Dennison moved to approve the reimbursable work agreement (Exhibit

do work on the Triton Cove Road for the Washington state Parks &

AGREEMENT reI Temporarv Helo: Public Works Department:
Karen Bailev: Administrative secretary Eileen Simon reported that
this temporary help agreement with Karen Bailey is for a three
month period to provide assistance with the striping projects this
summer. Commissioner Dennison moved to approve the agreement as
presented. Commissioner B. G. Brown seconded the motion. The

GRANT AGREEMENT reI #TAX89033 Amendment #1: Hazardous
Waste Manaaement Plan: Washinaton state Deoartment of Ecoloav:
This grant from the State Department of Ecology is for the
preparation of the Hazardous Waste Management plan, Jeff Fretting-
ham, Environmental Planner, reported. The original agreement
listed twenty tasks which will be reduced to two tasks by this new
agreement. The completion time for the grant is also being
extended to November 30, 1990.
Commissioner B. G. Brown moved to approve amendment number 1 to the
Grant Agreement with the State Department of Ecology as presented.
Commissioner Dennison seconded the motion which carried by a
unanimous vote.
county Landfill and Solid Waste Transfer stations
Operatina Hours: Jeff Frettingham advised that after discussing
the possible change of operating hours at the landfill and drop box
sites with the employees at these sites, it is felt that a survey
should be made of the users of these facilities to help determine
the operating hours. The survey will be taken for a three week
period and the results will be brought back before the Board on
June 10, 1990.
License reI Use county Road Riaht-of-way: Platted Alley
in Plat of South Port Townsend: Fleatice Whitley. Apolicant:
Fleatice Whitley is seeking a license to place a fence 8 feel
within the 16 foot platted alley, Eileen Simon reported. The
Public Works Department has checked the site and has no objection
to the fence being placed as presented. Commissioner B. G. Brown
moved to approve the license as requested. Commissioner Dennison
seconded the motion which carried by a unanimous vote.
Establishing the Name for a Private Road: Discovery
Crest Drive: Eileen Simon reported that the name "Díscovery Crest
Dríve" is not in conflict with any currently named road in the
County. Commissioner B. G. Brown moved to approve Resolution No.
45-90 establishing the private road name of Discovery Crest Drive
as requested. Commissioner Dennison seconded the motion which
carried by a unanimous vote.

Kearsley, Stormwater Coordinator, who is working on the development
of a stormwater plan for the County. Such a plan requires citizen
review and input. It is fel t that an advisory board for this
project is necessary to provide this citizen input, and that it be
made up of seven members. The positions on this Advisory Board
would be advertised for interested residents to apply. Commis-
sioner B. G. Brown moved to approve Resolution No. 46-90 establish-
ing the Stormwater Management Advisory Board. Commissioner
Dennison seconded the motion which carried by a unanimous vote.
Xntent to enter into Loan Aareement with the Public Works
Board for Public Works Trust Fund: :Improvements to the Beaver
valley Road: Bob Nesbitt reported that a loan is being sought for
approximately $491,000.00, at a 3% interest rate from the Public
Works Trust Fund for the improvements to the Beaver Valley Road.
Commissioner Dennison moved to approve Resolution No. 47-90 which
indicates the County's intent to enter into a loan agreement with
the Public Works Board for the funding of the improvements to the
Beaver Valley Road. Commissioner B. G. Brown seconded the motion
which carried by a unanimous vote.
AD-plication to O~en county Road Riaht-of-way: cook street
and Dennison street: Plat of Tibbals Lake Park: Homer N. Tobin:
Bob Nesbitt reviewed Homer Tobin's application to open Cook Street
from Cook Ave east to Elm Street, and Dennison Street from Elm
Street to Maple. The request is to open these streets to private
access standards. Since these streets will be providing access to
private residence lots, the Public Works Department recommends that
the streets be opened to county Road standards.
Commissioner B. G. Brown moved to approve the application to open
right-of-way as recommended by the Public Works Department.
Commissioner Dennison seconded the motion. The motion carried by
a unanimous vote.
Withdrawal of a Road Vacation AD~lication: Rhododendron
Avenue: Gary Jensen: Eileen Simon presented a letter from Gary
Jensen which indicates that he is withdrawing his vacation applica-
tion. Commissioner B. G. Brown stated that the applicant must be
informed that if they withdraw their application that another
property owner can submit an application to open this right-of-
way. Eileen Simon reported that the Jensen's are planning to
submit an application for a license to use this right-of-way. The
Public Works Department staff will review the possible circum-
stances that could arise from this withdrawal, to make sure that
Gary Jensen understands the ramifications.

