In the Matter of an Ordinance Establishing Policy}
That Will Limit the Use of Conservation Futures }
Fund Monies to the Acquisition of Easements }
STATE OF WASHINGTON
County of Jefferson
ORDINANCE NO. 20-1220-04
WHEREAS, the Washington State legislature has provided for the acquisition of
open space land pursuant to Title 84.34 RCW; and,
WHEREAS, Jefferson CoWlty has identified preservation of open space as
important to and for County residents; and
WHEREAS, the preservation and enhancement of existing open space lands is a
stated goal of the COWlty'S 1998 Comprehensive Plan; and,
WHEREAS, it is the desire of the Board of County Commissioners to keep the .
maximum amoWlt ofland in private ownership in Jefferson County as possible; and,
WHEREAS, one way of achieving this goal of private ownership is to purchase
easements over land, rather than fee simple title, thus leaving the land on the tax rolls and
in private stewardship; and,
NOW, THEREFORE, BE IT HEREBY ORDAINED, by the Board of
Commissioners of Jefferson County, Washington that:
Section 1 - Conservation Futures Tax
The Conservation Futures Tax established by Ordinance 06-0708-02 is a tax imposed
upon every taxable property, as defined in Chapter 84.34.230 RCW occurring within
Jefferson County.
Section 2 - Conservation Futures Advisorv Board
The Conservation Futures Advisory Board, established by Resolution No. 43-99, makes
recommendations to the Board of County Commissioners.
Section 3 - Limitations ImpOsed uoon the Conservation Futures Advisory Board
Ordinance 06-0708-02, establishing the Conservation Futures Advisory Board and the
Conservation Futures Tax authorizes the County to use the funds generated by said tax
for purposes as authorized by the laws of the State of Washington, including the cost of
acquisition of fee simple title in real property as well as other rights and interests in real
property pursuant to RCW 84.34.210 and 84.34.220.
Section 4 - Further Limitations imoosed
Not withstanding the authorization to acquire fee simple title and other rights and
interests in real property, if it is necessary to acquire property in fee simple because of the
desires of the sellers, the County shall dispose of such property, if practicable, as soon as

Fund monies to the acquisition of easement
practicable, retaining an easement over the portion of the property that fulfills the
restrictions desired by the County.
Section 5 - Effective Date and Expiration Date
This ordinance shall take effect the 27th day of December, 2004.
Section 6 - SeverabilitY -
If any provision of this ordinance or its application to any person or circumstance is held
invalid, the remainder of this ordinance or the application of the provisions to other
persons or circumstances is not affected.
