HEARING reI proÞose~ Budqet ADproDriations/Extensions: Law· &
Justice and Various other ¡De artments: The following persons were
present for the public earing regarding the budget appropria-
tions/extensions requested ~y the Law & Justice Departments and various
other County departments: ¡Sheriff MelMefford, prosecuting Attorney
John Raymond, District cour~ Judge Tom Majhan, District Court Office
Supervisor Sue Dillingham, County Clerk Marianne Walters, Prosecuting
Attorney's Office superviso~ Beryl Thorsen, Assessor Jack Westerman,
Assessor's Office Assessm~ts/operations Manager Jeff Chapman and
Juvenile and Family Court S1rvices Director Lois Smith.
The Board reviewed letter~ from the Prosecuting Attorney and the
District Court Judge rega· ding the justification for use of this
funding. Commissioner Denni on explained that his understanding ~s that
only the requests that appl to criminal justice are appropriate uses
of this funding. John Raymo d stated that the need for this funding was
to improve the law and just'ce system. There is a wide divergence in
the interpretation of how t is funding can be spent.
Commissioner B. G. Brown stated that the Chief Examiner for the state
Auditor's Office, Lee Reave~, advised him that if the funds are spent
on other than criminal just~ce items, the expenditure will be viewed as
a mis-appropriation of fund,.
Chairman George Brown openet the public hearing.
Jack Westerman: Jack Weste man stated that a breakdown was submitted
for each of the amounts that are requested for his office. The increase
in the mileage rate from $. 1 to $.25 per mile, the new appraiser and
the re-evaluation of the Br'nnon area, all added to the need for this
extra funding in 1990.
Commissioner B.G. Brown reported that Lee Reaves has agreed to come here
to discuss what the state ¡ Auditor's Office is going to require as
documentation of expenditurJs from the criminal law and justice funding.

John Raymond added that the I Law and Justice Committee has been working
on this for months as a grqup, and that their documentation should be
enough justification to satisfy the State Auditor.

commissioner B.G. Brown statêd that he feels that all of the requests
are worthy, but the requests for 1990 do not include any new programs.
Mel Mefford added that the Law & Justice committee feels that these
requests are all justified and meet the intent of the legislation.
Commissioner Dennison stated that the Law & Justice organizations across
the state need to work hard to get this'legislation clarified, even if
it means amending it. Chairman George Brown added that the legislation
specifically says it is for new programs.
Mel Mefford asked if the $30,000 that is being requested by the
Sheriff's Office can be carried over if it is not spent this year?
Commissioner B. G. Brown answered that this funding will stay in a
special fund until it is spent.
Hearing no further comments, the Chairman closed the hearing. Commis-
sioner Dennison moved to table action on the budget appropriation/exten-
sion requests to allow time for further clarification of the legisla-
tion. commissioner B.G. Brown seconded the motion which carried by a
unanimous vote.
BUSINESS FROM COUNTY DEPARTMENTS:
PUBLIC WORKS
Revisina county Road Proiects: CR"S12 Oak Bav Road: Public Works
Construction Engineer Bruce Laurie reported that the budget for the Oak
Bay Road project will be reduced by about $7,000. This resolution will
update the project to its current status. Commissioner Dennison moved
to approve Resolution No. 101-90 revising CRØ812 for the Oak Bay Road
Project. Commissioner B.G. Brown seconded the motion which carried by
a unanimous vote.
Chanainq county Road Name: Beach Drive to Beach Lane. Oak Bay
Waterfront Tracts: Traffic Engineering Technician Bob Henderson
reported that there are currently two roads on the County Road Log named
Beach Drive, one is a County road and one is a private road. The
private road named Beach Drive could be renamed Beach Lane. No one
lives on this road and it is not in a plat. Commissioner B.G. Brown
suggested that Bob Henderson check with the Deputy Prosecuting Attorney
regarding the need for a public hearing on this name change.
Bearina Notice reI Intent to change Road Names: Alcohol LOOD Road
and Georae Street: KUhnsville Plat: Bob Henderson stated that he has
discussed this proposed change in street names with all of the people
that Ii ve in this area. commissioner B. G. Brown moved to set the
hearing for the change of road names in the Kuhnsville Plat on November
5, 1990 at 10:30 a.m. Commissioner Dennison seconded the motion which
carried by a unanimous vote.''''
Withdrawal of Road Franchise Application: Gary Bandy (Gardiner
Beach Road): Letter fromCraiq A. Ritchie. Attorney: Administrative
Secretary Eileen Simon reported that a letter has been received from Mr.
Bandy's Attorney aSking that his franchise application be withdrawn.
Bob Henderson stated that all of the conditions for the permit were met
by Mr. Bandy and it has been issued. Commissioner B.G. Brown moved to
take the matter of the Bandy franchise off the table. Commissioner
Dennison seconded the motion .which carried by a unanimous vote.
Commissioner B.G. Brown then moved to approve the request for withdrawal
of the Bandy franchise application. commissioner Dennison seconded the
motion which carried by a unanimous vote.