CONTRACT reI providinq Kitchen EquiDment for the Port
Townsend Community Center: Andaar corporation. Lynden: commissioner
B. G. Brown moved to approve the contract with Andgar Corporation
of Lynden for the kitchen equipment for the Port Townsend Community
Center as awarded. Commissioner Dennison seconded the motion which
carried by a unanimous vote.

David Goldsmith. Planning & Building DeDartment Director
reI ProDosed Resolution to AdoDt the SRF Loan: Planning and
Building Department Director, David Goldsmith, reported on the
Pollution Control Revolving Loan program being funded by a loan
from the Department of Ecology. The total amount that the State
will loan the county for this program is $200,000 over a two year
period. The loan repayment schedule for the total amount is
$24,000 a year for 10 years at 4% interest per year.
The County will use this funding to provide loans to homeowners to
repair failing septic systems. A fund and budget must be es-
tablished so that the County can provide these loans to homeowners
and then the State will replenish the fund for the County. The
County will only be liable for the amount of money actually used
by the program in the two year period.
The County will be liable for any loan to a homeowner that goes
into default. The Prosecuting Attorney will provide the loan
papers for the County to secure from the homeowner as well as an
opinion on the loan program. David Goldsmith will check with the
Auditor's Office regarding the proper form for the resolution to
set up with fund and budget. After further discussion of the
program, the Board directed David Goldsmith to arrange a meeting
with the appropriate representatives from the State Department of
Ecology, to allow further discussion of the terms of this loan.
Shoreline Substantial DeveloDment Permit ApDlication
#SDP90-0002: Placement of Moorina Buoy for Private. Recreational
Use. Mystery Bay. Marrowstone :Island: Neil Berqstrom. Ap~licant:
Jim Pearson, Associate Planner, reported that Neil Bergstrom is
present to discuss his application to place a mooring buoy in
Mystery Bay. This buoy will be placed southeast of the buoy
installed by Charlie smith. This buoy would not intrude on any
other buoy or on any site that an upland property owner may want
to place a buoy.
This application is a primary use of the shoreline and it meets the
criteria of the Master Plan, Jim Pearson added. Commissioner B.~~

Brown moved to approve Shoreline Permit #SDP90-0002 for the
placement of a buoy in Mystery Bay with the conditions of approval
as recommended by the Planning Department. Commissioner Dennison
seconded the motion. The motion carried by a unanimous vote.
A~peal of Shoreline Substantial Development Permit
Exemotion #SDP90-0016: Reoair and Maintain Existina Dock. Pier.
Camp and Access Road: Triton Cove. Hood Canal: Washinaton State
Parks: Steve Dwyer and Mrs. Dwyer (his mother) property owners in
Triton Cove were present when Jim Pearson reviewed this Shoreline
Permit exemption for the Board. Jim Pearson explained that the
Board is being asked to consider an appeal of the Planning
Department's administrative decision to issue a Shoreline Permit
Exemption for this project by the State Parks'Department at an
existing boat launch facility at Triton Cove (near the Mason County
line) which they recently acquired.
There are a number of permit exemptions in the Shoreline Program
which includes one for repair of an existing facility (3.402
paragraph 6 County Shoreline Management Plan and 90.58.030 3 e.i.
R.C.W.). The Washington State Parks, the lead agency on this
project, issued a determination of non-significance for this repair
and maintenance project. Based on the State's SEPA review, the
Planning Department made this administrative decision to issue an
exemption for this project to repair and maintain an existing pier,
ramp and float, repair existing rip rap, and repair an existing
access road to the site. When the property was acquired by the
State Parks it was found that the existing access road encroached
on an adjacent property owner's (Mr. Dwyer) land.
Jim Pearson noted that a letter was received last Friday from steve
Dwyer, asking that the exemption be appealed to the Board. He
further stated that there is no question that there is development
at this site. The question is whether this development is subject
to an exemption from the Shoreline Program because it is repair and
maintenance of the site. If the road couldn't be moved (since it
is not currently on State Park property) the facility would have to
be closed. The regulations allow a permit exeînption for the
activity necessary to rectify this type of situation.
The Prosecuting Attorney has reviewed this matter and feels that in
order for the Board to hear an appeal of an administrative
decision, a public hearing must be held. Since the State is doing
this work currently, a hearing, if it is to be advertised properly,
Jim Pearson continued, would be held after the work is complete.
Chairman George Brown then asked for public comment on this matter.
Steve Dwyer stated that he owns one of the lots in the subdivision
which adjoins this property. He stated that he lives in Edmonds
and is a member of the City Council in Edmonds. He thanked Jim
Pearson for his prompt attention to this request for an appeal.
He then explained that the Triton Cove facility is not operating
currently. The State describes what they are doing as relocating
a road. It is his posi tion that you don't repair a road by
relocating it. The location of the traffic circle for the boat
launch is being relocated onto State property, also.
Mr. Dwyer added that it is his posi tion that this work is not
normal repair and maintenance, it is new work. He urged the Board
to preclude the State from moving forward and doing work until a
hearing can be held.
commissioner B.G. Brown asked Mr. Dwyer how long this encroachment
had been allowed on his parents property? Mr. Dwyer noted that the
encroachment was permitted by the adjacent property owners (his
parents), but that it, was in effect long enough that adverse
possession could have been claimed. The fence is six inches inside
the property line, but the encroachment was many feet beyond that

