WEEK OF OCTOBER 22, 1990
Chairman George C. Brown called the meeting to order at the
appointed time. commissioner B. G. Brown and Commissioner Larry W.
Dennison were both present. The Board then met in executive session
regarding a personnel matter with Deputy Prosecuting Attorney Mark Huth
and Assessor Jack Westerman before starting their regular meeting.
BUSINESS FROM COUNTY DEPARTMENTS
PUBLIC WORKS
AGREEMENT. Su~~lement #3: Enaineerina Services CR'S79 (Beaver
valley South). CRØ811 (Beaver Valley North). CRø812 (Oak Bay Rd.). and
CRø813 (Beaver valley/Swansonville intersection): Parametrix. Inc.:
Public Works Construction Engineer Bruce Laurie explained that this
agreement covers engineering services for four projects. This update
provides for additional construction staking work for the Oak Bay Road
Project. Due to this addition and some other minor changes the overall
agreement costs have been reduced by approximately $5,700.00.
Commissioner B.G. Brown moved to approve Supplement #2 for the agreement
with Parametrix, Inc. as submitted. Commissioner Dennison seconded the
motion which carried by a unanimous vote.
Intent to Enter Into Inter local Agreements: To Join the Southwest
Washinqton Inter-County solid Waste Advisory Board AND AGREEMENT.
Interlocal re: Addina Jefferson County to the Southwest Washinaton
Inter-County Solid Waste Advisory Board (SWICSWAB): cowlitz. Grays
Harbor. Lewis. Mason. Thurston and Wahkiakum Counties: Environmental
Planner Jeff Frettingham reported that seven counties have formed a
consortium to study solid waste management (collection and disposal) on
a regional basis. The scope of work includes doing a study of existing
solid waste management systems in each county and to establish common
goals to allow development of a plan for the region. There is a State
Department of Ecology grant for this project and it will be amended to
include Jefferson County. The county's share for Phase I is ap-
proximately $1,444.00.
Commissioner B.G. Brown moved to approve and sign Resolution No. 103-
90 stating Jefferson County's intent to join into the Southwest
Washington Inter-County Solid Waste Advisory Board and to approve the
Interlocal agreement with that advisory board as presented. Commis-
sioner Dennison seconded the motion which carried by a unanimous vote.

Establishina the Name for a Private Road: McNeil Road: McNeil
Road is located near Gibbs Lake Road, Administrative Assistant Eileen
Simon reported. The name, McNeil Road, is not in conflict with any
other county road name.
Commissioner B.G. Brown moved to approve Resolution No. 104-90 es-
tablishing the private road name of McNeil Road. Commissioner Dennison
seconded the motion which carried bya unanimous vote.
FACILITIES XANAGEHENT
Re-aDDointment of Members of the Parks Advisorv Board: Planning
and Programs Manager, Carter Breskin, reported that Larry Scott and Rick
Tollefson are each willing to serve another three year term on the Parks
Advisory Board. Commissioner Dennison moved to re-appoint Rick
Tollefson and Larry Scott to another term as recommended. Commissioner
B.G. Brown seconded the motion. The motion carried by a unanimous vote.
AdoDtion of Jefferson County Parks Advisory Board By-Laws: The
request has been made that the Parks Advisory Board membership be
increased to nine members so that there is equal representation on the
Board from each Commissioner's District. This change is reflected ~n
this By-Laws revision, Carter Breskin reported. :

Commissioner Dennison expressed concern that there seems to be a publ~c
misunderstanding about the Board's approval, in concept, of the Parks
Advisory Board's plan for dealing with the 1% Excise Tax Initiative ~f
it is passed in November. (See Minutes of October 1, 1990). cart~r
Breskin stated that a Parks Board meeting should be called to find oµt
how the members feel about this issue and the Board should explain the¡ir
position to them. .

Commissioner Dennison stated that people feel that action has been tak~n
by the Board before the initiative passes which may indicate how t~e
funding will be spent. Now, steps need to be taken to make sure th~t
it is understood that the Board is not attempting to undermine anyon~.
Carter Breskin reported that there was a definite process that the par~s
Board went through before making their recommendation to the Boarki.
Commissioner B.G. Brown reminded everyone that the Parks Board does not
have the final say on how this funding would be spent. They only ma~e
a recommendation. Carter Breskin volunteered to call a meeting of the
Parks Board to discuss this issue further. i

