Commissioner Glen Huntingford and Commissioner Richard Wojt were both present. Continuation of Hearin2 re: Review and Consideration of Hearin2 Examiner Findin2s, Conclusions and Recommendation; Conditional Use Application #IZ-34-93 Arcadia Terrace; Multi-Family Development; Robert Ha~en, Applicant: Chairman Hinton stated that the public comment portion of the hearing had been closed, and that the Board will consider the issues raised at the previous hearing. Chairman Hinton asked the Prosecuting Attorney if the Board had the authority to question the supply of water from the PUD since the applicant had a contract with them to provide water for this project. Prosecuting Attorney Mark Huth reported that the Board has to make a finding that there is an adequate supply of potable water. Mr. Huth stated that, in most cases, if a PUD came forward and stated that they would supply water, it would be sufficient. However, since there has been testimony which indicated the PUD was already over-committed in the area, it would be appropriate for the Board to question the PUD about the water supply issue. Chairman Hinton asked PUD Commissioner Dick Shipman to address the issue. Mr. Shipman reported that the records of the PUD for the water usage from the City indicate that 9.68 million gallons of water were used in a year. The City is contracted to provide 1.5 million gallons per month to the PUD. In a gross year, that means that the PUD is using approximately 52% of that allocation. Mr. Shipman stated that he would argue that the PUD is not over capacity. He explained that if the monthly allocation is exceeded, the City doesn't shut the valve off, but a penalty is applied for those gallons. Mr. Shipman said that another matter is that there is a City customer (Arcadia Inn) on the PUD system which is a heavy user. The Inn uses 7% to 8% of the annual actual water usage. That usage, as well as some other problems, need to be discussed with the City to increase the PUD's allocation. Chairman Hinton asked if the penalty is assessed on a monthly basis? Dick Shipman reported that the one time the PUD went over the contracted amount, the City did not assess the penalty. Chairman Hinton asked if the penalty would be passed on to all the rate payers or just be absorbed by the PUD. Dick Shipman reported that the penalty would not be passed on immediately. The PUD has a surcharge in the summer which would be assessed to individuals for excessive usage. If the total PUD allocation were exceeded consistently, the PUD would have to look at changing the rates. Commissioner Wojt asked if the water system for this project has been installed and accepted by the PUD? Dick Shipman reported that the system has been accepted by the PUD. Commissioner Wojt asked if the system is inspected when the PUD accepts a system that is installed by someone else. Dick Shipman stated that an inspection is done and the PUD representative was wrong in stating that the line was six inches; it is an eight inch line. Commissioner Huntingford reported that he had received information that there are 110 taps on the Glen Cove water system, when the agreement with the City indicated 50 taps. It appears that the PUD has issued twice the number of water taps than the State has indicated there is capacity for, using a usage rate of 800 gallons per day per tap. Dick Shipman answered that there are about 100 people invoiced for water on the system, and another 10 or 11 that aren't active at this time. The actual usage was considerably less, 265 to 300 gallons per day. Commissioner Huntingford asked what the allowable limits for pumping per day will be on the five wells being developed by the PUD? Commissioner Huntingford said the figure he heard was 5,000 gallons per day per well. Dick Shipman noted that figure is correct. Mr. Shipman said that while negotiations were taking place, no contractual agreements had been signed as yet. He added that the billing is different than connections and that the actual usage was much lower than the 400 or 800 gallons per day designated by State agencies. Chairman Hinton asked for the boundaries of the Glen Cove water system? Dick Shipman reported that the boundaries are Glen Cove Road, Seton Road including the industrial park, Discovery Road, and branches out Cape George Road and Jacob Miller Road. Chairman Hinton asked whether storage facilities would be required for any expansion outside the described area? Dick Shipman agreed that it was possible. Mark Huth asked where the 50,000 gallons a day figure came from? Commissioner Huntingford stated that the contract between the City and the PUD filed with the State Department of Health called for 50,000 gallons per day for the Glen Cove system. Commissioner Wojt asked if the PUD has or is planning to make changes to this water system to meet fire flow standards? Dick Shipman answered that there have been issues with the Fire District in the past about where the system has been extended and the planning for it, but this project met the fire flow requirements and was a looped system. Commissioner Wojt asked what options the Board has with regard to the answers from the PUD about the water capacity of this system? Mark Huth stated that he feels the answers to these questions should be put in writing. Mr. Huth stated that Mr. Shipman's testimony had not provided enough clarification of the questions raised. Whatever the actual usage is, the State requirement is for 800 gallons per day. He stated that it would not be in the County's best interest to participate in such an arrangement without knowing exactly where the water will come from. Mr. Huth reiterated that the Board must make a finding that there is adequate potable water. Mr. Huth stated that the PUD should provide a letter addressing the 50,000 gallons per day allocation, and how they could serve 150 taps. In addition, Mr. Huth stated that a letter from the Fire District stating that the proposal's water system meets fire flow requirements should be provided. He suggested the Board ask the Fire District for their assessment of the as-built system. Commissioner Huntingford stated that he feels that the Fire District should review the system to make sure that it is adequate. Commissioner Huntingford moved that the Board not go further with the approval of the project, and that the PUD be instructed to contact the State Department of Health, to determine if there is adequate water supply. If the two determine that there is adequate water, then the Board could continue the process. Commissioner Wojt seconded the motion. Chairman Hinton asked if the issue of the buffer on the south side of the property has been addressed? Jerry Smith reported that no action was taken on the issue since the last hearing. The Chairman called for a vote on the motion. The motion carried by a unanimous vote. Commissioner Huntingford moved to instruct the Planning Department to contact the applicant to address the buffer issue as far as the positions on the Hearing Examiner's report. Commissioner Wojt seconded the motion which carried by a unanimous vote. HEARING re: Application for Franchise; For Water Lines in County Road Ri2ht-of- Way; Black Point Road; Sam Bolin2, Applicant: Bob Henderson reported that this franchise was first applied for two years ago, and because of some paperwork , VOL 20 rAG~· 228 . The staff recommendation was that the project be approved with a $8,000 maintenance bond. For the Board's information, Mr. Henderson reported that normally a $150 construction bond would be recommended. However, the Board waived the construction bond requirement previously. Commissioner Wojt asked if this is a new application? Prosecuting Attorney Mark Huth reported it is. Bob Henderson reviewed the franchise map for the Board. Sam Boling reported that he has approved water rights on the well and that those approvals were the reason for the delay. Commissioner Huntingford moved to approve the franchise request by Sam Boling as conditioned. Commissioner Wojt seconded the motion which carried by a unanimous vote.