for the road. Once a year the road was blocked off, so that
adverse possession could not be claimed. The permission to use
this property was granted to the previous property owner, not to
the state, Mr. Dwyer added.
David Heiser, Chief of Environmental Coordinator for the state
Parks and Recreation Commission and John Purcell who did the
environmental work on this site were present. Mr. Heiser stated
that the state has been looking for a boat launch site on Hood
Canal for many years. This site has everything that the state was
looking for in a boat launch facility. Public Health and safety
are the state's main concern. The state is trying to put this·
facility into public use as quickly as possible and is attempting
to do minor improvements before the shrimp season. There have been
minor improvements to the road and to the facility.
Mr. Heiser stated that this is not a new road. (He presented two
pictures taken earlier in the day.) The road is being widened into
an existing lawn area. Approximately one half of the approach
angle to Highway 101 has been lost. They have gone from a narrow
two way roadway to effectively a one way road. Four trees will be
removed (a Forest Practice application was processed for this tree
removal). John Purcell then drew a representation of the site for
the Board. The state intends to operate a first class facility
with on-site management, Mr. Heiser continued. They also intend to
be good neighbors to the adjacent property owners.
John Purcell stated that the state is interested in solving the
problems that they can, for the adjacent property owners, but their
main objective is public health and safety. The re-aligned road is
on state land, but it is still on the right-of-way for the road.
The issue of normal maintenance is defined by the Washington Ad-
ministrative Code and the Shoreline Management Act as work
necessary to correct a "cessation from a lawfully established
condi tion. " If this road is not relocated a cessation from
lawfully established condition will occur.
steve Dwyer replied that he has gone to great pains to only discuss
the proper granting of the exemption. The state's discussion today
was on the merits of the project which is not proper for this
discussion, but would be appropriate at a hearing on the permit.
The State is seeking to increase the use of this site which means
that they do not meet the criteria for the exemption.
The discussion continued regarding the issues of development of the
site and the use of the site.
John Heiser stated that the state has looked at the use of this
site and feel the use will stay approximately the same as it was
with the previous owner. The maximum condition would allow 40 to
80 launchings per day. As far as development, if the adjacent
property owners would have put up their fence last year, the
previous owner would have been faced with the cessation of a
lawfully established condition also. The State is trying to
restore the access to a level that is commensurate with the current
boat ramp which is a single lane ramp.
Commissioner B.G. Brown stated that whether the fence is present or
not, the road had to be moved because the state did not have the
agreement with the adjacent property owner for use of a portion of
their property for a road. Mr. Dwyer stated that when this
proposal was going through the state Parks Commission for con-
sideration, there were other plans presented, but the State choose
to go forward with this plan.
John Purcell stated that on March 20, 1990 a meeting was held with
Mr. Dwyer (the father) and interim measures were discussed. At
that time the property had not been surveyed, but where the
property line was located and the building of a fence were
discussed.

commissioner B. G. Brown stated that it is in the pUblic's best
interest to make the approach the safest one possible. To
accomplish that, the state will have to do what their plan
represents. Commissioner Dennison stated that the question is
whether or not this work meets the intent of the Shoreline Permit
exemption. The only item that is questionable is the additional
parking area that did not exist previously. Jim Pearson stated
that there was an area for parking travel trailers.
Mr. Purcell stated that there are 33 fully developed trailer and
tent hook up sites with an additional area for parking boats and
trailers. The change will be in what type of vehicle is parking on
the site, not in the parking itself.
Mr. Heiser added that the state doesn't want to close a facility
that has been operating for years. They would rather do the
maintenance that is necessary to make the facility operational as
it was previously, and then planning will be done to make the
facility a quality site.

Use. Skow Bay. Killisut Harbor: Wayne Chimenti. ADDlicant: Jim
Pearson reported that this mooring buoy will be placed in Skow Bay.
This buoy is in the same area and will be subj ect to the same
findings and conditions as the buoy for David and Jeannette Lord.
