HomeMy WebLinkAbout13 1206 04�irc�s C°de STATE OF WASHINGTON County of Jefferson AUTHORIZING AND ESTABLISHING } FEES FOR JUVENILE COURT } ORDINANCE NO. 13-1206-04 DIVERSION SERVICES } WHEREAS, RCW 13.40.085 authorizes the County to establish fees to cover the costs of the administration and operation of diversion services provided under this chapter; and, WHEREAS, RCW 13.40.085 also states that "the parent or legal guardian of a juvenile who receives diversion services must pay for the services based on the parent's or guardian's ability to pay;" and, WHEREAS, the Juvenile Court Administrator has reviewed the fees charged by other Counties for these services and has determined fair and equitable fees to be charged in Jefferson County. NOW, THEREFORE, BE IT ORDAINED by the Jefferson County Board of Commissioners that the following shall apply: Section One: Purpose The purpose of this ordinance is to authorize the Juvenile Court Diversion Program of Jefferson County to charge fees to cover the costs of the administration and operation of diversion services provided under RCW 13.40.085. Section Two: Fee The fee for each case shall be thirty five dollars ($35.00) provided that no juvenile who is eligible for diversion as provided in RCW 13.40 may be denied diversion services based on an inability to pay for the services. A second tier fee of fifty dollars ($50.00) will be charged for a second diversion. The Juvenile Court Administrator shall have final authority to determine if the fee will be waived. Section Three: Collection of Fee The Superior Court Clerk of Jefferson County shall collect this fee in the same manner that other fees and charges are collected. Section Four: Payment of the Fee to County Treasurer Upon collection, the Superior Court Clerk of Jefferson County shall remit the fee to the Jefferson County Treasurer in accordance with the schedule set for the collection of fees. Ordinance No. 13-1206-rPJuvenile Court Diversion Fees Page: 2 Section Five: Savings Clause If any court shall find any provision of this ordinance or its application to any person or circumstance to be unconstitutional or otherwise invalid, such findings shall not affect the validity of all remaining portions of this ordinance or the application of this ordinance to other persons or circumstances. Section Six: Repeal and Replace This ordinance repeals and replaces ORDINANCE NO. 05-0708-02, adopted by the Jefferson County Board of Commissioners on July 8, 2002.
