Dennison were both present; The Board met in executive session with Deputy Prosecuting Attorney Mark Huth and Assessor Jack Westerman at 10:00 a.m. BUSINESS FROM COUNTY DEPARTMENTS: PUBLIC WORKS Application to Open County Road Ri2ht-of- Way; Widen and Improve East Middlepoint Road; Tom Beavers. Applicant: Transportation Planner Scott Kilmer explained that this request to open County road right-of-way is for improvements to East Middlepoint Road which are required as a part of a large lot subdivision which Tom Beavers is planning to develop in this area. Commissioner Dennison asked if Mr. Beavers would be willing to provide assurance in some form acceptable to the County for this road work in lieu of actually doing the work before the environmental review is done on the large lot subdivision application? Mr. Beavers stated that he is only making this request so that he can have the approval of the Public Works Department on his plans for the large lot subdivision, as required by the large lot subdivision regulations. The discussion turned to the best way to handle this application so that the concerns of the area residents and the needs of the project proponent can be met. Tom Beavers asked that the County approve this application in concept until the whole project is approved, so that he can follow the County regulations to submit his application for a large lot subdivision. Mr. Beavers stated that he is filing a Forest Practices application for his property . Commissioner B.G. Brown moved to approve the application to open right-of-way with the conditions as recommended and an additional condition that security will be provided by Mr. Beavers for the road improvement work, but that the work will not be started until the large lot subdivision receives final approval. Commissioner Dennison seconded the motion which carried by a unanimous vote. YrJ. 16rAG&.DO-. . 980 Commissioners Meeting Minutes: Week of December 24, 1990 Page: 2 Claim for Damaees #C-09-90; Molly Burton: After review, Jeff Frettingham reported, the recommendation from the Risk Manager and the Prosecuting Attorney, is that the claim submitted by Molly Burton of Aberdeen be paid in the amount of $500.64. Commissioner B.G. Brown moved to approve payment of the claim as recommended. Commissioner Dennison seconded the motion which carried by a unanimous vote. License to Open County Road Rieht of Way; Construct a Landine for a Beach Access Stairway; Shine Road; David Stroud: This license to use County road right-of-way will allow David Stroud to construct a landing for a beach access stairway on the southerly 15 feet of the 60 foot Shine Road right-of-way, the Clerk of the Board explained. This license is a condition of approval of a Shoreline Permit Exemption (#XMP90-0057) applied for by Mr. Stroud. The Prosecuting Attorney has reviewed and signed this license. Commissioner B.G. Brown moved to approve the license as recommended. Commissioner Dennison seconded the motion. The motion carried by a unanimous vote. Hearine Notice re: Updatine Solid Waste Fee Ordinance No. lA-89: After review and discussion of the proposed hearing notice for updating the Solid Waste Fee scheduled, the Board asked that it be redone and submitted at a later date. PLANNING AND BUILDING HEARING re; Plat Amendment. Roose Short Plat (SP17-89); Relocatine a Portion of Platted Common Access Easement; 20 Miles Southeast of Port Townsend Adjacent to Hiehway 104 (Shine Area); Donald Roose: Associate Planner Jerry Smith explained that a 40 foot right-of-way access easement is shared by two adjacent short plats - the House Short Plat and the Roose Short Plat. This amendment to the Roose short plat is being requested to relocate the access easement. This relocation is necessary because the access easement, as declared on the plat, is encroached on by an existing garage. Karen Gates-Hildt, Attorney, representing the owners (Bob and Christine Nokes) of Lots 1 and 2 of the House Short Plat was present. Jerry Smith reported that the access easement will be relocated on a portion of their property. Commissioner B.G. Brown and Commissioner Dennison both stated that the County cannot grant an easement on property that the County does not own. Commissioner Dennison noted that this hearing should be held after the easements are granted from all the property owners involved. Karen Gates-Hildt stated that the Nokes' may agree to working this out with the other property owners. . State Environmental Policy Act Review and Threshold Determination; Shoreline Permit #SDP90-0014 Construction of a Dock; Pleasant Harbor; Lee Zieeler: Jim Pearson, Associate Planner, reported that Lee Ziegler is proposing to build a 60 x 60 foot dock, for private, non-commercial use, on Lot 1 of Pleasant Harbor Tracts. A piling would be driven 20 feet from each end of the dock to facilitate docking of vessels longer than 60 feet. On November 5, 1990 a similar proposal was reviewed for Clifford Center on Lot 3 of Pleasant Harbor Tracts. A determination of non significance was issued on that proposal which can be applied to this project. The question of eel grass in the area was discussed and Jim Pearson reported that the State Department of Fisheries will address any such problem. They have the authority to deny the project if there is an impact to eel grass that cannot be mitigated, before the Hydraulic permit is issued. Commissioner B. G. Brown moved to adopt the existing Determination of Non Significance issued to Clifford Center for the Ziegler project. '" Commissioners Meeting Minutes: Week of December 24, 1990 Page: 3 Request To Exclude Applicants' Property From Terms of Resolution No. 69-83; Property Frontine on By-Water Bay between Hood Head and the Hood Canal Bridee; Providine Demonstration and Assurance of Slope Stability; Steve and Maree Wakefield. Paradise Bay Road: Jerry Smith reported that this is a request to exclude an eight acre parcel of property from the County's resolution that declares a moratorium on development in the Termination Point area due to slide conditions, from Steve and Marge Wakefield. The Wakefield's are going to develop a short subdivision on this property. Action was tabled on this request on Dec$mber 10, 1990 to allow time for more specific wording to be developed on the conditions of approval. Jerry Smith presented and reviewed a draft resolution which lists more specific conditions. Commissioner B.. G. Brown moved to bring this request off the table. Commissioner Dennison seconded the motion which carried by a unanimous vote. Commissioner B.G. Brown then moved to approve RESOLUTION NO. 119-90 with the conditions and the geologist report attached. Commissioner Dennison seconded the motion. The motion carried by a unanimous vote. *** ADOPTION AND APPROVAL OF THE CONSENT AGENDA: Commissioner B.G. Brown moved to adopt and approve the consent agenda as presented. Commissioner Dennison seconded the motion which carried by a unanimous vote. 1. RESOLUTION NO. 120-90; Adoption of the Annual Current Expense Budget for 1991 with Special Revenue Funds and the County Road Construction Program and Setting the Property Tax Levy. 2. Application for Assistance from the Soldiers' and Sailors' Relief Fund; Delmer L. Sayer $500.00 3. RESOLUTION NO. 121-90; Hearing Notice; 1990 Budget Appropriations/Extensions; Various County Departments. The hearing was set for January 14, 1991 at 10:00 a.m. in the County Commissioners Chambers. Applications for Assistance from the Soldiers' and Sailors' Relief Fund: Commissioner B.G. Brown moved to approve these requests for assistance from the Soldiers' and Sailors'. Relief Fund as presented for Larry Tally $500, Joseph Kurtzo $200, and Michael J. Kelly $250. Commissioner Dennison seconded the motion which carried by a unanimous vote.
