Brown in the absence of Chairman John L. Pitts. Commissioner Larry W. Dennison was present. Larry Kohrdt re: Discharge of Firearms in an area adjacent to a County-ROad: Mr. Kohrdt reported that there have been people dischargtng firearms near his home from the Old Beaver Valley Road. He has complained to the Sheriff's Office and has turned in witness statements but was told that this shooting is only illegal if it is done from a County Road. The road was vacated by .the County in 1931 when a new, straighter road was constructed in this area across from the Beaver Valley Store. Even though the road was vacated, Mr. Kohrdt advised the Board that the County road crews have maintained the road. Commissioner Brown advised Mr. Kohrdt that the Sheriff's Office and the Prosecuting Attorney have the responsibility of _ enforcing the law.~he Board will have the Public Works Department research their records to determine if this road is private or public. John Leare: County's concurrence to variance for installa- tion of sewer line-under small stream: John Lee explained that the gravity fed sewer collection line from the buildings of the proposed shopping center site at Port Ludlow will need to be installed under a ravine to reach~the s~ptic tank. State regulations require that sewer lines shall be kept at least ten feet from surface water. Mr. Lee asked that the County concur with the project proponents request for a waiver of this separation requirement from the Department of Social and Health Services and noted that the proponent is agreeable to doublecasing the sewerline with an unjointed pipe for a distance of fifty feet on each side of the ravine. Commissioner Dennison moved to direct Randy'Du);ant, Environmental Health Director, write a letter to the Department of Social and Health Services presenting Mr; Lee's request for a waiver of the regulations to allow the installation of a sewer line under the Towncenter ravine and advising DSHS that the County has no objection to the waiver with the condition regardIDgthe double cased, unjointed pipe as sug- gested by the project proponent. Commissioner Brown seconded the motion.
