RESOLUTION NO. 30-03
WHEREAS, the Jefferson County Parks Department discovered that the
recently constructed Satterlee residence (Assessor parcel No. 701282003) and
appurtenances encroach upon the southerly boundary line of the Broad Spit Park
Property (Assessor parcel N. 701252001), located in Section 28, T27N, Range 1
West, off Lindsay Hill Road, Bolton Peninsula, near Quilcene WA, and;
WHEREAS, the property owner, Mr. Satterlee, after learning of the
encroachment, had the common boundary line surveyed by a licensed
professional land surveyor and also employed a licensed professional Appraiser
to perform an appraisal to estimate the diminution in market value (damages) of
the subject property as a result of said encroachment, and;
WHEREAS, through the appraisal and appraisal review process it has
been determined that it is physically and economically unfeasible to relocate said
encroachments, and;
WHEREAS, the encroached upon area does not meet the requirements to
become a separate parcel under current Jefferson County Codes and
regulations, and;
WHEREAS, the Jefferson County Parks Department determined that the
area of encroachment could be separated from the main property without
detriment to the park and the uses of the park, and;
WHEREAS, it is the desire of Jefferson County to resolve this
encroachment issue fairly and without expensive litigation, and;
WHEREAS, it has been determined that a Boundary Line Adjustment will
ensure that the Satterlee parcel is defined in such a way that the encroachment
area is included and legal Building Code setback requirements are met.
NOW, THEREFORE, BE IT RESOL VED, by the Jefferson County Board
of County Commissioners, that the County authorizes a boundary line adjustment
and conveys to the Satterlee's by Deed (Attachment A to this Resolution) only
the amount of park property necessary to resolve the encroachment issue.

BE IT FURTHER RESOLVED, that approval of the Boundary Line
Adjustment and Deed are contingent on Mr. Satterlee et al compensating the
Jefferson County Parks Department for damages and expenses incurred as a
result of the encroachments.

The Grantor, JEFFERSON COUNTY, a Municipal Corporation, P.O. Box 1220, Port
Townsend Washington, 98368, for and in consideration ofthe sum of Sixty Six Thousand
Nine Hundred and NO/100---($66,900.00)---Dollars and other valuable consideration,
conveys and quit claims to the Grantee, David W. Satterlee and Margita Satterlee, husband
and wife, the following described real estate, situated in the County of Jefferson, State of
Washington:

This Conveyance is for the purpose of resolving a Boundary line encroachment issue and
defining the Southerly Boundary line of the Jefferson County Park Property, APN
701282001, and the northerly limits for the Satterlee Property, APN 701282003. It shall not
create any additional lots, tracts, parcels, or division.
All situate in the County of Jefferson, State of Washington.
Affecting Assessor Parcel Numbers: 701282001 & 701282003
The land being conveyed herein contains an area of approximately 1.51 acres more or less.
