Brown in the presence of Commissioner B. G. Brown and commissioner Larry W. Dennison. The Board went immediately into an Executive Session with Planning & Building Department Director David Goldsmith and Deputy Prosecuting Attorney, Mark Huth regarding possible litigation. APPROVAL AND ADOP~ION OF HE CONSENT AGENDA: commissioner B.G. Brown moved to adopt and approve the items on the consent agenda as . submitted. Commissioner Dennison seconded the motion which carried by a unanimous vote. .. 1. CONTRACT re: Professional Services; Oral Consultant for the Primary Care Dental Program at the Health Department; Cynthia S. Newman, R.D.H. 2. CONTRACT re: Professional Services; Dentist for the primary Dental Care Program at the Health Department; K. Ben Skerbeck, D.D.S. 3. CONTRACT #1620-00731 re: Consolidated Health Department Services; State Department of Health CO~RAC~ Amendment No. 1445-74479 (1) re: Human Services community prevention/Early Intervention Proqrams: state Department of social and Heal th Services: commissioner B. G. Brown moved to approve contract amendment #1 for the Prevention/Early Intervention Program of the Human Services Department with the State Department of Social and Heal th Services. commissioner Dennison seconded motion which carried by a unanimous vote. Amendment #1 re: Human Services community Mobilization Against Substance Abuse proqram Year 1990-1991: state Department of community Development: Contract Amendment #1 for the MObilization Against Substance Abuse Program funding for the Human Services Department from the State Department of community Development _ was approved by motion of Commissioner B. G. Brown and seconded by Commissioner Dennison. The motion carried by a unanimous vote. .vat lGj"t~Œ 00 931 Commissioners' Meeting Minutes: Week of November 26, 1990 Page: 2 BUSINESS FROM COUNTY DEPAR~S: PUBLIC WOUS PROCLAHA~ION OF EH~GENCY: Flood Damaqe from ~hanksqivinçr storm: West End: County Engineer Bob Nesbitt reported on the flood damage in the West End from the Thanksgiving storm and asked the Board to proclaim an emergency to allow the department to deal with this situation. Commissioner Dennison moved to approve and sign Resolution No. 112-90 to proclaim an emergency in the West End of Jefferson County due to the flooding. Commissioner B.G. Brown seconded the motion which carried by a unanimous vote. AGREEKEN'r reI ~emoorarY Helo: Karen Bailey: Public Works Construction Engineer Bruce Laurie reported that this agreement will allow Karen Bailey to work as a Technician II for the Public Works Department for the next 90 days. Commissioner B.G. Brown stated that the issues raised by the Union need to be reviewed before this agreement is approved. Later in the Dav: Commissioner B. G. Brown moved to approve and have the Chairman sign the temporary help agreement with Karen Bailey effective to December 31, 1990. Commissioner Dennison seconded the motion which carried by a unanimous vote. HEARING NO~ICE: Annual Road construction proaram: commissioner' Dennison moved to approve the hearing notice setting the hearing for the annual construction program for December 3, 1990 at 10:45 a.m. Commissioner B.G. Brown seconded the motion which carried by a unanimous vote. Aporove and siqn Riqht-of-wav Plans: Beaver valley Road projects CR0579 and CR0S11: Bruce Laurie reported that it is anticipated that right-of-way costs for these projects will be approximately $15,000.00 (including acquisition). Commissioner B.G. Brown moved to have the Chairman sign the right-of-way plans for CRØ579 and CRØ811 (the Beaver Valley Road projects) as presented. Commissioner Dennison seconded the motion which carried by a unanimous vote. Bstablishinq a Name for a Private Road: Heron Court: Kala Point: Traffic Engineering Technician Bob Henderson reported that this road is just off of Sail view Drive in Kala Point. There is already a road named Blue Heron Drive in the County. The Board directed the Public Works Department to ask the applicant to suggest another name. Establishinq a Name for a Private Road: ~setsibus Drive: Bob Henderson reported that Phil Broms has suggested the name Tsetsibus Drive for this private road that takes off of George street near the Alcohol Loop Road. Commissioner Dennison moved to approve and sign Resolution No. 113-90 establishing this private road name as requested. Commissioner B.G. Brown seconded the motion which carried by a unanimous vote. ~emporary Restriction of ~raffic on ~eal Lake Road: Public Works Transportation Planner Scott Kilmer reported that this temporary road closure is being requested to allow pope Resources to install water line (about 6,000 feet) on the portion of Teal Lake Road from milepost 0.14 to 1.48. The road needs to be closed for this work because it is narrow and the crew will be working on the shoulder of the road. This closure would be effective December 3 through 20, 1990, Monday through Friday, from 7 a.m. to 5 p.m. No one lives on this section of the road and alternate routes are available. Brown moved to approve Resolution No. authorizing the temporary restriction of traffic on Teal Lake proposed for installation of a water line. commissioner seconded the motion which carried by a unanimous vote. 114-90 Road as Dennison PLANNING AND BUILDING Final Plat Aooroval: Kala ~errace: 1 Commercial and 20 Residential Lot Subdivision: Kala Point: Kala Point Development company: Associate Planner Jerry smith reported that all of the conditions for preliminary plat approval for this sUbdivision have been met. The Planning commission has reviewed this plat and recommends fin~l approval. Commissioner B.G. Brown moved to adopt the findings of fact and Planning Commission recommendation and approve the final plat of Kala Terrace. Commissioner Dennison seconded the motion which carried by a unanimous vote. State Environmental Policy Act Review and Threshold Determination re: SDP#90-0013 Construct Dock. Ram'Ç)s and pier in Common with a single Family Residence: Fred MCLauqhlin: Associate Planner Jim Pearson reviewed this proposal to construct a 50 foot by 9 foot dock teeing into a pier and ramp connecting it to the shoreline, in the Port Ludlow Inner Harbor area. This lot is one of the Inner Harbor lots that is allowed to have a dock (as outlined in SDP88-0016). The proponent, Jim