Commissioner Dennison moved to adopt the revised By-Laws for the par~s
Advisory Board to reflect the expansion of the Board to nine membe~s
with three from each Commissioner District. Commissioner B.G. BroWn
seconded the motion which carried by a unanimous vote.
PLANNING AND BUILDING
Final Jakum-McKay Short Plat SP5-89: North of Hiahway 104 , Teal
Lake Drive: Frank , Diana Jakum and John McKav: This is a re-plat ¡of
an existing lot in the Huckleberry Hill Plat, Associate Planner Je~ry
smith reported. There are two lots in this short plat. Access to one

Jerry Smith reviewed the comments received on the Teal Lake Village
Subdivision. ;
State Department of Ecoloqv expressed concern that it appears a
wetland area will be used for containment of stormwater runoff.
Stormwater must be treated before discharge. They feel that this
plan is not consistent wi th ~tate WAC. They asked that storm
drains be marked wi th the wording "Dump No Waste, Drains to
stream". The Planning Department staff feels that Mitigative
Measures #2 and #3 address these DOE concerns.
Fire District #3 in Port Ludlow feels that there should be improve-
ments to Teal Lake Road. They advised that because of the
condition of this road they wo~ld not use it for emergency vehicle
response.
State Department of Fisheries ~s concerned about the water quality
of the Bay and have advised that a hydraulic project approval is
required for stormwater entering the bay. Jerry Smith reported
that mitigative measures #2 and #3 already address this issue.
Jerry smith added that he will, contact these agencies as well as
David Cunningham of Pope Resources regarding these comments.
The Planning Commission has reviewed the preliminary plat and have maae
a recommendation that it be approved, however, the staff is having
trouble getting the findings and conclusions and recommendation ready
for the Board. RCW requires that the planning Commission recommendatiþn
be brought before the Board withip 14 days. Jerry smith then submittþd
the Planning commission recommendation for preliminary plat approv~l
with conditions.· I

The Board directed Jerry Smith to prepare the findings and conclusioþs
of the Planning commission and. to contact the State Department bf
Ecology and Fisheries and Fire District #3 regarding their comments and
bring this matter back before them on November 5, 1990. ¡

Sam Swanson, Planning commission Chairman, stated that the Planniþg
Commission, during their review, ,expressed concern for the impact th~t
this project will have on Teal ~ake Road. They were also concerned
about who would be responsible ,for improvements made to this roa~.
Another concern was regarding the roads within the plat which end 250
feet from the last lot to be accessed. !

reported that this hearing is to ;take comments on allowing puget So~nd
Surfacers to temporarily operate¡ a gravel crushing operation for al 3
week period sometime between November 1, 1990 and June 1, 1991,at the
intersection of Highway 101 and Dosewallips Road. !

The Planning Department recommends that: 1) the three week period ¡of
time be defined, 2) limits be pl~ced on noise levels, and 3) that ~he
hours of operation be limited. I

Chairman George Brown opened the hearing for public comment. !

Sam Boling: Sam Boling stated that his brother has owned this gravel ~it
for 25 years and they own the only home near the site.

Mike Shaw, puget Sound Surfacers, stated that he has no problem with ~he
recommendations made by the Planning Department. He would rather Ibe
allowed to give notice before they start work at the site, than have ¡to
state a more specific three week time frame. He noted that they w~ll

either be working in November or in the spring. commissioner B. G.
Brown noted that if the November deadline can't be met then Mr. Shaw
should notify the county of the alternate date. He then reminded Mr.
Shaw that the operation must meet the State noise standards.

Jerry smith suggested operating hours of 7 a.m. to 6 p.m. Commission~r
Dennison moved to grant an emergency exception for puget Sound Surfacers
to operate a rock crusher in Brinnon as recommended. Commissioner B.~.

Review and ADDrove Revised Schedule for Subdivision Ordinance
Draft: Senior Planner, craig Ward, submitted a tentative Planni~g
commission schedule outlining their work for the next two months. ~e
asked that the Board extend the interim subdivision ordinance f¢>r
another 30 days to allow time for the Planning commission to develoþ,
review, hold a public hearing, revise and submit a final draft of t~e
ordinance to the Board for consideration. I
Commissioner Dennison stated that the Planning commission may need mote
time to do this work and keep up wi th their normal workload apd
suggested that a longer extension. be granted. i

Commissioner Dennison moved to extend the interim subdivision ordinance
guidelines for 60 days beyond their expiration. commissioner B.G. Broþ
seconded the motion which carried by a unanimous vote. I

CONTRACT #G0091042 reI offshore oil Drilling ImDact to CO~-
munities: Ocean Resource Management Act Grant: state DeDartment þf
Ecoloçrv: Jefferson County is eligible for $13,500.00 in grant funding
from the State Department of Ecology during 1991 for studying the
impacts of proposed offshore oil drilling, Planning and Buildipg
Director, David Goldsmith reported. Commissioner B.G. Brown moved ~o
approve the contract for the Ocean Resource Management Act Grant ~s
presented. Commissioner Dennison seconded the motion which carried þy
a unanimous vote. I

CONTRACT reI Growth Manaaement Act Fundina: state Department þf
community DeveloDment: The approval of this contract means that tþe
county will meet the provisions of the state's new Growth Managemeþt
Act. The first two quarterly allocations ($52,000.00) from HB2929 a;re
now available to the County, David Goldsmith reported. Commissioner
Dennison moved to approve and sign the grant contract with the Sta~e
Department of Community Development as submitted. Commissioner B.G.
Brown seconded. The motion carried by a unanimous vote.

