimous vote. Appointment to the Position of Chief Examiner for the Civil Service Commission. Commissioner Wojt moved to appoint Betty Johnson as the Chief Examiner for the Civil Semce Commission. Commissioner Hinton seconded the motion which carried by a unanimous vote. PUBLIC WORKS DEPARTMENT BRIEFINGS Recommendation for Rejection of all Bids for the Oak Bay Road, Emergency Road Repair Project CR1219: Acting Public Works Director Lou Haffreported that after reviewing the bids on the Oak Bay Road repair project, the Public Works Department recommends that all the bids be rejected because they were significantly higher than the Engineer's Estimate of $450,018.02. A temporary repair project will be done on this road instead. Commissioner Hinton moved to approve RESOLUTION NO. 82-95 rejecting the bids and revising the County Road Project. Chairman Huntingford seconded the motion in the temporary absence of Commissioner W ojt. The motion carried. VOL 21 rAG~ 0:1094 Page: 3 S:£~.~~~~~f?,~.M~~~~~ß.M!~~!~~;.~f?,f?,~.~.f.~.~.P.!~~~~~..!.!.:..!.??~................................................................. 11:30 a.m. The Board met in Executive Session to discuss a real estate purchase from 11 :20 to Intent to Purchase Property: Michael Shahda~ Commissioner Wojt moved to approve and sign RESOLUTION NO. 83-95 directing the Public Works Department to proceed with the purchase of the Shahda property in Quilcene pursuant to a Purchase and Sale Agreement and designating the Chainnan as the authorized representative of the Board to sign all of the necessary paperwork. The Chainnan seconded the motion and called for the vote. Commissioner W ojt and Chairman Huntingford voted for the motion. Commissioner Hinton voted against it. The motion carried. Commissioner W ojt moved to direct the Public Works Department to draft a loan agreement for the purchase price of this property ITom the ER& R or Road Fund to the Current Expense Fund. Chairman Huntingford seconded the motion and called for a vote on it. Commissioner W ojt and Chairman Huntingford voted for the motion. Commissioner Hinton voted against it. The motion carried. Update on Budget for Facilities Repair and Maintenance: Facilities Manager Warren Steurer reported that the Facilities Repair and Maintenance budget includes funds for specific projects, service contracts for equipment, emergency repairs and unanticipated repairs. Loring Bemis then reviewed the projects that have been completed. There was $73,000 budgeted for repair and maintenance and to date they have spent $66,997.88. There is still $12,200 in service contracts to be paid this year and it is anticipated that $2,500 is needed for regular maintenance and unanticipated expenses for the balance of the year. They have identified another $19,800 in projects that they feel should be done this year. There is $36,000 in unencumbered cash in the Facilities budget, so there is funding to meet these needs. Lou Haff explained that the originally proposed budget for facilities repairs and maintenance in 1995 was $90,000 and that was cut in an attempt to help balance the budget. Commissioner Hinton moved to allow Facilities Management to spend their reserve fund to cover the expenditures as proposed for the balance of the year. Commissioner W ojt seconded the motion which carried by a unanimous vote. Marianne Walters. Superior Court Clerk re: Request for Increase In Hours of A Current Position: Marianne Walters reported that her request is to increase a 28 hours per week position to 35 hours per week. Overall the case filings in the Superior Court are up 30%, while in Juvenile Court the filings are up 100% and proceedings are up 300%. This position is the reception and ITont counter position in the office. If this request is approved, it will require a budget appropriation of approximately $1,500.00 for the balance of 1995. Commissioner W ojt moved to approve the increase in hours per week from 28 to 35 as requested for the position in the Clerk's Office. Commissioner Hinton seconded the motion which carried by a unanimous vote. HEARING re: SEP A Appeal~ Threshold Determination Appeal Short Subdivision #SUB94-0071: Jim Piper~ Applicant: Deputy Director of Public Services David Goldsmith reported that this matter has been resolved and so the hearing is canceled. '/OL 21 rAf,Ç 0 :1095 Page: 4 Review Accessory Dwelling Unit Amendment to the Jefferson County Zoning Code: Deputy Director of Public Services David Goldsmith reported that this draft change to the Zoning Code defmes what an accessory dwelling unit is, provides for an exemption for ££~.~~!~~~~.M~~!~~~.~~~!~~:.}Y~~~.~.f.§.