Pearson continued, is requesting a variance from the performance standard that allows a maximum six foot wide dock. A three foot variance is being requested. The environmental checklist was then reviewed. This area is designated as a 'critical water habitat in the Coastal Zone Atlas. No mitigative measures are proposed by the Planning Department staff for this permit. The Shoreline Commission will review this permit. commissioner Dennison moved to issue a determination of non-significance and lead agency status on shoreline permit #90-0013. Commissioner B.G. Brown seconded the motion which carried by a unanimous vote. HEARING re: Preliminary Plat Aoproval: ~eal Lake villaqe: 111 Lot single Family Detached Residential Housinq Subdivision. Clustered Lots with 23 Acres Open Soace: South Paradise Bay Road abuttinq ~eal Lake Road: Pooe Resources: Seven interested a~ea residents were present when Associate Planner Jerry smith reviewed th~ preliminary Teal Lake Village Plat. He reported that when the Planning commission recommendation on this plat was presented to the Board (See also Minutes of November 5, 1990) there was discussion of conditions #14, which requires that a traffic impact evaluation be prepared, and condition #15, which requires that road improvements and a pedestrian pathway from Paradise Bay Road to the entrance of the subdivision, b~ provided by Pope Resources. Since the Board suggested a change to Condition #15 a public hearing was required and has been advertised. No cbmments have been received on this project. The Board is required to establish their own findings of fact for the basis of any decision made today. Chairman Brown opened the public hearing for comments for or against this proposed preliminary plat. David Cunninqham stated that a mitigated determination of non- significance was issued with a condition that a traffic impact study be done for Teal Lake Road to determine w~at effect the Pope Resources projects are going to have on it. After that the Planning Commission added a condition that requires Pope Resources to pay for road improvements and a pedestrian pathway on Teal Lake Road from Paradise Bay Road to the subdivision. This condition negates the meaning of the ~ VOL 16 fAŒ 00 93'3 .. commissioners' Meeting Minutes: Week of,November 26, 1990 Page: 4 condition requiring a traffic impact study because it would make pope Resources pay 100% of any improvements heeded to that portion of the road. Marv McLure stated that she lives on Paradise Bay Road. She asked how much of Teal Lake Road would be studied?: David Cunningham stated that the traffic impact study will be done on the whole length of Teal Lake Road (from Paradise Bay Road to state Highway 104). Being no further comments, the Chairman closed the public hearing. commissioner Dennison suggested that condition #15 be changed after the first sentence, to say: "A proportionateishare of road improvements and pedestrian pathway shall be provided by ~he applicant from Paradise Bay Road to the entrance to the subdivision based on the traffic impact evaluation (See Condition #14)." ! Commissioner Dennison moved tò approve thb preliminary plat of Teal Lake Village with the findings of fact and c9nclusions as presented by the Planning Commission with the exception 'of mitigative measure #15 as noted. David cunningham noted that there is an internal issue regarding pedestrian pathways. Pedestrian pathw~y are not part of the County comprehensive Plan or updated Trails Plan for the Teal Lake Road. All pedestrian pathways are planned to be internal to the specific project. commissioner Dennison added that the words "pedestrian pathway" be struck from the motion. commissioner B~G. Brown seconded the revised motion. The motion carried by a unanimous vote. commissioner Dennison questioned the need for this public hearing since the Planning commission review of this 'plat included more than their charge of assurance that the projeqt conforms with the County Comprehensive Plan? Deputy prosecuting Attorney Mark Huth stated that since the planning commission is an aðvisory board, if they make a recommendation that concerns an item that is not within the scope of their review, then a public hearing does not need to be held. Final Plat AO'Ç)roval: One Hawkeve Park: 43 Lot Mobile Home 'Subdivision: Discovery Road. 1/2 Mile East of Port ~ownsend city Limits: Bruce Seton: (Formerly referred to as ~he Glen Cove Mobile Home Park) Jerry smith reviewed this 43 lot mol;>ile home subdivision on Old Discovery Road. The Planning Commission found that all conditions of the preliminary plat have been met and ~ecommend final plat approval. commissioner B.G. Brown asked if the conditions on the permit to open public road right-of-way have been met? One condition required that an agreement be negotiated between Mr. Seton and the neighboring property owners to pay compensation for !timber taken off the right-of- I way. Sharon southard reported that she owns the adjacent property to this site. They have closed off the right';'of-way, but she has not been approached by Mr. Seton about compensation for timber removed from the right-of-way. Jon Addison, representing Bruce Seton, . stated that he discussed this issue with Mr. Seton, who reported that the value of the timber removed from this right-of-way did not cover the cost of removing it. Mr. Addison stated that this matter would bave been taken care of before today if he had realized the issue needed to be resolved before final plat approval would be issued. * * * t VOl 16 rA~~ 00 9311 "'E.. Commissioner B. G. Brown seconded th~ motion which carried by a unanimous vote. AGREEMENT #90-10-12 re: Human Seryices Youth Services Proqram for Brinnon and Quilcene: Jefferson county. Fire Protection District #2 : Commissioner Dennison moved to approve ~nd have the Chaìrman sign the agreement between the Human Services D$partment and Jefferson county Fire District #2 for youth services in the Brinnon/Quilcene area. The agreement term is from November 20, 1990 to June 30, 1991. Commissioner B. G. Brown seconded the motion which carried by a unanimous vote. APPROVAL OF MINU~ES: The minutes! of October 8, 15, 22, November 5, 13 and 19, 1990 were approved as corrected by motion of Commissioner B. G. Brown, seconded by Commissioner Dennison.