Forest Shomer and Others reI puaet Power Company's Uerbiciðe
sDrayina proaram: Forest Shomer and three other interested area
residents came before the Board to discuss puget Power Company's plaþs
to spray herbicides on 30 miles of County road rights-of-way. I

Public Works Director Gary Rowe reported that puget Power will !be
applying herbicides to portions of County Road rights-of-way to prevent
re-sprout on stumps that have been treated previously. The herbicide
is not sprayed from a truck, it is sprayed from a backpack carried by
workers. The Public Works Department has reviewed their plan to assu~e
that they were doing the minimal amount of spraying possible. I

Forest Shomer stated that puget Power is using a herbicide that has been
approved for use on several college campus's. He questioned if this lis
a good time of year to apply this herbicide? He added that if it raips
after an application this herbicide could get into the ground wate'r.
He also stated that treating plants this time of year may not be ¡as
effective as treatments when the trees are in leaf.

Chairman Brown stated that he attended a presentation by Puget Power
regarding this program and they explained that they are only treating

stumps to prevent re-sprout in areas under power lines where they have
previously cut trees. Gary Rowe reported that this treatment is do~e
in conjunction with puget Power's tree trimming program on a five year
cycle. '

Forest Shomer reported that the notice in the newspaper stated that they
would be spraying stumps along Hastings Avenue. He is currently
collecting seeds for the Airport re-vegetation project and one of the
areas that he is designated to collect seeds is on Hastings Avenue. I

Avian Thibault added that she is highly sensitive to chemicals and she
is alarmed because she rides her bicycle to work every day along
Hastings Avenue. Forest Shomer asked that a mailer be sent to people
who live in the area proposed for spraying. Many people are used to
being able to pick berries and plants along the road sides. i
I
Gary Rowe reported that one of the requirements of the Puget pow~r
permit is the use of manual vegetation management around a residence of
a person who has a sensitivity to chemicals or a health problem. This
does not help in the case of someone riding by a roadside such as MS.
Thibault described. puget Power is operating under a 25 year franchi$e
for the use of County road rights-of-way and the County can approve
their maintenance practices as part of the franchise terms. :

Commissioner Dennison stated that right now the County is maintaini~g
vegetation on county road rights-of-way manually. He asked if the
County couldn't contract with puget Power to do the maintenance th~t
they require? Gary Rowe reported that the maintenance that the County
does meets a different need than that performed by Puget Power. Commis-
sioner Dennison added that this may be an alternative to look at in t~e
future. I

Forest Shomer suggested that puget Power be asked to 1) notify residents
who live in the specific locality where the spraying will be done, ~)
provide figures comparing the cost of mechanical vegetation management
versus spraying, 3) try girdling the trees to kill them, and 4) use t~e
tree stumps as a resource for firewood. Forest Shomer stated that t~e
need to spray in an emergency is something he can understand, but t*e
county having a policy that allows spraying is what he objects t<¡>.
Commissioner Dennison stated that the County set a policy in 1980 th~t
vegetation management on County road rights-of-way will not include
spraying herbicides.

In response to a question about when this year's program will be start~d
and where the spraying will be done specifically, Gary Rowe reported
that puget Power has already contracted the work for this year' s
program. The newspaper article listed Puget Power's phone number as
well as the Public Works Department's number, so that people who are
sensitive to this spray can call to find out where it will be don~.
Commissioner Dennison asked that puget Power be contacted to direct them
to notify, possibly through a mailing, the people in the area where they
will be spraying. Gary Rowe added that puget Power has stated that th~y
will honor "no spray" signs on private property. They are still
responsible, however, for maintaining the right-of-way in these area,.
Commissioner Dennison asked about monitoring? Gary Rowe stated that t~e
only monitoring done by Public Works will be verification that they are
doing what they said they would do. There is no monitoring of the spr~y
itself. !

Preliminary Budget submitted by the Planning Department. The meeting
was reconvened on Tuesday morning with all three Board members presen1j;..