~£!~~~~~..!.~.:..!.~~2................................................................. ADD's in all zones as long as they meet specific standards, and identifies the standards that must be met. The standards include 1) the building must be owner occupied, 2) it must have a certificate of occupancy, 3) an outline of the specific requirements for outbuildings, 4) one front door to the residence, 5) manufactured homes are prohibited, 6) One ADD per single family residence and 7) water service is not separate. Commissioner Hinton moved that this draft be sent, after changes discussed are made, to the Planning Commission for their review and recommendation. Commissioner W ojt seconded the motion which carried by a unanimous vote. Application for Assistance from the Veterans Relief Fund: Commissioner Hinton moved to approve the application for assistance from the Veterans Relief Fund in the amount of $500.00 from VFW Post #10706 Brinnon. Commissioner Wojt seconded the motion which carried by a unanimous vote. Review and Final Decision re: Establishing a "No Shooting Zone" in the Quilcene Bny Area: Chainnan Huntingford explained that the hearing record is closed on this petition to establish a "No Shooting" zone around Quilcene Bay. Commissioner Hinton explained that the people of Kala Point initially came to the Board regarding an ordinance and procedure that would allow for the establishment of "no shooting" zones in the County for protection in more urbanized areas. They got a copy of an ordinance from King County. He can appreciate the concerns of the property owners on the east side of Quilcene Bay regarding the alleged violations that have occurred over the years. The alleged violations that are occurring are already covered by State game codes or statutes. Few people, if any, have ever lodged a complaint with the Sheriffs Office or the State Department of Fish and Wildlife regarding these alleged violations. There were suggestions made to reconfigure the "no shooting" boundary to make it work, but it's difficult to delineate lines for enforcement purposes without some type of identifiable road, etc. for locating the boundary. The Sheriffs Office has a marine unit that can be brought on line to patrol on Quilcene Bay during duck hunting season. Even if the "no shooting" zone was enforced, the Tribes will be able to hunt in that area. He also stated concern about setting a precedent by initiating such an ordinance in a rural area. Commissioner Hinton noted that he doesn't feel that he can support a "no shooting" zone in this area at this time. Commissioner W ojt stated that the sense he got at the hearing was that this ordinance, if adopted, wouldn't solve the problem. The problem is how to stop the indiscriminate shooting in this area. Having another law on the books that can't be enforced doesn't provide any more protection. Possibly a block watch, working with the Sheriffs Office regarding illegal activities in the area, and posting land would go further toward solving this problem. He questioned if the problem is the noise from the shooting or the shooting itself. He doesn't feel this ordinance will solve the problem. People need to report incidences of illegal shooting. Chairman Huntingford stated that he agrees with many of the things that Commissioner Hinton and Commissioner W ojt have said. He feels that the use of rifles is an enforcement issue. Safety issues are a concern. The tribal hunting issues may be a problem in the future. He discussed this with a representative of the State Department of Fish and Wildlife (Mike Fradinburg) who wants to know the result of this hearing and advised that they realize there is a problem and are willing to do more enforcement in this area. The Department of Fish and Wildlife will possibly put some hunting restrictions in the area of the barge on Linger Longer Road. ChaÌnnan Huntingford agrees that the community needs to work through the Sheriffs Office on more enforcement. Chairman Huntingford· stated that he will work with the State Department of Fish and Wildlife on these issues. Commissioner Hinton stated that since there is now a resident Sheriff s deputy in Quilcene the response times should be better than they were in the past. He volunteered to arrange a meeting in the community with representative of the Sheriffs Office and the State Department ofFish and Wildlife so that the residents can update them on their concerns and experiences. Commissioner Hinton moved to deny the petition for establishing a "no shooting" zone in Quilcene Bay at this time. Commissioner W ojt seconded the motion which carried by a unanimous vote.