Memo reI No Huntinq on DNa Gibbs/Beausite Lake Property: Parks
Advisory Board: There are many people that use this area as well as
people that live in the area and that is why the Parks Advisory Board
is concerned that "No Hunting" signs be posted on this property, Eileen
Simon reported. Sheriff Mel Mefford reported that this area has been
used for hunting in the past.
Planning and Programs Manager Carter Breskin reported that all DNR
property is available for hunters to use. Chairman Brown asked how much
of the 600 acres would be posted as no hunting? Carter Breskin stated
that the whole piece of property would be posted. Chairman Brown stated
that he has seen the "No Hunting" signs posted around the houses in this
area, but not on the rest of the property. Hunting season opens this
Saturday.
. Commissioner B.G. Brown stated that the area where the people live
should be posted with "No Hunting" signs to help make it more safe for
the residents, but hunting can be allowed on the rest of the property.
The DNR turned the control of the land over to the County which means
the County should have the authority to post these signs. Carter
Breskin will check the terms of the agreement with the DNR.
Discussion of Use of County Roads for Filminq Television Commer-
cials: Bob Henderson reviewed the State guidelines for using State
roads for filming television commercials. When a filming company
submitted an application to the County these guidelines were used. The
film company has stated that vehicle delays would be kept to five
minutes at the maximum. On occasion the delays have extended to 10
minutes. A notice was published in the paper the last time filming was
done to warn the public that there may be traffic delays on several
County roads. The filming company will pay for the publication of the
notice. A permit fee could be charged to cover the staff time required
to review these applications. Other counties charge fees for this type
of permit that range from nothing to $50.00.
commissioner Dennison stated that the Beaver Valley Road is one of the
most highly travelled roads in the county and it is the main road to the
ferry. Bob Henderson suggested that filming could be prohibited on
major arterial roads in the County. Commissioner B.G. Brown noted that
he doesn't like the publication naming eight roads when the company only
actually 'uses one or two of the roads.
The Board concurred that these requests be restricted to secondary roads
whenever possible. A $25.00 fee can be charged under the use of county
road right-of-way general permit category.
PLANNING AND BUILDING
Final Garten View Short Plat #SP16-90: 3 Lot Residential Sub-
division: Shine: Robert L. Garten: Associate Planner Jerry smith
reported that this final approval is for the three lot, residential,
Garten View short plat in Shine. The plat access is off Old Shine Road.
All necessary departments have approved this short plat and it meets all
of the short plat requirements.
commissioner B.G. Brown moved to issue final approval of the Garten View
Short Plat #SP16-90 as presented. Commissioner Dennison seconded the
motion which carried by a unanimous vote.
Final Bruneau Short Plat #SP9-89: 4 Lot Subdivision: Port
Hadlock: Tom Bruneau: The Bruneau Short Plat is a four lot short plat
in the Port Hadlock area off of Ness' Corner Road. All short plat
requirements have been met, Jerry Smith reported. Commissioner Dennison
moved to approve the final short plat as presented. Commissioner B. G.
Brown seconded the motion which carried by a unanimous vote.

Bearinq Notice reI Emeraencv Exce~tion for a TemDorary Gravel
crushinq operation in Brinnon: puaet Sound Surfacers: Jerry Smith
reported that a hearing is required to ~ determine if an emergency
exception from the Development Code should be granted for a temporary
gravel crushing operation to be located in a gravel pit on Highway 101
next to the Bayshore Motel (Brinnon Senior center).
commissioner B.G. Brown moved to approve the hearing notice setting the
hearing for October 22, 1990 at 2:30 p.m. Commissioner Dennison
seconded the motion which carried by a unanimous vote.
CONTRACT #001-90 reI Consultant for the Initial Watershed Charac-
terization and Draft Water Quality Assessment ReDort: David Evans and
Associates. Inc.: Water Quality Technician Teresa Barron reviewed the
contract with David Evans and Associates for preparation of the
watershed characterization for the Ludlow watershed. David Evans and
Associates will do more work for the amount of funding than any of the
consultants interviewed. The contract is for $9,000.00.
commissioner B.G. Brown moved to approve the Professional Services
Contract with David Evans and Associates contingent on approval of the
Prosecuting Attorney. Commissioner Dennison seconded the motion which
carried by a unanimous vote.

ADOPTION AND APPROVAL OF THE CONSENT AGENDA: Commissioner B. G.
Brown moved to adopt and approve the following items on the consent
agenda:
1. AGREEMENT re: Management of the First Floor of the Port Townsend
Community center; Port Townsend Senior Center Association
2. CONTRACT #3430-80421 re: $5,800.00 in Funding for Assessment, Treat-
ment, Monitoring and Supervision of Juvenile Sex Offenders by the
Juvenile Services Department; state Department of Social and Health
Services
commissioner Dennison seconded the motion which carried by a unanimous
vote.
APPROVAL OF XINUTES: The minutes of September 10, and October
1, 1990 were approved as read and the minutes of September 17, and 24,
1990 were approved a.s corrected by motion of Commissioner B. G.Brown,
seconded by Commissioner Dennison. The motion carried by a unanimous
